BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes November 24, 2025, at 7pm The Borough Council Meeting of the Milltown Borough Council was held on November 24, 2025, at Milltown Borough Hall, 39 Washington Avenue, Milltown, New Jersey. The meeting was called to order by Mayor Murray at 7:00 pm. The Borough Clerk read the following statement: Adequate notice of this meeting has been provided as required under Chapter 231, P.L. 1975, specifying the time, date, and location of this meeting by posting a copy of the notice in the Municipal Building, on the Municipal Website, and providing a copy of the Annual Notice Schedule to the official newspapers of the Borough. Notice is also on file in the Office of the Municipal Clerk. Public Comment: Mayor Murray opened the floor for public comment on resolutions listed on the agenda. Seeing no members of the public wishing to speak, the mayor closed the audience comments portion. Page | 1 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes November 24, 2025, at 7pm Ordinances Public Hearing, Second Reading Ordinance 25-1576 An Ordinance to Amend Chapter XXV, Water, Section 25-7.23, Replacement of Water Meters of the Revised General Ordinances of the Borough of Milltown BE IT ORDAINED by the Borough of Milltown of the County of Middlesex and State of New Jersey that the Revised General Ordinances of the Borough of Milltown be amended as follows: Section 1. Chapter 25, “Water,” Section 25-7.23 “Replacement of Water Meters,” of the Revised General Ordinances of the Borough of Milltown is hereby added as follows: Section 25-7.23 Replacement of Water Meters. It shall be the obligation of the owner to schedule an inspection, repair and/or replacement of a meter within ten (10) days of receipt of written notice from the Borough requesting same. Such notice shall be delivered to the owner by certified mail, return receipt requested. In the event that the owner fails to schedule such work or admit the Borough representative access for such work, the owner shall be liable for a surcharge in the amount of $250.00 per month to be added to the quarterly bill until such time that the Borough representative has been provided access for such inspection, repair and/or replacement of the water meter. Section 2. Each clause, section or subsection of this Ordinance shall be deemed a separate provision to the intent that if any such clause, section or subsection should be declared invalid, the remainder of the Ordinance shall not be affected. Section 3. All Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed as to the extent of such inconsistency. Section 4. This Ordinance shall take effect immediately upon adoption and publication according to law. Mayor Murray opened the public hearing on Ordinance 25-1576. No public comments were received. Councilman Potter recommended that letters regarding water meter replacement be made bilingual to ensure all residents understand the information. Councilman Collins expressed concern that the $250 fine was excessive and might be legally problematic as an excessive penalty. He also noted that without understanding individual circumstances of non-compliance, it was difficult to support such a measure. Borough Attorney Vignuolo affirmed that the fine was legally appropriate to ensure compliance. Administrator Carr confirmed this was still in the code, but Council had previously instructed not to use this measure. Posnansky also asked about correlation between non-compliance and delinquent water bills, noting that approximately 8-9% of residences (around 200) had not complied with meter replacement, which was similar to the percentage of delinquent accounts. He also suggested that some non-compliant properties might be illegal boarding houses or multi-family homes whose owners did not want borough personnel entering the premises. Councilman Posnansky mentioned that seniors at the senior center had expressed concerns about losing their homes or having water shut off, and he had worked to calm their fears and assist those with issues. BE IT ORDAINED by the Borough of Milltown of the County of Middlesex and State of New Jersey that the Revised General Ordinances of the Borough of Milltown be amended as follows: Section 1. Chapter 25, “Water,” Section 4.1, “Water Rates,” of the Revised General Ordinances of the Borough of Milltown is hereby amended as follows: Section 25-4.1. Water Rates a. Chapter 22, “Electrical Service,” Section 22-38, “General Service,” Subsection 22- 38.3, “Service Rates,” of the Revised General Ordinances of the Borough of Milltown is hereby amended as follows: Section 22-38.3. Service Rates a. Monthly charges shall be as follows: Residential Rates Number of KWH $13.71 First 20 kwh or less $0.2508 In excess of 20 kwh b. Monthly Minimum Charge. The minimum monthly charge under the above rate will be the first 20 kilowatt hours usage or $13.71. Excess of 300 kilowatt hours of $0.198 per kilowatt-hour, for heat pump service. c. General Service. Monthly charges shall be as follows: 1. Customers that have a twelve-month average demand reading, based on the previous calendar year of 20 kW to 99.99 kW: (a) Kilowatt Charge. First kilowatt of monthly maximum demand is included in the kilowatt hour charge; $30.16 per kilowatt for the next four kilowatts; $29.11 per kilowatt for each additional kilowatt of monthly maximum demand. Notwithstanding the kilowatt charge paragraph above, the Governing Body is authorized to provide demand charge relief for certain not-for-profit organizations residing within the Borough of Milltown. The Governing Body shall provide said demand charge relief through the adoption of a resolution on an annual basis. (b) Kilowatt