BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes July 21, 2025, at 7pm The Borough Council Meeting of the Milltown Borough Council was held on July 21, 2025, at Milltown Borough Hall, 39 Washington Avenue, Milltown, New Jersey. The meeting was called to order by Mayor Murray at 7:00 pm. The Borough Clerk read the following statement: Adequate notice of this meeting has been provided as required under Chapter 231, P.L. 1975, specifying the time, date, and location of this meeting by posting a copy of the notice in the Municipal Building, on the Municipal Website, and providing a copy of the Annual Notice Schedule to the official newspapers of the Borough. Notice is also on file in the Office of the Municipal Clerk. Presentation: Mr. Jim Polos, Executive Director of the Middlesex County Improvement Authority (M.C.I.A.), presented information regarding recent recycling changes in Milltown. He explained that beginning in August, the borough would transition to a new recycling program using automatic side-load service. Mr. Polos outlined the improvements of the new program: ● Residents would receive 95-gallon wheeled totes with lids ● The containers would keep materials dry and prevent debris from blowing around ● The new system would be more efficient and improve service levels Page | 1 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes July 21, 2025, at 7pm Mr. Polos noted that the borough's recycling coordinator had been very helpful in implementing the program. He then addressed several questions from council members: Council President Zambrana asked about the change from Thursday to Monday pickups. Mr. Polos explained this was based on scheduling efficiency, allowing for better service by deploying more trucks on Mondays. Council President Zambrana also inquired about narrow streets like Kuhlthau Avenue. Mr. Polos clarified that if the automated side-load trucks couldn't access certain areas, they would revert to rear- load collection using "mini packers" for those locations. Councilman Posnansky asked about reports that each arm operation would cost $5. Mr. Polos denied this, stating there was a flat fee per home and container with no additional charges. Councilman Potter asked if residents could purchase additional containers if needed. Mr. Polos confirmed this would be possible at a cost of under $100 per container, with the same pickup rate applying to for each container. Councilwoman Payne inquired about accommodating recycling during high-volume periods like Amazon Prime Day. Mr. Polos reiterated that the 95-gallon containers could hold substantial amounts if cardboard was broken down properly. Several council members asked about pickup start times, with Mr. Polos indicating it would likely be 7:00 AM, though he would verify this information. Public Comment: Mayor Murray opened the meeting to the public for comments on Resolutions on the Agenda. Nick Ligotti, 9 Janet Court, asked questions about three resolutions: Regarding Resolution 2025-265 (terminating contract with Heyer Gruel), Mr. Ligotti asked if there was an agreement in place with no recourse. Borough Attorney Vignuolo confirmed there was a 30-day termination clause that required payment only for services already rendered. Regarding Resolution 2025-261 (designating supervising certifying officer), Mr. Ligotti questioned whether an absentee CFO would cause problems. Council President Zambrana explained that there was also a backup certifying officer, and this resolution was simply replacing the former borough clerk who had left for another position. Regarding Resolution 2025-260 (crossing guard services contract), Mr. Ligotti asked about current costs compared to the contracted service. Council President Zambrana indicated he would provide details after the finance meeting the following day, explaining this was being pursued because of difficulty finding crossing guards, which resulted in police officers being pulled from other duties. Councilwoman Payne added that the police chief had conducted exhaustive research on this matter, and the Public Safety Committee had determined it was the right course of action after analyzing costs and benefits. WHEREAS, the Chief of Police of the Borough of Milltown ("Borough") has determined and recommended that it would be in the beneficial to establish the position of Captain of Police; and WHEREAS, the Chief of Police of the Borough of Milltown ("Borough") has determined and recommended that it would be in the beneficial to expand the position of Lieutenant of Police; and Page | 3 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes July 21, 2025, at 7pm WHEREAS, the Chief of Police of the Borough of Milltown ("Borough") has determined and recommended that it would be in the beneficial to clarify certain positions within the Police Department; and WHEREAS, the Borough concurs in this determination; and believes that the creation of the position of Captain of Police; the expansion of the position of Lieutenant of Police; and the clarification of certain positions within the Police Department are in the best interests of the residents of the Borough of Milltown. NOW, THEREFORE, BE IT ORDAINED by the Borough of Milltown of the County of Middlesex and State of New Jersey that the Revised General Ordinances of the Borough of Milltown be amended as follows: Section 1. Chapter 11, Establishment of the Police Department, of the Revised General Ordinances of the Borough of Milltown, Article 1, Establishment; Department Head; Membership, is hereby revised as follows: §11-1 ESTABLISHMENT; DEPARTMENT