Minutes of the Millcreek City Council January 10, 2023 6:30 p.m. Work Meeting 7:00 p.m. Regular Meeting The City Council of Millcreek, Utah, met in a special public work meeting and regular meeting on January 10, 2023, at City Hall, located at 3330 S. 1300 E., Millcreek, UT 84106 in lieu of the regularly scheduled meeting on Monday, January 9, 2023. The meeting was live streamed via the City's website with an option for online public comment. Staff Reports There were none. 2. Discussion of Agenda Items, Correspondence, and/or Future Agenda Items There was none. 3. Closed Session per Utah Code §52-4-205(e) Strategy Sessions to Discuss the Sale of Real Property Council Member Jackson moved to go into a closed meeting per Utah Code §52-4-205(e) Strategy Sessions to Discuss the Sale of Real Property at 6:32 p.m. Council Member Catten seconded. Mayor Silvestrini called for the vote. Council Member Catten voted yes, Council Member DeSirant voted yes, Council Member Jackson voted yes, and Mayor Silvestrini voted yes. Welcome, Introduction and Preliminary Matters 1.1 Pledge of Allegiance Mayor Silvestrini called the meeting to order and led the pledge of allegiance. 1.2 Public Comment There were no coinments. 2. Business Matters 2.1 Discussion and Consideration of Resolution 23-04, Approving an Appointment to the Millcreek Planning Commission Mayor Silvestrini indicated that Dwayne Vance had been involved with the city since before incorporation and had previously applied to be part of the planning commission. Due to the resignation of Aryel Cianflone, a vacancy for her terin existed. Instead of seeking new applications, the selection committee decided to appoint Mr. Vance. Council Member Jackson commended Vaiice's abilities to serve in the capacity. Council Member DeSirant moved to adopt Resolution 23-04, Approving an Appviiiioicnt to the Millcreeli rlauiiiug COuiua,15!On. Council Member Catten seconded. The Recorder called for the vote. Council Member Catten voted yes, Council Member DeSirant voted yes, Council Member Jackson voted yes, and Mayor Silvestrini voted yes. The motion passed unanimously. Mayor Silvestrini noted the planning commissioners served without city compensation. 2.2 Discussion and Consideration of Resolution 23-01, Approving the First .'!.mcpdmeqt to the Interlocal Cooperation Agreement Between Millcreek and Salt Lake County for Traffic Signal Installation 4115 S (Central Ave) Main Street John Miller said the resolution added additional time to the original contract. Mayor Silvestrini noted the city contracted with Salt Lake County for signal maintenance and this agreement would add a new signal on Central Avenue. Miller said it was decided to add a light there one and half years ago, but utilities were damaged during the boring.  Millcreek City Council Meeting Minutes 10 January 2023 Page 3 of 6 The county would continue the project when the repairs to the utilities were made. Council Member Jackson asked if the county coordinated the timing of signals across jurisdictions. Miller confiri'ned. Council Member Catten moved to approve Resolution 23-01, Approving the First Amendment to the Interlocal Cooperation Agreement Between Millcreek and Salt Lake County for Traffic Signal Installation 4115 S (Central Ave) Main Street. Council Member Jackson seconded. The Recorder called for the vote. Council Member Catten voted yes, Council Member DeSirant voted yes, Council Member Jackson voted yes, Mayor Silvestrini voted yes. The motion passed unanimously. 2.3 Discussion and Consideration of Resolution 23-02, Approving an Interlocal Cooperative Agreement for Traffic Signal Installation (Upgrade Multiple Locations) Mayor Silvestrini said this was an agreement to update existing signals. Miller noted the estimated cost was $29,900. Council Member Catten moved to approve Resolution 23-02, Approving an Interlocal Cooperative Agreement for Traffic Signal Installation. Council Member DeSirant seconded. The Recorder called for the vote. The motion passed unanimously. 2.4 Discussion and Consideration of Resolution 23-03, Approving a Cooperative Agreement Between UDOT and Millcreek to Maintain a Pedestrian Safety Project Located at SR-171 from 1885 East to 1940 East Mayor Silvestrini said Millcreek had been trying to install sidewalks on 3300 S. since incorporation. This section was problematic with securing right-of-way and it costing more than anticipated. The additional cost would be covered by UDOT through a grant in exchange for Millcreek matching 25% of construction costs and agreeing to maintain the sidewalk after it is installed and agreeing to pay half of relocating utilities costs. Miller said the city applied for the grant in 2019 and the costs went up. The city released the grant funding and reapplied for the higher amount, which was awarded. Mayor Silvestrini said adding sidewalks on 3300 S. was a priority of his. Miller noted this sidewalk was on the south side of the street near Evergreen Junior High School. Council Member Jackson moved to adopt Resolution 23-03, Approving a Cooperative Agreement Between UDOT and Millcreek to Maintain a Pedestrian Safety