BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 9, 2025, at 7pm The Borough Council Meeting of the Milltown Borough Council was held on June 9, 2025, 2025, at Milltown Borough Hall, 39 Washington Avenue, Milltown, New Jersey. The meeting was called to order by Mayor Murray at 7:00PM. The Borough Clerk read the following statement: Adequate notice of this meeting has been provided as required under Chapter 231, P.L. 1975, specifying the time, date, and location by posting a copy of the notice on the Municipal Building, Municipal Website, providing a copy of the Annual Notice Schedule to the official newspapers of the Borough and is on file in the Clerk’s Office. First Reading Ordinance: Ordinance 25-1567 was read by title ORDINANCE 25-1567 AN ORDINANCE AMENDING CHAPTER 7, TRAFFIC, SECTION 7-14, PARKING PROHIBITED AT ALL TIMES ON CERTAIN STREETS, TO IMPOSE PARKING RESTRICTIONS ON VARIOUS STREETS WITHIN THE BOROUGH OF MILLTOWN. Chapter 7, Traffic, Streets, Section 7-14, Parking Prohibited at All Times on Certain Streets, is amended to add the following: Name of Street Sides Location Garver Avenue North From a point 186 feet east from the east side of North Main Street, east for 84 feet North Wilson Avenue West From the north side of Washington Avenue, north for 90 feet SECTION 2. All Ordinances or parts of Ordinance inconsistent with the provisions of this Ordinance shall be and the same are hereby repealed. SECTION 3. If any paragraph, clause, provision, sentence, or application of this Ordinance is declared invalid for any reason whatsoever, the same shall not affect the validity or constitutionality of any other paragraph, clause, provision, sentence, or application of this Ordinance. SECTION 4. This Ordinance shall take effect upon passage and publication as provided by law; and upon approval by the Commissioner of the Department of Transportation, if required. First Reading Ordinance Ordinance 25-1568 was read by title ORDINANCE 20-1568 Ordinance to Fix and Amend Salaries and Wages for Milltown Borough Employees to Include Full-Time Confidential Secretary Page | 2 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 9, 2025, at 7pm WHEREAS, the Salary Ordinance of the Borough of Milltown confirms the titles of officers and employees of the Borough and establishes their respective compensation, and the Ordinance remains in effect until amended or superseded; and WHEREAS, the Borough Council wishes to amend the Salary Ordinance to include a full-time position of Confidential Secretary to the Business Administrator; NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Milltown as follows: Section 1. The aforesaid Salary Ordinance is hereby amended and supplemented as follows: A. The salary ordinance is amended to include the full-time position of Confidential Secretary to the Business Administrator with an annual salary range of $60,000 to $72,000 B. This position shall be an unclassified, non-union position in the Borough of Milltown. Section 2. All Ordinances or parts of Ordinances inconsistent here within are hereby repealed. Section 3. This Ordinance shall become effective upon final publication as required by law. Councilman Posnansky inquired whether this position was a new position and whether there would be a new hire to the position. Business Administrator Carr explained that the creation of this position allows the current employee, as a confidential employee, to perform personnel duties in the Administrator’s office. Second Reading Ordinance/Public Hearing: The Clerk read Ordinance 25-1560 by title: Page | 3 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 9, 2025, at 7pm ORDINANCE 25-1560 Ordinance to Amend Chapter XXXIV, Comprehensive Development, Section 34-14, Schedule of Fees, of the Revised General Ordinances of the Borough of Milltown BE IT ORDAINED by the Borough of Milltown of the County of Middlesex and State of New Jersey that the Revised General Ordinances of the Borough of Milltown be amended as follows: Section 1. Chapter 34, Comprehensive Development, Section 34-14 Schedules and Fees, Fees of the Revised General Ordinances of the Borough of Milltown is hereby amended as follows: § 34-14.1 Application Fees a. Subdivision Application Fees. 1. Sketch Plat Fees. (a) Sketch plat for minor subdivision (3 or less lots): $100 $150 plus $20 per lot. (b) Sketch plat for major subdivision: $250 $300 plus $25 per lot. (c) The fee for any submission of any revised sketch plat which has or has not received approval shall be 1/4 of the original submission fee. $150 2. Preliminary Major Subdivision Fees. (a) The fee for one through 5 lots shall be $100 per lot. The fee for six lots and thereafter shall be $200 per lot. $250 per lot (b) The extension of preliminary plat approval as set forth and defined in N.J.S.A. 40:55D-52 shall be 1/4 one-third of the