HEAD; MEMBERSHIP. There shall be a Police Department of the Borough, the head of which shall be the Chief of Police. The Chief shall be directly responsible to the appropriate authority for the efficiency and routine day to day operations thereof. The Department shall consist of a Chief of Police, a Captain of Police, up to three Lieutenants, up to eight Sergeants, Corporals and such other patrolmen, probationary officers, special police officers and employees as the Council may appoint. Section 2. Chapter 11, Establishment of the Police Department, of the Revised General Ordinances of the Borough of Milltown, Article 5, Head of Department, is hereby revised as follows: §11-5 HEAD OF DEPARTMENT. The Chief of Police shall be the head of the Police Department and shall be responsible to the Borough Council. In the temporary absence or disability of the Chief of Police, the Captain of the Department or the Lieutenant of the Department may act in place of the Chief of Police for the duration of the temporary duty. Section 3. Chapter 11, Establishment of the Police Department, of the Revised General Ordinances of the Borough of Milltown, Article 13, Captain of Police, is hereby added as follows: §11-13 CAPTAIN OF POLICE. §11-13.1 Responsibility in Absence of Chief. The Captain of Police, in the absence of the Chief of Police, may be charged with and be responsible for those duties prescribed for Chief of Police. The Captain of Police holds an administrative supervisory position under the supervision of the Chief of Police. The Captain of Police shall supervise Lieutenants who are in charge of Administrative and Daily/Field Operations. The Captain of Police shall supervise the accreditation program in the role of accreditation manager. The Captain of Police shall assist the Chief of Police with formulating and implementing policy, regulations, goals, and objectives of the Police Department. The Captain of Police inspects personnel and equipment to ensure that both meet Department standards; and performs such other duties as are directed by the Chief of Police and/or set forth in the Police Department's Standard Operating Procedures and Rules and Regulations. Section 4. Chapter 11, Establishment of the Police Department, of the Revised General Ordinances of the Borough of Milltown, Article 15, Lieutenant of Police, is hereby revised as follows: §11-4 LIEUTENANT OF POLICE. §11-14.1 Responsibility in Absence of Chief and Captain. The Lieutenant of Police, in the absence of the Chief of Police and/or Captain of Polce, may be charged with and be responsible for those duties prescribed for Chief of Police and/or Captain of Police. §11-14.1 Duties of Lieutenant. The Lieutenant(s) hold an administrative supervisory position(s) under the supervision of the Captain of Police. The Lieutenants’ duties shall include supervision of Administrative functions; Department Operations; and Field/Patrol duties. The Sergeants(s) hold an administrative supervisory position(s) under the supervision of the Chief of Police, Captain of Police and Lieutenant(s) of Police. Sergeant duties shall include supervision of all officers of lesser grade; including Corporals, Patrolman and Public Safety Telecommunicators. Sergeants inspect personnel and equipment to ensure that both meet Department standards and performs such other duties as are directed by the Chief of Police and/or set forth in the Police Department's Standard Operating Procedures and Rules and Regulation. Each clause, section or subsection of this Ordinance shall be deemed a separate provision to the intent that if any such clause, section or subsection should be declared invalid, the remainder of the Ordinance shall not be affected. Section 7. All Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed as to the extent of such inconsistency. Section 8. This Ordinance shall take effect immediately upon adoption and publication according to law. Ordinance Public Hearing, Second Reading: ORDINANCE 25-1569 ORDINANCE TO FIX AND AMEND SALARIES AND WAGES FOR MILLTOWN BOROUGH EMPLOYEES TO INCLUDE FULL-TIME APPRENTICE LINEMAN WHEREAS, the Salary Ordinance of the Borough of Milltown confirms the titles of officers and employees of the Borough and establishes their respective compensation, and the Ordinance remains in effect until amended or superseded; and WHEREAS, the Borough Council wishes to amend the Salary Ordinance to include a full-time position of Apprentice Lineman; NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Milltown as follows: Section 1. RESOLUTION 2025-244 Authorizing Payment of Municipal Obligations WHEREAS, the Borough Council of the Borough of Milltown, County of Middlesex, State of New Jersey finds and declares that certain municipal obligations have come due and are now payable; and WHEREAS, the Borough Council further finds and declares that said obligations have been itemized on the annexed schedules, which are hereby deemed part of this resolution. NOW THEREFORE BE IT RESOLVED that the Borough Council of the Borough of Milltown, County of Middlesex, State of New Jersey does hereby authorize payment of said municipal obligations, in accordance with the recommendations of the Chief Financial Officer in the total amount of $4,029,960.36. Resolution 2025-248 AUTHORIZING CREDIT CARD PAYMENTS FOR TAXES AND MUNICIPAL UTILITIES WHEREAS, the Department of Community Affairs, Division of Local Government Services has promulgated regulations, N.J.A.C. 5:30-9.1, et seq., authorizing municipalities to accept credit card payments in accordance with the provisions of the Administrative