Project Located at SR-171 from 1885 East to 1940 East. Council Member Catten seconded. Mayor Silvestrini said there had been consultants involved in negotiating for the right-of-way. The sidewalk would change the grade of yards and driveways, so engineering was involved. He was pleased to see the project realized. Council Member Jackson said the council was trying to make the street more pedestrian safe. Miller credited Mason Adamson, staff engineer, in performing a lot of the work on the project. The motion passed unanimously. Mfflcreek City Council Meeting Minutes 10 January 2023 Page 4 of 6 2.5 Discussion and Consideration of Ordinance 23-01, Amending Section 2.82.100 of the Millcreek Code of Ordinances Regarding Appeals of the City's Classification of a Record, the Fees Charged for a Record, or by a Response to a Record Request Elyse Sullivan said the current code allowed people to appeal her GRAMA decisions to the mayor twice then appeal to a records appeals board that could be created by Millcreek. The amended code would simplify the appeal process so the first appeal would go to the city manager or mayor, whichever was designated as the chief administrative officer, then the next appeal would go to the State Records Committee. Mike Winder noted in other areas of the code the chief administrative officer was the city manager, so for consistency, he recoinrnended appeals be to the city manager. Council Member DeSirant moved to adopt Ordinance 23-01, Amending Section 2.82.100 of the Millcreek Code of Ordinances Regarding Appeals of the City's Classification of a Record, the Fees Charged for a Record, or by a Response to a Record Request. Council Member Jackson seconded. Council Member DeSirant and Mayor Silvestrini commended city staff. The Recorder called for the vote. Reports 3.1 Mayor's Report Mayor Silvestrini reported the Promise Program Advisory Council met. The Promise Program had been having a lot of success and had a lot of projects in the works. He said the Millcreek Common ice ribbon had been successful and had generated over $170,000 in revenue to the city in the month of December 2022. The goal was to cover costs, not make money. He noted Millcreek Comi'non had won two local awards. The mayor was excited for the upcoming legislative session. He felt there would be meaningful progress with addressing homelessness. The average intake for Millcreek's overflow homeless shelter was 90 people a night. Law enforcement had been getting calls for service within the shelter but not from outside the shelter. He credited law enforcement for their work. 3.2 City Councn Member Reports Council Member Catten said the Point in Time Count, which counted homeless individuals in the county, would be taking place on January 26Ih. She noted she would be participating. She reported she was the new chair for the South Salt Lake Valley Mosquito Abatement District and unofficially the chair of the Jordan River Commission. Council Member DeSirant noted he would also be attending the legislative session in his professional capacity. 3.3 Staff Reports Mike Winder reported he met with Stan Penfold of Green Bikes to discuss potentially having a station in Millcreek's new Jordan River trailhead. There may also be a future for it at Millcreek Common. Winder said every three years the city has the opportunity to be a Community Development Block Grant (CDBG) city with the federal government. The city currently contracts with the county through the Urban County Program and staff concluded that the city should stay with the county and not be a CDBG city. The mayor explained all of the work associated with a city doing it on its own, and agreed it was wise to stay with the county. Millcreek City Council Meeting Minutes 10 January 2023 Page 5 of 6 Elyse Sullivan reported that the county was willing to support ranked choice voting that year for municipal elections. The county intended to meet with all of the city recorders at the end of the month to discuss contracts and costs. She told the city council the dates for the candidate declaration period for a traditional election and ranked choice voting election, and that the council needed to decide before May Ist if they would opt into ranked choice voting. She noted the cost for elections would be higher that year than in 2021 since ballots would be going to the whole city for the mayoral election instead of only two council districts. Council Member DeSirant advocated for ranked choice voting for cost savings and system preference. Council Member Catten asked about any surveys. Winder said the only survey conducted was through an organization called, Utah Ranked Choice Voting, which was not targeted specifically at Millcreek. The respondents had a favorable view of ranked choice voting in all cities but Sandy. Mayor Silvestrini requested a survey of Millcreek residents on ranked choice voting. Mike Winder noted the printed newsletter deadlines-were coming up and the city could put an article in about the election..The council would like a survey on ranked choice voting in the e-newsletter. Council Member Uipi arrived at the meeting. 4.