original application fee. (c) The fee for any resubmission of any revised preliminary plat which may or may not have received approval shall be 1/4 one-third of the original submission fee. 3. Final Major Subdivision Fees. (a) The fee for final plat subdivision shall be $50 $75 per lot. (b) The fee for the extension of final approved plat for purposes of recording plats shall be 1/4 one-third of the preliminary subdivision fee. (c) The fee for any resubmission of any revised final plat which may or may not have received approval shall be 1/4 one-third of the final subdivision fee. b. Site Plans Application Fees. 1. Minor Site Plan Fees. (a) For nonresidential uses: a fee of $100 $250 plus $10 $15 for each 1,000 square feet of floor area. (b) For residential uses: a fee of $100 $150 plus $10 $15 for each dwelling unit. (c) The fee for any resubmission of any revised plat which may or may not have received approval, shall be 1/4 one-third of the original submission fee. (a) Nonresidential preliminary site plan fee shall be $300 $500 plus $0.10 $0.15 per square foot of gross floor area of new construction up to 100,000 square feet and thereafter $0.01 per square foot. (b) Residential preliminary site plan fee shall be $100 per dwelling unit. (c) Final site plan fee shall be 1/2 the original application fee paid at preliminary application. (d) The fee for any submission of revised site plan which may or may not have received approval shall be 1/4 of the original application fee. (e) The extension of site plan approval as set forth and defined in N.J.S.A. 40:55D-52 shall be 1/4 of the original application fee. c. Variances and Appeals Application Fees. 1. Fee to hear and decide appeals (N.J.S.A. 40:55D-70a) shall be $100. 2. Fee for interpretation of Zoning Regulations or Zoning Map (N.J.S.A. 40:55D-70b) shall be $75. 3. Fee for bulk variances (N.J.S.A. 40:55D-70c) shall be $100, $200 or $15 $20 per individual bulk violation, whichever is greater. 4. Fee for use variances (N.J.S.A. 40:55D-70d) shall be $250. $300 d. Conditional Use Application Fees. The fee for conditional use application shall be based on paragraph b above. e. Other Fees. 1. The fee for a building permit in conflict with the official map or building permit not related to a street shall be $100. 2. The fee for a Zoning Use Permit, based on gross floor area: 0 — 500 square feet $50 $75 501 — 1,500 square feet $75 $100 1,501 — 3,000 square feet $100 $150 3,001 — 5,000 square feet $150 $300 5,001 — 10,000 square feet $300 $600 Over 10,000 square feet $600 $1000 3. Special meetings scheduled only upon request of the applicant and if agreed to by the Board at its discretion shall be $250. $1000 4. An additional fee of $250 $500 per hearing night shall be paid for any hearing or any type of application where testimony extends more than two meetings. Informal review of development concept plan for minor subdivision: $100. $150 Informal review of development concept plan for major subdivision or any site plan: $250. $350 6. General development plan: A fee of $150. 7. Certified list of property owners: $0.25 per name or $10 whichever is greater. 8. Copy of transcripts prepared at cost to the Borough: $1.50 per page for the first copy of the page, plus $0.50 per copy of each additional copy of the page. The estimated amount of the cost shall be deposited into an escrow account. 9. Copy of minutes or decisions. (a)One to 10 copies: $0.75 per page. (b) 11 to 20 copies: $0.50 per page. (c) 21 plus copies: $0.25 per page. 10. Capital project statutory review: $100. § 34-14.2 Fees for Escrow Deposit Accounts Applications. 1. Escrow Deposits for Professional Services: (a) The Planning Board shall require fees for technical and/or professional services and testimony employed by the Board in reviewing, processing and memorializing an application, including the review services of the Borough Engineer and Planner, Board Attorney and such other experts as may be deemed necessary (i.e. Traffic, Landscaping, Environmental, Soils, etc.). Fees required for this purpose shall be held in an escrow account by the Borough. (b) Fees for technical and professional services shall be in addition to any and all other required fees. 2. Applicants required to submit Escrow Deposits; Exemptions: (a) All applicants to the Planning Board, with the exception of those applications involving one single- family dwelling shall submit fees or escrow deposits in accordance with this chapter. (b) When the reviewing Planning Board determines that the application will serve a public purpose and promote the public health, safety and welfare, the following applicants may submit 50% of the required escrow deposit: (1) Public organizations and/or agencies; (2) Charitable and/or philanthropic organizations; (3) Fraternal and/or religious nonprofit organizations. (4) All applications proposing development of housing units providing for all low and/or moderate income families. Page | 6 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 9, 2025, at 7pm (c) Any organization qualifying for paragraph 2(b) above must hold a tax-exempt status under the Federal Internal Revenue Code of 1954 (26 U.S.C. Sec. 501 (c) or (d)). 