BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 23, 2025, at 7pm The Borough Council Meeting of the Milltown Borough Council was held on June 23, 2025, at Milltown Borough Hall, 39 Washington Avenue, Milltown, New Jersey. The meeting was called to order by Mayor Murray at 7:02 pm. The Borough Clerk read the following statement: Adequate notice of this meeting has been provided as required under Chapter 231, P.L. 1975, specifying the time, date, and location by posting a copy of the notice on the Municipal Building, Municipal Website, providing a copy of the Annual Notice Schedule to the official newspapers of the Borough and is on file in the Clerk’s Office. Presentation: Joe Glanzman, Senior Director of Business Development for OnSite Partners gave presentation on the Battery Storage System Project. Utilizing a power point presentation, Mr. Glanzman explained how the batteries will help the Borough electrical system during peak times of usage. He also gave an overview regarding revenues and fielded questions regarding a performance guarantee, safety standards, construction time, and the difference between the proposed storage system and the system in California that caused a horrible fire. Seeing no persons wishing to comment, Mayor Murray closed this portion of the meeting to the public. First Reading Ordinance: Ordinance 25-1569 was read by title Ordinance 25-1569 Ordinance to Fix and Amend Salaries and Wages for Milltown Borough Employees to Include Full-Time Apprentice Lineman WHEREAS, the Salary Ordinance of the Borough of Milltown confirms the titles of officers and employees of the Borough and establishes their respective compensation, and the Ordinance remains in effect until amended or superseded; and WHEREAS, the Borough Council wishes to amend the Salary Ordinance to include a full-time position of Apprentice Lineman; NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Milltown as follows: Section 1. The aforesaid Salary Ordinance is hereby amended and supplemented as follows: A. The salary ordinance is amended to include the full-time position of Apprentice Lineman to the Electric Department with an annual salary range of $45,650.00 to $65,400.00 Section 2. All Ordinances or parts of Ordinances inconsistent here within are hereby repealed. Section 3. This Ordinance shall become effective upon final publication as required by law. The date of July 7th, 2025, at 5pm was agreed upon by the Council. First Reading Ordinance Ordinance 25-1570 ORDINANCE OF THE BOROUGH OF MILLTOWN, COUNTY OF MIDDLESEX, STATE OF NEW JERSEY, AUTHORIZING A 15 YEAR LEASE TO ONSITE PARTNERS FOR A PORTION OF THE PROPERTY LOCATED AT BLOCK 60 LOT 5.062 FOR THE MILLTOWN ELECTRIC BATTERY STORAGE, DISPATCH AND MAINTENANCE SERVICES PROJECT. WHEREAS, the Borough duly advertised for the receipt of bids for the Milltown Electric Battery Storage, Dispatch and Maintenance Services; and WHEREAS, in response to the invitation to bidder’s, one conforming bid was received on or about May14, 2025 from OnSite Partners, LLC, 34 South 3rd Street, 4th Floor, Columbus, Ohio 43215; and WHEREAS, on May 28, 2025, the Borough of Milltown awarded a contract for the Milltown Electric Battery Storage, Dispatch and Maintenance Services to AEP OnSite Partners, LLC; and WHEREAS, pursuant to the bid specifications and contract, the parties are required to enter into a lease agreement with the bidder for a portion of the Borough owned property located at Block 60, Lot 5.062 on the Tax Map of the Borough of Milltown measuring approximately 140 feet by 200 feet; and WHEREAS, pursuant to the bid specifications, the Lessee desires to lease a portion of Block 60, Lot 5.062 on the Tax Map of the Borough of Milltown measuring approximately 140 feet by 200 feet for the installation of a battery storage facility; and WHEREAS, New Jersey law requires that such conveyance by authorized by ordinance. NOW, THEREFORE, BE IT ORDAINED by the Borough Council of the Borough of Milltown, County of Middlesex, and State of New Jersey, as follows: SECTION 1. The Borough hereby conveys to OnSite Partners, LLC a lease interest in a portion of Block 60, Lot 5.062 on the Tax Map of the Borough of Milltown measuring approximately 140 feet by 200 feet for the purpose of completing the Milltown Electric Battery Storage, Dispatch and Maintenance Services project. SECTION 2. If any paragraph, clause, provision, sentence, or application of this Ordinance is declared invalid for any reason whatsoever, the same shall not affect the validity or constitutionality of any other paragraph, clause, provision, sentence, or application of this Ordinance. SECTION 5. This Ordinance shall take effect upon passage and publication as provided by law. The salary ordinance is amended to include the full-time position of Confidential Secretary to the Business Administrator with an annual salary range of $60,000 to $72,000 B. Resolution 2025-231 Authorizing 2025-2026 Liquor License Renewal Golden Lion Inn, Inc (pocket license) Page | 11  BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 23, 2025, at 7pm WHEREAS, the Plenary Retail Consumption