Hour Charge. $38.86 For the first 100 kwh or less used in each month $0.2319 Per kwh for the next 400 kwh used in each month $0.1989 Per kwh in excess of 500 kwh used in each month 2. Notwithstanding the kilowatt charge paragraph above, the Governing Body is authorized to provide demand charge relief for certain not-for-profit organizations residing within the Borough of Milltown. The Governing Body shall provide said demand charge relief through the adoption of a resolution on an annual basis. (a) From October 1 through May 31. $1,437.73 First 5,000 kwh, or less $0.2849 Per kwh in excess of 5,000 kwh (b) From June 1 through September 30. $1,437.73 First 5,000 kwh, or less $0.3134 Per kwh in excess of 5,000 kwh (c) Monthly Minimum Demand Charge. The minimum monthly charge under this schedule shall be one of the following, whichever shall be the highest amount: (1) $1,696.33 (2) The demand charge calculated by use of a kilowatt value equal to 85% of the customer's highest demand measured in any of the previous 11 months. The distributor shall no longer supply meter pans and hardware for purchase by customers. All customers shall, at their own cost and expense, provide all necessary meter pans and hardware, which shall meet standards and specifications of the distributor. f. The foregoing rates shall take effect December 31, 2025. Section 2. Each clause, section or subsection of this Ordinance shall be deemed a separate provision to the intent that if any such clause, section or subsection should be declared invalid, the remainder of the Ordinance shall not be affected. This Ordinance shall take effect immediately upon adoption and publication according to law. Mayor Murray opened the public hearing on Ordinance 25-1578. Rosa Tavares, a resident, asked when the service rate increase would take effect and expressed concern about multiple increases, noting there had already been a 20% increase in April and now another 10% increase proposed for January. Borough Attorney Vignuolo explained that the increase was recommended by the CFO based on projected spot rates showing a potential 20% increase next year. The current 10% increase was an attempt to get ahead of this, with hopes that the battery project planned for June would prevent the need for an additional 10% increase later. Councilman Collins added that the earlier April increase had been the first in a considerable time and was due to reduced renewable energy resources and increased power demands from data centers across the state. Ms. Tavares noted that Milltown residents faced challenges because they couldn't shop for alternative electric rates or access certain rebates since Milltown has its own utility service. She suggested considering renewable energy options and solar panels to address these issues. Councilman Posnansky stated he would vote against the increase despite understanding its necessity. He attributed the rising costs to mismanagement at the state level, citing the closure of clean coal and nuclear plants, reduced natural gas production, and failed windmill projects that led to New Jersey becoming an electricity importer dependent on the PJM market. Councilman Collins also opposed the increase out of sympathy for residents, though acknowledging there was little alternative. BE IT ORDAINED by the Borough of Milltown of the County of Middlesex and State of New Jersey that the Revised General Ordinances of the Borough of Milltown be amended as follows: Section 1. Chapter 2, Administration, Section 2-7, Business Administrator, Subsection 2-7.5, Qualifications, of the Revised General Ordinances of the Borough of Milltown, is hereby amended to read as follows: §2-7. BUSINESS ADMINISTRATOR. *** §2-7.5. Qualifications. The Business Administrator shall be chosen by the Mayor and Borough Council solely on the basis of executive and administrative qualifications, with reference to actual training in governmental affairs, education, experience and training as evidenced by: (a) a degree from a recognized four year college in Public Administration, Business Administration or a field related to governmental administration and by actual experience in governmental administration; or (b) an associate’s degree in Public Administration, Business Administration or a related field, along with a minimum of five (5) years of responsible experience in an executive or administrative municipal position involving duties comparable to those of the Business Administrator. This Ordinance shall take effect immediately upon adoption and publication according to law. Mayor Murray invited public comment regarding Ordinance 25-1579. As no comments were offered, Mayor Murray requested Council comments. Councilman Collins questioned what qualifications were being changed. Borough Attorney Vignuolo explained that subsection B was the new addition, allowing for an associate's degree with a minimum of 5 years of experience in a responsible management position to qualify for the Business Administrator role. Councilman Collins expressed concern about paying up to $150,000 to someone with only an associate's degree. Administrator Carr clarified that the change would expand the candidate pool to include people with substantial experience, such as someone with an associate's degree who had been a director of public works managing 150 people and a $50 million budget in a larger town. Councilman Posnansky requested that all council members be allowed to review resumes for the position, particularly if lesser credentials would be accepted. Councilwoman Payne objected, stating that was the responsibility of the personnel committee who would make recommendations to council, similar to other committee