3. Submission of Escrow Deposits: (a) The applicant shall submit the required escrow deposit to the Borough Clerk prior to the application being reviewed for completeness. No application shall be determined complete, reviewed by professional staff or placed on the agenda for public hearing until the required escrow deposit is paid. (b) Required escrow deposits shall be in the form of cash, money order or certified check payable to the Borough of Milltown. 4. Escrow for Informal Review: (a) Whenever an applicant requests an informal review of an application for development, involving technical or professional advisors, an escrow deposit shall be required in accordance with the schedule for formal applications. The deposit must be received prior to professional review. (b) Any escrow deposit received for informal review shall be credited to the required escrow deposit for formal applications. The cost for professional services involved in the informal review shall be considered part of the formal application review and charged to the escrow account. (c) Informal Review Fees. (1) Minor subdivision or minor site plan: $100. $1,000 (2) Major subdivision or major site plan or use variance: $500 $1,000 (3) Capital Projects Statutory Review: $750 $1,000 (4) Use Variance $1,000 5. Schedule of Required Fees for Escrow Deposits: (a) The following sums are required to be deposited in an escrow account for applications to the Planning Board: (1) Variances i. Variance under N.J.S.A. 40:55D-70d, not requiring site plan or subdivision approval (use, etc.): $1,000. a. Individual single-family home: $500 per variance b. Applicants should pay escrow deposit fees based upon 20% one-third of the original submission fee for each resubmission of revised plans, including applications for use variance, preliminary subdivisions, final subdivisions preliminary site plans, final site plans, and planned unit development applications. Page | 9 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 9, 2025, at 7pm (8) Special design elements - applicants shall pay escrow fees based upon twenty 20% of the original escrow fee, when and as determined by the Planning Board, that the proposed project includes a special design consideration, such as, but not limited to: sanitary sewer pump station, detention or retention ponds, potable water storage facility, traffic signalization device, off -tract improvements, etc. (9) Appeal from decision of Zoning Officer: $750. (10) Interpretation of Zoning Map or ordinance: $750. (11) Request for zoning change: $5,000. (12) Certificate of nonconformity (N.J.S.A. 40:55D-68): $750 Section 2. Each clause, section or subsection of this Ordinance shall be deemed a separate provision to the intent that if any such clause, section or subsection should be declared invalid, the remainder of the Ordinance shall not be affected. Section 3. All Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed as to the extent of such inconsistency. Section 4. Seeing none, Mayor Murray asked for roll call: ROLL CALL VOTE Motion Second Aye Nay Abstain Absent Council President Zambrana X X Councilman Collins X Councilman Manco X Councilwoman Payne X Councilman Posnansky X Councilman Potter X X Page | 10 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 9, 2025, at 7pm Second Reading Ordinance/Public Hearing: The Clerk read Ordinance 25-1561 by title: BOND ORDINANCE NO. 25-1561 BOND ORDINANCE PROVIDING FOR VARIOUS CAPITAL IMPROVEMENTS AND THE ACQUISITION OF VARIOUS CAPITAL EQUIPMENT, APPROPRIATING $1,515,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $1,001,000 BONDS AND NOTES TO FINANCE A PORTION OF THE COSTS THEREOF, AUTHORIZED IN AND BY THE BOROUGH OF MILLTOWN, IN THE COUNTY OF MIDDLESEX, NEW JERSEY BE IT ORDAINED by the BOROUGH COUNCIL OF THE BOROUGH OF MILLTOWN, IN THE COUNTY OF MIDDLESEX, STATE OF NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring), AS FOLLOWS: Section 1. The improvements described in Section 3 of this bond ordinance are hereby authorized as general improvements to be undertaken in and by the Borough of Milltown, in the County of Middlesex, New Jersey (the “Borough”). For the improvements or purposes described in Section 3, there is hereby appropriated the sum of $1,515,000, said sum being inclusive of all appropriations heretofore made therefor, including grant funds expected to be received from the New Jersey Department of Transportation (NJDOT) in the amount of $460,830, and the sum of $53,170 as the down