liquor license renewal application for Golden Lion Inn, Inc license number 1212-33-002-002 has been submitted; and WHEREAS, the Retail Renewal Application form for the 2025-2026 license term has been deemed complete in all respects, and the annual fees have been paid to both the Borough of Milltown and the State of New Jersey, Division of ABC; and WHEREAS, the Borough of Milltown Police Department reviewed said application and determined that no violations of the New Jersey Alcoholic Beverage Code exist on the respective premises; and WHEREAS, the Tax Collector has provided to the Borough Clerk a certification that all property taxes and assessments pertaining to the premises are current; and NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Milltown, County of Middlesex, State of New Jersey that the said liquor license is hereby renewed without special conditions for the period commencing July 1, 2025, until June 30, 2026, and the License certificate shall be retained by the Borough Clerk is until such time as the license is sold or the licensee activates the license with a suitable premise in Milltown. Resolution 2025-232 Authorizing Waiving Special Event Food License Fees National Night Out - August 5, 2025 WHEREAS, the Milltown Police Department will be hosting National Night Out on August 5, 2025;and WHEREAS, National Night Out is an annual community-building campaign that promotes police­ community partnerships and neighborhood camaraderie to make our neighborhoods safer, more caring places to live, and enhances the relationship between neighbors and law enforcement while bringing back a true sense of community. WHEREAS, the Milltown Borough Police Department has requested fees be waived for food vendors participating in this event; and NOW THEREFORE BE IT RESOLVED, by the Borough Council of the Borough of Milltown, County of Middlesex, State of New Jersey that the Borough Council grants the request for the waiver of Municipal fees. BE IT FURTHER RESOLVED, that Milltown Borough Officials, including, but not limited to the Mayor, Borough Administrator and Borough Clerk are hereby authorized and directed to take such ministerial actions as are necessary to effectuate the provisions of this resolution Page | 12  BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 23, 2025, at 7pm Resolution 2025-233 Authorizing Block Party and Road Closure – Courtlandt Street WHEREAS, Bill May has requested a street closing for Cortlandt Street at the corner of Garver Avenue and Courtlandt Street and also at Columbia Avenue and Courtlandt Street for the purpose of a Block Party; and WHEREAS, the closing will occur on Friday, July 4, 2025, between the hours of 12:00 PM and 10:00 PM; and WHEREAS, the aforesaid proposal has been reviewed and approved by the Chief of Police. NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Milltown, that a block party is hereby authorized as follows: Courtlandt Street will be closed as aforementioned to all but emergency vehicle traffic on Friday, July 4, 2025, between the hours of 12:00 PM and 10:00 PM. Resolution 2025-234 Appointing Confidential Secretary to the Business Administrator WHEREAS, the position of Confidential Secretary to the Business Administrator was created upon the adoption of Ordinance 25-1568, entitled “Ordinance to Fix and Amend Salaries and Wages for Milltown Borough Employees to Include Full-Time Confidential Secretary”; and WHEREAS, the Borough of Milltown desires to fill said created position; and WHEREAS, Stefanie Chando is qualified for the position of Confidential Secretary and has accepted the appointment to fulfill those duties. NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Milltown, County of Middlesex, State of New Jersey that Stefanie Chando be and is hereby appointed as Confidential Secretary to the Business Administrator for the Borough of Milltown. BE IT FURTHER RESOLVED the salary for this position shall be Sixty Thousand dollars ($60,000) per year in accordance with the salary ordinance. Page | 13  BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 23, 2025, at 7pm Resolution 2025-235 Appointing 2025 JIF Commissioner WHEREAS, the Borough of Milltown, (hereinafter "Local Unit") is a member of the New Jersey Intergovernmental Insurance Fund (hereinafter "Fund"), a joint insurance fund as defined in N.J.S.A. 40A: 10-36 et seq.; and WHEREAS, the Fund's Bylaws require participating members to appoint a Fund Commissioner; and an Alternate Fund Commissioner; and Milltown is in need of designating a Fund Commissioner due to the resignation of Monica Orlando; and NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Milltown, County of Middlesex, State of New Jersey that Stefani Chando is hereby appointed as the Fund Commissioner for the Local Unit for the year 2025; and BE IT FURTHER RESOLVED that the Local Unit's Fund Commissioner(s) are authorized and directed to execute all such documents as required by the Fund. WHEREAS, the Borough Council by Resolution No. 2024-305 dated November 12, 2024, authorized the award of a contract to Core and Main for the Water Meter Replacement