processes. Councilman Collins acknowledged it was a difficult decision but that he would rely on the personnel committee's judgment. Councilman Posnansky strongly opposed the resolution, characterizing it as an attempt to abridge free speech by limiting council comments. He stated that while the rules may allow time limits, this was rarely done, and as the one who typically speaks during council comments, he always prepares and times himself, never exceeding 5 minutes. He viewed the change as politically motivated. Councilwoman Payne said she didn't object to council members having the same 5-minute limit as public commenters, but questioned whether the rule would be enforced equally, noting that the mayor does not enforce time limits for public comments. Councilman Collins agreed with Councilwoman Payne's point, expressing concern about limiting free speech. He questioned why the rules needed to be changed with only one month left in the year, suggesting it could wait until the new year. Councilwoman Payne asked Mayor Murray if he intended to enforce the 5-minute rule equally for council and public comments, noting he hadn't enforced time limits during her tenure on council. Borough Engineer McClelland provided an update on the water meter project. To date, 2,368 accounts were completed, 20 were scheduled, and 182 remained unscheduled. Nine commercial properties were scheduled for December, along with borough properties in the first three weeks of December. Engineer McClelland also presented information on the lead and galvanized water service line replacement project. He noted potentially good news: a local plumber believed about 80% of services could be replaced using pull-through methods or molds, reducing costs to an estimated $10,000- $20,000 per service. From the meter replacement project, approximately 70 lead service lines had been identified so far, with another 200 homes to check. The total project cost was estimated at $1 million, including $835,000 for construction and $165,000 for soft costs. McClellan recommended replacing lines by neighborhood rather than first- come-first-served to minimize road damage and address older areas that likely had more lead services. Old Business Councilman Collins asked Councilman Manco to clarify previous comments about household incomes. Manco explained he had been making the point that rate increases affect all families regardless of size or composition, though the dollar impact might vary based on usage. He emphasized that inflation is universal and doesn't skip anyone. New Business No new business was discussed. Public Comment Lee Weissenburger asked about the notice regarding drawing down the water tank and whether this would affect water pressure for firefighting. Administrator Carr explained they were lowering the water tank level from 38 to 20 feet to cycle water faster through the system, reducing trihalomethane formation by minimizing chlorine contact time with organic material. He assured that water pressure would remain consistent for firefighting, and in case of a significant fire event, all pumps and interconnects could be activated to bring more water into the system. Rosa Tavares expressed frustration about residents who refused to have their water meters replaced. She noted that both old and new meters were subject to the same water rates and questioned why some residents would want to opt out of meter replacement, especially when it was part of identifying lead service lines. She emphasized that as homeowners, residents have a responsibility to provide the borough access to maintain utilities, and that refusing to participate could ultimately hurt property values and potentially lead to insurance or home sale issues in the future. She urged council members to provide accurate information rather than entertaining the idea of "opting out" when that wasn't an option in Milltown. Tavares also commented that council should focus on improving the town and property values rather than debating procedural matters like how frequently minutes are read. There being no others wishing to speak, Mayor Murray closed to public comment. Council Comments Council members offered Thanksgiving wishes to residents and thanked Administrator Carr for his service to the borough, as he had submitted his resignation (Resolution 2025-365). Councilman Potter reminded everyone of the annual tree lighting ceremony on December 5th and congratulated Council President Zambrana on his reelection and Debbie Miller on her election to council. Councilman Collins spoke about the water meter replacement project, noting that while some installations had been complex (citing a 3-4 hour installation that required multiple adjustments), the Page | 25 BOROUGH OF MILLTOWN 2025 Borough Council Meeting Minutes November 24, 2025, at 7pm service was provided at no cost to residents. He emphasized that the program was designed to benefit the town, particularly by identifying lead service lines that could be replaced. Mayor Comments Mayor Murray reported attending an award luncheon with CME Associates at the League of Municipalities Convention, where CME won a statewide award for Milltown's battery project from the New Jersey Society of Municipal Engineers. The mayor also clarified that the meter replacement project and lead line service replacement were completely separate initiatives. He had requested CME to advance the lead line replacement process because he didn't want residents with lead lines to be delayed by those refusing meter replacements. Regarding time limits, the mayor mentioned that he had asked the Municipal Clerk to get a timer that she would operate to ensure objectivity if the resolution had passed.