payment for said purposes as required by the Local Bond Law, N.J.S.A. 40A:2-1 et seq. The down payment is now available by virtue of provision for down payment or for capital improvement purposes in the Capital Improvement Fund of one or more previously adopted budgets. Section 2. In order to finance the costs of said improvements or purposes not provided for by the application of the down payment, negotiable bonds are hereby authorized to be issued in the principal amount not to exceed $1,001,000, pursuant to the Local Bond Law. In anticipation of the issuance of said bonds and to temporarily finance said improvements or purposes, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law. Section 3. (a) The improvements hereby authorized and the purposes for which the obligations are to be issued consist of (i) the acquisition of a dump truck, pickup truck and chipper; (ii) 911 system upgrade; (iii) improvements to various roads within the Borough, including, but not limited to, North Brook Drive - Phase II; and (iv) Albert Avenue Park improvements, together with all purposes necessary, incidental or appurtenant thereto, all as shown on and in accordance with contracts, plans, specifications or requisitions therefor on file with or through the Borough Clerk, as finally approved by the governing body of the Borough. (b) The estimated maximum amount of bonds or notes to be issued for the improvements or purposes described in Section 3(a) hereof is $1,001,000, as stated in Section 2 hereof. (c) The estimated cost of the improvements or purposes described in Section 3(a) hereof is $1,515,000, which is equal to the amount of the appropriation herein made therefor. The excess of the appropriation of $1,515,000 over the estimated maximum amount of bonds or notes to be issued therefor being the amount of said $53,170 down payment for said purposes, and said grant funds expected to be received from the NJDOT in the amount of $460,830 for said improvements to North Brook Drive. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer of the Borough, provided that no note shall mature later than one (1) year from its date. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. 40A:2-8. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer, who shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer's signature upon the notes shall be conclusive evidence as to all such determinations. The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of such notes occurs, such report shall include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser. Section 5. The following additional matters are hereby determined, declared, recited and stated: (a) The improvements or purposes described in Section 3 of this bond ordinance are not a current expense and are improvements or purposes that the Borough may lawfully undertake as general improvements, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby. (b) The average period of usefulness of the improvements or purposes, within the limitations of the Local Bond Law and taking into consideration the amount of the obligations authorized for said purposes, according to the reasonable life thereof computed from the date of the bonds authorized by this bond ordinance, is 13.24113 years. (c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Borough Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such Statement shows that the gross debt of the Borough as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $1,001,000 and the obligations authorized herein will be within all debt limitations prescribed by that Law. (d) An aggregate amount not exceeding $250,000 for interest on said obligations, costs of issuing said obligations, engineering costs, legal fees and other items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included as part of the cost of said improvements and is included in the estimated cost indicated herein for said improvements. (e) To the extent that moneys of the Borough are used to finance, on an interim basis, costs of said improvements or purposes, the Borough reasonably expects such costs to be paid or reimbursed with the proceeds of obligations issued pursuant hereto. Section 6. The capital budget of the Borough is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Borough Clerk and is available there for public inspection. Any grant or similar moneys from time to time received by the Borough for the improvements or purposes described in Section 3 hereof, shall be applied either to direct payment of the cost of the improvements within the appropriation herein authorized or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are received and so used. Section 8. The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the Borough, and, unless paid from other sources, the Borough shall be obligated to levy ad valorem taxes upon