Project in the amount of $1,376,365.00; and WHEREAS, the Borough's Engineer, CME Associates has determined that the work contained within this application for Payment No. 3 is complete; and WHEREAS, the Township's Engineer, CME Associates recommends that Payment No. 3 of $134,128.48 should be made in accordance with N.J.S.A. 40A:11-1 et seq.; and WHEREAS, sufficient Funds are available. Resolution 2025-241 Authorizing Professional Engineering Services - CME Associates Battery Energy Storage System Bid and Construction Phase NTE $ 78,497.00 WHEREAS, CME Associates has submitted expenditure requests outlining professional engineering services that will be provided to the Borough of Milltown; and WHEREAS, copies of said expenditure requests have been provided to the Borough Administrator and Borough Council for their review; and Page | 16  BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 23, 2025, at 7pm WHEREAS, the Borough of Milltown Council has deemed it appropriate to authorize the estimated expenditures as follows: Estimated Purchase Project Description Order Amount • Attend the bid opening • Review the property descriptions associated with the land lease agreement for the Project. • Review the electrical and site improvement working drawings and submittals for the materials to be incorporated into the Project. • Perform site observations of the ongoing improvements as needed. • Review revisions to the single line diagram for the substation incorporating the proposed energy storage system. • Review scope and results of the required system and commissioning testing. TOTAL $78,497.00 WHEREAS, Certification of Availability of Funds has been received from the Chief Finance Officer. Page | 17  BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 23, 2025, at 7pm CERTIFICATION OF FUNDS Resolutions Removed From the Consent Agenda: The Clerk read Resolution 2025-237 by title: RESOLUTION 2025-237 AUTHORIZING CREDIT CARD PAYMENTS FOR TAXES AND MUNICIPAL UTILITIES WHEREAS, the Department of Community Affairs, Division of Local Government Services has promulgated regulations, N.J.A.C. 5:30-9.1, et seq., authorizing municipalities to accept credit card payments in accordance with the provisions of the Administrative Code; and WHEREAS, in order for a municipality to accept credit card payments a resolution must be adopted by the governing body authorizing the same and stating the type of obligations which can be paid by electronic receipt and the types of electronic receipt that will be permitted; and WHEREAS, it is the intention of the Borough Council of the Borough of Milltown to authorize the Tax Collector’s office to accept payment by credit card for fees, costs or other payments associated with that department, and WHEREAS, the utilization of credit cards for payment of taxes, utilities, fees or costs must be in accordance with the provisions of N.J.A.C. 5:30-9.1, et seq. NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Milltown that the appropriate Borough officials be and are hereby authorized to allow the Tax Collector’s Office to accept credit card payments for municipal tax and utility bills; and BE IT FURTHER RESOLVED that the processor of the credit card, debit card and e-check services is authorized to charge the following fees: Credit Card or Debit Card 2.5% of the total payment E-Check $1.95 per transaction Page | 18  BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 23, 2025, at 7pm Councilman Collins questioned the fees to be charged. Business Administrator Carr explained that the 3rd party provider charges the fees,. Not Milltown Borough. Council President Zambrana asked if there would be an auto-pay feature, storing information and Administrator Carr replied there would not. Councilwoman Payne inquired how residents would be notified of these resolutions. Administrator Carr replied that notice would be given via a notice in their tax bills and on the tax portal. The credit cards and e-check payments are only an option for online payments, not in-person payment. Councilman Collins asked what the due date would be based on this time extension. Council President Zambrana - Finance, Administration, Planning, Personnel Reported that a finance meeting will held soon on the mid-year financial status of the borough. Councilman Collins – Environmental, Health, & Social Services Reported that the library will have a Jeep in the 4th of July parade and that the library provides free notary services to residents, 10 am -4pm Monday through Friday. Councilman Collins also reported upcoming library events. Councilman Manco - Utilities Reported that “red” letters would be going out to residents regarding the water meter replacement. Administrator Carr announced 652 letters would be going out the following day and will ask residents to call and speak with a scheduling technician. Checks will also be made for lead or galvanized steel pipes as well as ensuring there are operational sensors on the meters. Residents will be notified if lead or steel pipes are found and at a later date, a letter will be sent by the Construction office to the