Code; and WHEREAS, in order for a municipality to accept credit card payments a resolution must be adopted by the governing body authorizing the same and stating the type of obligations which can be paid by electronic receipt and the types of electronic receipt that will be permitted; and WHEREAS, it is the intention of the Borough Council of the Borough of Milltown to authorize the Tax Collector’s office to accept payment by credit card for fees, costs or other payments associated with that department, and WHEREAS, the utilization of credit cards for payment of taxes, utilities, fees or costs must be in accordance with the provisions of N.J.A.C. 5:30-9.1, et seq. BE IT FURTHER RESOLVED, that Milltown Borough Officials, including, but not limited to the Mayor, Borough Administrator and Borough Clerk are hereby authorized and directed to take such ministerial actions as are necessary to effectuate the provisions of this resolution Resolution 2025-253 A RESOLUTION OF THE BOROUGH COUNCIL OF THE BOROUGH OF MILLTOWN APPROVING THE SUBMISSION OF A GRANT APPLICATION TO THE NEW JERSEY DEPARTMENT OF TRANSPORTATION FOR THE MILL POND PARK BIKE PATH IMPROVEMENTS PROJECT WHEREAS, the Borough Council of the Borough of Milltown, County of Middlesex, State of New Jersey is desirous to apply for a Department of Transportation Bikeways grant; and WHEREAS, the Borough Engineer has described the scope of work to include reconstruction of a bike path system within Mill Pond Park. The improvements generally consist of reconstruction of Mill Pond Park Bike Path including site clearing, installation of dense graded aggregate, hot mixed asphalt base and surface course, lawn restoration, and other related work. Mr. Carr explained that while no water had been shut off yet, the borough needed to take action regarding approximately 200 properties that had not responded to requests to schedule meter replacements. He announced that the borough would be receiving $1 million in infrastructure water funding, thanking Senator Deignan, Assemblyman Karabinchak, and Assemblyman Stanley for their support. This funding would help address lead line replacements that must be completed by 2031. Regarding the Ford Avenue redevelopment project, he reported that a federal court judge was inclined to require the developer to deposit money into an escrow account within 90 days or abandon the project. The developer appeared inclined to make the deposit, though appeals were expected. He estimated that within 3-5 years, site cleanup could begin once title changes occurred. Councilman Collins – Environmental, Health, & Social Services Councilman Collins provided a list of upcoming library programs for July and August, including drop-in play, Minecraft Island Survival Test, crochet for beginners, adult yoga, journaling for mindfulness, the library book club, Wednesday movie matinee, New Jersey Snake Man presentation, estate planning basics, Lucky Cat Bingo, and other activities. Councilman Manco – Utilities Councilman Manco was absent. Councilwoman Payne – Public Safety Councilwoman Payne reported that the police department responded to 1,288 calls for service between June 1-30, 2025. Officers conducted 92 radar details, made 490 motor vehicle stops, and investigated 19 motor vehicle accidents. Page | 25 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes July 21, 2025, at 7pm She highlighted letters of commendation issued to Patrolman Nicholas Espinoza and Patrolman Robert Whorle for their actions on June 19, 2025, when they responded to a report of a suspicious individual at approximately 3:35 AM. The officers apprehended a suspect wearing dark clothing and a ski mask who was carrying stolen items from unlocked vehicles. During the arrest, Patrolman Whorle was kicked in the face, but both officers maintained their professionalism throughout the encounter. For the fire department, she reported 17 calls in June for a year-to-date total of 92 calls. Total incidents year-to-date were 3,262. She noted significant preparation by the fire department for Fourth of July activities and mentioned their annual drafting drill for water rescues. As the Board of Education liaison, Councilwoman Payne reported attending a Community Relations Committee meeting on July 16 where she met the new superintendent, Dr. Steve Wisniewski, who would be starting September 1. She raised two issues with the Board of Education: the conflicts in meeting schedules between the Council and Board of Education, and the possibility of televising Board of Education meetings. She reported that the outgoing superintendent indicated they had no options for changing meeting dates, and the Board President stated they "don't do Board of Ed meetings for the public" but "meet to do board work." Councilwoman Payne also announced that National Night Out would be held on Tuesday, August 5, from 6-9 PM, at the American Legion. Councilman Posnansky – Public Works & Recycling Councilman Posnansky first raised a concern about procedural issues with the meeting agenda template, stating that placing council comments with reports violated their bylaws which follow Robert's Rules of Order. He then reported on the old DPW site, acknowledging Councilman Collins for contacting GovDeals about potentially auctioning items stored there. Regarding recycling, he noted that the last pickup with the old containers would be August 4, with the new system beginning August 11. He mentioned he would hold a meeting at the senior center the following Tuesday to address residents' questions about the transition. Councilman Posnansky