all the taxable property within the Borough for the payment of the obligations and the interest thereon without limitation as to rate or amount. Section 9. This bond ordinance shall take effect twenty (20) days after the first publication thereof after final adoption, as provided by the Local Bond Law. Mayor Murray opened the meeting to public comment. Seeing none, the Mayor asked for Council comment. Councilman Posnansky inquired what the interest rate would be for this bond. Business Administrator Carr explained that the ordinance is a funding authorization and the Borough has not yet gone out for financing on these bond ordinances. For the improvements or purposes described in Section 3, there is hereby appropriated the sum of $145,000, said sum being inclusive of all appropriations heretofore made therefor, including the sum of $7,250 as the down payment for said purposes as required by the Local Bond Law, N.J.S.A. 40A:2-1 et seq. The down payment is now available by virtue of provision for down payment or for capital improvement purposes in the Capital Improvement Fund of one or more previously adopted budgets. Section 2. In order to finance the costs of said improvements or purposes not provided for by the application of the down payment, negotiable bonds are hereby authorized to be issued in the principal amount not to exceed $137,750, pursuant to the Local Bond Law. In anticipation of the issuance of said bonds and to temporarily finance said improvements or purposes, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law. Section 3. (a) The improvements hereby authorized and the purposes for which the obligations are to be issued consist of the acquisition of a utility truck for the Water/Sewer Utility, together with all purposes necessary, incidental or appurtenant thereto, all as shown on and in accordance with contracts, plans, specifications or requisitions therefor on file with or through the Borough Clerk, as finally approved by the governing body of the Borough. (b) The estimated maximum amount of bonds or notes to be issued for the improvements or purposes described in Section 3(a) hereof is $137,750, as stated in Section 2 hereof. (c) The estimated cost of the improvements or purposes described in Section 3(a) hereof is $145,000, which is equal to the amount of the appropriation herein made therefor. The excess of the appropriation of $145,000 over the estimated maximum amount of bonds or notes to be issued therefor being the amount of said $7,250 down payment for said purposes. Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer of the Borough, provided that no note shall mature later than one (1) year from its date. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. 40A:2-8. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer, who shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer's signature upon the notes shall be conclusive evidence as to all such determinations. The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of such notes occurs, such report shall include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser. Section 5. The following additional matters are hereby determined, declared, recited and stated: (a) The improvements or purposes described in Section 3 of this bond ordinance are not a current expense and are improvements or purposes that the Borough may lawfully undertake as Water/Sewer Utility improvements, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby. (c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Borough Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such Statement shows that the gross debt of the Borough as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $137,750 and the obligations authorized herein will be within all debt limitations prescribed by that Law. (d) An aggregate amount not exceeding $5,000 for interest on said obligations, costs of issuing said obligations, engineering costs, legal fees and other items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included as part of the cost of said improvements and is included in the estimated cost indicated herein for said improvements. (e) To the extent that moneys of the Borough are used to finance, on an interim basis, costs of said improvements or purposes, the Borough reasonably expects such costs to be paid or reimbursed with the proceeds of obligations issued pursuant hereto. Section 6. The capital budget of the Borough is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Borough Clerk and is available there for public inspection. Section 7. Any grant or similar moneys from time to time received by the Borough for the improvements or purposes described in Section 3 hereof, shall be applied either to direct payment of the cost of the improvements within the appropriation herein authorized or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are