homeowners, advising them of the findings and the need to replace their water service lines. Council President Zambrana noted that the meter change is mandatory, not optional. Councilman Posnansky inquired whether, in the future when remote electric meters are to be installed, it will be optional to do so. Administrator Carr advised against making it optional. Councilman Manco also remarked against making electric meter replacement optional. Councilwoman Payne – Public Safety Reported on the Public Safety Committee meeting held the previous week, where crossing guards, a restructuring of the department and traffic flow were all discussed. Councilwoman Payne will also be having a conversation with the Milltown Fire Department regarding the training that will be needed for the new battery system. Page | 20  BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 23, 2025, at 7pm Councilman Posnansky – Public Works & Recycling Gave report on the Senior Center activities. For DPW, Councilman Posnansky reported on the pool opening, the bike path reconstruction, and the upcoming recycling collection changes, which will be addressing narrow street concerns. Councilman Posnansky inquired of Councilman Collins with regard to television communications, whether the Board of Education meetings could be televised, allowing the borough council liaison to be more involved. If this cannot be achieved, could discussions be had regarding the coordination of the Board of Education meetings and council meetings? Councilwoman Payne, the liaison to the Board of Education, indicated that communication is helpful and discussions could be had, however, the choice is left to the Board of Education on whether to televise or move their meetings. Councilman Manco stated, that as a parent, he receives many emails from the schools, however, the Board of Education could be more transparent and open to communication since the schools do affect taxes and home values. Councilman Posnansky also spoke regarding the former DPW property and his past suggestions for the site. In addition, Councilman Posnansky wished to recognize the Borough Police department as well as the national military branches. Councilman Potter – Parks & Recreation Councilman Potter read the Recreation Department report, covering musical theater, Albert Avenue Camp, the borough pool, the snack shack, softball, the splash squad, adult yoga, beach volleyball, pool availability for pool parties, swim lessons, tennis, basketball clinics and the availability of Albert Avenue park site rentals. The recreation website has more information on all these topics and how to register for these programs. The Planning Board is to meet next on July 9th.. Also announced, were 4th of July 100th Anniversary celebration events. Councilman Potter also thanked the Borough Engineers for their work on the new bike path at Albert Avenue Park. Mayor Murray had no report Reports from Borough Professionals The Borough Attorney had no report Borough Engineer, Lou Ploskonka reported on the water meter replacement project and the Albert Avenue Bike Path project The Borough Administrator had no report The Borough Clerk had no report. Old Business Councilman Collins wished to agree with Councilman Posnansky’s remarks, that Board of Education meetings should be televised. Councilwoman Payne added that the budget meeting for the Board of Education was not very publicized nor transparent and that meeting is where parents and taxpayers have to come out and ask questions about the budget and how much money the borough collects for the Page | 21  BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes June 23, 2025, at 7pm Board. It is hoped that the new superintendent will be more open to communication and transparency and, perhaps, coordinate meeting dates so they do not occur on the same day as Borough Council meetings. Councilman Manco agreed that the Board of Education needs to change their process. New Business Councilman Collins remarked that he has seen positive response to the new bike path and congratulated CME Engineers on a job well done. Councilman Collins also stated that he had spoken to Gov Deals to come to the DPW yard to look at the contents and condition of the building there and further questioned whether council approval would be needed to allow Gov Deals to take action. Administrator Carr responded that a resolution would need to be passed enumerating the specific equipment to be sold, as no borough property can be sold without the consent of the governing body. Goals and objectives would need to be set in order to go out to bid on an exact project for the premises. Until a plan is formulated, it cannot be executed. Councilman Collins wished everyone a Happy 4th of July. Mayor Murray inquired about a resolution of support for a Middlesex County project from the Borough. Borough Attorney Vignuolo will draft for the special meeting of July 7th. Public Comment Debbie Miller, 92 Ford Avenue • Announced that the Public Library provides notary services free of charge to Borough residents • Her meter change went smoothly Lee Weissenburger, 99 J.F.