expressed disappointment that the borough did not receive CDBG grant funding this year, which he had hoped to use for window replacements at the senior center. He noted the application was submitted late, and last year the borough had received approximately $60,000 from this grant. Councilman Potter – Parks & Recreation Councilman Potter announced that the mobile DMV would be at the senior center on Thursday from 9 AM to 2 PM, offering all services except driving tests. He explained that Mr. Barre, who had worked with the Borough on its Affordable Housing Plan and Ford Avenue Redevelopment, was no longer with that entity. He recommended that the council consider adopting a resolution during new business to authorize a request for proposals for a new planner. Borough Engineer Mike McClelland Borough Engineer McClelland reported that local aid applications had been submitted prior to the July 1 deadline, and the resolutions adopted at the meeting would be uploaded that week to complete the applications. Borough Clerk McCarthy had no report. Old Business Councilman Collins brought up two items: ● Regarding the old DPW building, he mentioned that GovDeals representatives indicated they would take down the building and pay the Borough. Mr. Carr advised that if the council wished to proceed, they would need to develop specifications and go through a proper bidding process. ● Councilman Collins also asked about replacing the camera and sound system for council meetings, noting that $5,000 was budgeted but a new system could be purchased for $2,500. He mentioned receiving complaints about the current system's performance. Council President Zambrana asked for information about the proposed system to be forwarded for consideration. New Business Borough Attorney Vignuolo presented a resolution to authorize a request for proposals for professional planning services. He explained that proposals would be submitted before the next meeting, allowing the council to appoint someone at the August 18 meeting when the current planner's 30-day termination period ended. Councilmen Collins and Posnansky objected to the combination of reports and comments sections, arguing this violated Robert's Rules of Order. Mr. Vignuolo clarified that Robert's Rules were guidelines that didn't strictly apply to governmental bodies, and that the council could modify its procedures during meetings. Public Comment Scott Siegel, owner of 111 South Main Street, expressed concerns about the lead pipe issue in town. He criticized the Borough for "kicking the can down the road" and objected to the idea of placing assessment liens on properties. He urged the council to take leadership on this issue, particularly for the sake of seniors in town. Mayor Murray responded that he had just discussed the issue with the Borough Engineer, who indicated there were approximately 40-50 affected properties. The Mayor acknowledged that with the new $1 million grant, the borough needed to develop an implementation plan. Rosa Tavares, 100 Riva Avenue, thanked Council President Zambrana for his work on obtaining the $1,000,000 grant and further questioned why homeowners would be responsible for replacing lead service lines when the water utility is owned by the borough. She argued that while homeowners plan for expenses like roof repairs and water heaters, a $20,000 expense for lead line replacement would significantly decrease property values. She asked the council to consider the burden this would place on longtime homeowners, particularly seniors, and suggested hiring grant writers to secure additional funding while Governor Murphy remains in office. Debbie Miller, 92 Ford Avenue, agreed with concerns about the burden on homeowners. She asked whether multi-unit dwellings would be required to have separate meters for each unit. Mr. Carr explained that while this had been discussed previously, the current meter replacement project did not include replumbing buildings for multiple meters. She also asked about the water meter replacement grant funding, which Mr. Carr clarified was a repurposing of two $1 million infrastructure grants, with the possibility of using remaining funds for other water system improvements after the meter project was completed. Lee Weissenberger, 99 JFK Drive, discussed water loss in the Borough, citing a 2000 report on the Eastern Raritan River Basin. He noted that small leaks add up significantly, with 2,600 homes potentially losing 14 million gallons annually from minor leaks. He also presented historical information about dredging in the Mill Pond area, noting that the issue had been ongoing since the 1950s with little resolution. Nick Ligotti, 9 Janet Court, made several points: ● He confirmed with the Police Chief that current crossing guards would not lose their jobs under the new contract ● He encouraged residents interested in becoming poll workers to contact the Borough Clerk ● He expressed concern about the lack of a full-time business administrator, arguing that someone needed to "quarterback" daily borough operations ● He urged the council to sell the two old firehouses, noting the borough had missed three real estate booms and failed to follow through on promises to sell these properties to recoup costs of the new facility Mayor Murray responded that he had tried since April to establish a firehouse subcommittee but had been "denied" by the Council President. He mentioned being approached by residents and business owners about converting one firehouse into a microbrewery to generate revenue, but "this council was not entertained by it."