received and so used. Section 8. The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. RESOLUTION 2025-222 Authorizing Approval Request of Chapter 159 Insertion in CY2025 Municipal Budget - Clean Communities Grant WHEREAS, NJSA 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount was not determined at the time of the adoption of the budget; and WHEREAS, the NJSA 40A:4-87 provides that the Director may also approve the insertion of an item of appropriation for equal amount, WHEREAS, the Borough of Milltown has received notice of an award from the State of New Jersey for the Clean Communities Grant in the amount of $18,226.22 and wishes to amend its CY2025 Budget to include this amount as revenue; and NOW, THEREFORE, BE IT RESOLVED, that the Borough Council of the Borough of Milltown, County of Middlesex, State of New Jersey hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the CY2025 in the amount of $18,226.22. Page | 32 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 9, 2025, at 7pm Resolution Removed From the Consent Agenda: The Clerk read Resolution 2025-221 by title: RESOLUTION 2025-221 Resolution Endorsing the Fourth Round Housing Element and Fair Share Plan Adopted by the Borough of Milltown Planning Board on June 4, 2025 WHEREAS, on March 20, 2024, New Jersey Governor, Phil Murphy, signed into law P.L. 2024, c. 2, which amended the 1985 New Jersey Fair Housing Act (hereinafter the “Amended FHA”); and WHEREAS, on January 21, 2025, the Borough of Milltown adopted a binding resolution accepting the Present and Prospective Need calculated by the New Jersey Department of Community Affairs, establishing its Fourth Round Present Need of 13 affordable units and a Prospective Need of 51 affordable units; and WHEREAS, in accordance with Amended FHA and the Administrative Office of the Court’s Directive No. 14-24, the Borough of Milltown filed a timely Declaratory Judgment Action complaint (hereinafter the “DJ Action”) with the Affordable Housing Dispute Resolution Program (hereinafter the “Program”), along with its binding resolution, on January 22, 2025; and WHEREAS, the Borough did not receive any objections to its Present and Prospective Need numbers by February 28, 2025, resulting in the statutory automatic acceptance of the Borough’s Fourth Round obligations on March 1, 2025; and WHEREAS, on March 14, 2025, the Court entered an order establishing the Borough’s Fourth Round Present Need of 13 affordable units and its Prospective Need of 51 affordable units; and WHEREAS, upon establishment of the Borough’s Fourth Round Affordable Housing Obligations, the Amended FHA requires the Borough to adopt a Fourth Round Housing Element and Fair Share Plan by June 30, 2025; and WHEREAS, in accordance with the requirements of the Amended FHA, John Barree, AICP, PP of Heyer, Gruel & Associates, the Borough’s affordable housing planner, drafted a Fourth Round Housing Element and Fair Share Plan; and WHEREAS, upon notice duly provided pursuant to N.J.S.A. 40:55D-13, the Planning Board of the Borough of Milltown (hereinafter the “Planning Board”), adopted a Fourth Round Housing Element and Fair Share Plan, as well as a resolution memorializing its action in adopting the Fourth Round Housing Element and Fair Share Plan, on June 4, 2025; and Page | 33 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 9, 2025, at 7pm WHEREAS, the Borough Council of the Borough of Milltown wishes to endorse the Fourth Round Housing Element and Fair Share Plan. Councilman Collins remarked that this isn’t fair to Milltown as there isn’t space for 51 housing units within the Borough. Borough Attorney Vignuolo explained that the New Jersey state legislature has mandated a plan to be produced by the Borough. A reminder was also given that Community Pass is open for Milltown Day. Council President Zambrana wished everyone that celebrates a happy Pride month and also recognized the federal and state designated Juneteenth holiday to be observed the 3rd Friday of June, thereby falling on June 20th this year. Page | 34 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 9, 2025, at 7pm Councilman Collins stated, due to scheduling difficulties, he was unable to attend the Environmental Commission meeting. Library events were also announced. Councilman Manco reported that the electric utility has been working on downed wires on West Church Street, installing U.S. flags on Main Street for Memorial Day, lineman have reported to calls for power outages, and low hanging wires. Line clearance was also performed in various locations and some streetlights were replaced also. The water utility remains working on the water meter replacement project and issues with non-response from some residents. Councilman Manco also noted that everything possible is being done to prevent possible loss of services due to lack of response by the homeowners. Councilwoman Payne read the police report for May 2025. Chief Johnson requested that summer safety advisories be read regarding pedestrian and driver safety as well as parental and guardian responsibilities, bike helmets and swimming safety. The May Milltown Fire Department and the May Rescue Squad reports were also read. Councilwoman Payne wished to echo Council President Zambrana’s remarks with regard to supporting pride month and acknowledgement of Juneteenth. Councilman Posnansky read the Senior Center report and announced June events at the center, including a presentation by DPW Director, Raph Jasionowski regarding recycling program changes. Councilman Posnansky also reported on Public Works matters, including the filling and preparation of the Borough pool, pothole repairs, street sweeping activities and the changes to the recycling program utilizing the new large, wheeled totes provided by the Middlesex County Improvement Authority. Mr. Posnansky additionally reported on the replacement of a utility pole due to a car accident. Councilman Potter read the Recreation Department report, covering cartoon drawing classes, musical theater, Albert Avenue Camp, the borough pool, softball, adult yoga, beach volleyball, tennis and basketball activities. Councilman Potter also reminded all about the availability of Albert Avenue park rentals and to visit the recreation website for more information on all these topics and how to register for these programs. The Planning Board met on June 4th and is to meet next on July 9th.. Also announced, were 4th of July celebration events. Mayor Murray announced that the Milltown P.B.A. will be having their 2nd annual Food Truck Festival on June 14th, 2025, from 12pm-6pm at the American Legion Parking Lot. Council President Zambrana inquired whether the gallons were metered while filling the Borough pool. Councilman Potter stated that 363,200 gallons were used and will be monitored throughout the season. Reports from Borough Professionals The Borough Attorney had no report Page | 35 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 9, 2025, at 7pm Borough Engineer, Mike McClelland, gave an update on the water meter replacement project -1,494 have been completed, approximately 60%, and the number is dropping fast due to the Borough’s efforts. The Albert Avenue Bike Path project has commenced, and the contractor will work to not be in the way of the Albert Avenue Park Camp. Mr. McClelland also reported that he met with the County Community Development director regarding community development funds and will be coordinating regarding this in the future. Lastly, this evening, the Borough authorized the preparation of 2026 NJDOT grants, and they will require prioritization for submission. The Borough Administrator had no report The Borough Clerk reminded all that the Primary Election would be held the following day, June 10, 2025, and that polls would be open from 6am to 8pm. Old Business Councilman Collins inquired what needs to be done with the old recycling bins when the new totes are instituted Councilman Manco brought up that he would like to see the old DPW lot cleared out and a plan in place to utilize the property. New Business Councilman Collins stated that he read in the paper that Perth Amboy, via a grant, made their former DPW site a pocket park. Councilman Posnansky recalled that former a Councilman had received a reasonable quote to take down the DPW building and asked council to reconsider doing so. Councilman Manco said that he has spoken with some residents who feel a community center would be a good option for the parcel, or perhaps a pavilion. Another resident suggested a flea market or farm market area. Public Comment Mayor Murray opened the meeting to Public Comment. Council Comments Councilman Manco wished to recognize Jen Speezo as she leaves the PTO of the Joyce Kilmer school for all the hard work she put in for the kids. Mr. Manco also spoke regarding the job well done by the girl scouts on the gardens at the Senior Center, St. Paul’s Church and the Bradford Park purple project. Councilman Posnansky expressed gratitude for veterans in light of the recent anniversary of D-day. Councilman Posnansky also appealed to residents and council for the enactment of an empty lot ordinance to regulate vacant land and unsanitary conditions for public health and safety. Councilman Collins reminded all to vote the following day. Councilman Potter echoed Mayor Murray’s comments regarding the P.B.A. Food Truck Festival on June 14 and wished a Happy Father’s Day to all Dads and Grandfathers. Mayor Comments Mayor Murray had no comments ADJOURNMENT Mayor Murray asked for a motion to adjourn. Motion was made by Councilman Collins and seconded by Councilman Manco to adjourn the meeting.
