Solosky Resolution No. 110-25 BOARD OF TRUSTEES INCORPORATED VILLAGE OF MINEOLA -----------------------------------------------------------------X In the Matter of the Application of GARY DATTNER DECISION For a Special Use Permit pursuant to Chapter 550, Section 550-12.B of the Code of the Incorporated Village of Mineola, to expand an existing veterinary hospital at premises known as 132 Jericho Turnpike, Mineola, New York, known and designated on the Nassau County Land and Tax Map as Section 9, Block 332, Lot 1. -----------------------------------------------------------------X NAME OF APPLICANT: Gary Dattner SUBJECT PROPERTY: Section 9, Block 332, Lot 1 STREET LOCATION: 132 Jericho Turnpike Mineola, New York 11501 ZONING DISTRICT: "B-1” District RELIEF REQUESTED: Application For a Special Use Permit pursuant to Chapter 550, Section 550-12.B to expand an existing veterinary hospital upon the Property. PUBLICATION & POSTING: All in accordance with applicable laws, rules and regulations. DATE OF HEARING: April 16, 2025 APPEARANCE: Gary Dattner 2 DECISION: Gary Datner (hereinafter, “Applicant”) is before this Board, pursuant to Chapter 550, Section 550.12.B of the Municipal Code of the Incorporated Village of Mineola, for a special use permit to expand an existing veterinary hospital upon the property known as 132 Jericho Turnpike, Mineola, New York (known and designated on the Nassau County Land and Tax Map as Section 9, Block 332, Lot 1) (hereinafter, the “Property”). By Notice of Disapproval, dated March 14, 2025, Applicant’s building permit was denied. The Building Inspector determined that the proposed application is contrary to the Village’s zoning regulations. Applicant was thus required to seek relief before the Board of Trustees for a special use permit to expand an existing veterinary hospital upon the Property. Based upon the evidence adduced at the public hearing, and the documentation submitted to the Board in support of the application, the Board makes the following findings of fact: 1) Applicant is seeking a special use permit to expand an existing veterinary hospital upon the property known as 132 Jericho Turnpike, Mineola, New York; 2) The hours of operation will remain as existing (8:00 am to 7:00 pm Monday-Friday and 8:00 am to 4:00 pm Saturday and Sunday); 3) The proposed use, subject to the conditions imposed by this Board, will provide a desirable service and convenience to the Village. Based upon the above findings, it is hereby determined that the proposed use, subject to the conditions stated below, is harmonious to the “B-1” District, will conform to the general character of the neighborhood, and that the public health, morals, safety and general welfare of such neighborhood will be secured by the granting of the requested Special Use Permit. Further, it is hereby determined that the Special Use Permit will provide a desirable facility to the area and will not be incongruous to the neighborhood by reason of excessive traffic. IT IS THEREFORE RESOLVED, that the Special Use Permit is GRANTED subject to the following conditions: 1) Applicant shall obtain and maintain all necessary licenses, permits and approvals from all agencies having jurisdiction with respect to the operation of the business; 2) No animal noise or other disturbing noise shall emanate from the building. Any noise shall be kept within the building. Applicant shall install and maintain soundproofing to achieve this condition; 3) All solid waste shall be removed by private carter; 4) All medical waste shall be properly stored and removed by a licensed entity; 3 5) There shall be no outside storage or walking animals at the Property. Applicant shall discourage its clients from walking their animals in the neighborhood. 6) Each of these conditions is material to the approval granted by the Board of Trustees. Violation of any of these conditions shall subject the applicant or it successors to enforcement pursuant to the Village’s Municipal Code, including possible revocation of this Special Use Permit; 7) The representations made by Applicant on the record in this proceeding have been deemed material to this application and have been relied upon by the Board of Trustees in its deliberations and decisions. Said representations are deemed to be part of the conditions of this Special Use Permit; and 8) Violation of a condition set forth in this decision shall be deemed a violation of the Village Zoning Law and shall subject the owner or occupant of the premises to all penalties set forth in the Zoning Law. Solosky Resolution No. 127-25 Resolved to renew and continue the Village’s Commercial Facade Improvement Program (Facade Improvements), created and funded through either federal or New York State funding sources that empower the Village of Mineola to guide, coordinate and arrange harmonious private building storefront improvements for participating commercial building owners in qualified commercial business districts within the Village; Finding it in the best interest of Village communities, consistent with its Master Plan, Downtown Revitalization Recommendations and as recommended by the Village’s Community Development Coordinator, Tom Savino of Vision Accomplished, the Village Board resolves to continue to seek and use funds acquired through: Commercial Rehabilitation lines from federal Community Development Block Grants (CDBG) issued from HUD; New York Forward (NYF) funding through New York State; or other grant funds that grant similar authority as they may be acquired in the future; Funding continues each budget year until the Board of Trustees duly resolves to end Facade Improvements, provided that any funds which have been awarded shall be retained in the Facade Improvements Program to be disbursed upon completion and approval of the project; To continue the program, the Board authorizes Vision Accomplished to acquire a proposal from urban architectural design professional, Jonathan Martin, PhD, AICP, to renew his contract and continue to provide exterior facade storefront improvement recommendations in professional illustrations (Renderings). These artistic renderings are used to create more inviting, aesthetically pleasing and harmonious storefront appearances. In addition, Vision Accomplished will re-engage a qualified contractor for the Village to attain necessary information of assigned commercial buildings, including but not limited to, photos, storefront measurements, sign band locations and other data needed to set protocol and improvement cost estimates. Moreover, the Board authorizes Vision Accomplished to issue Requests for Proposals (RFPs) as needed or present the Mayor or his designee, with renewed contracts for signature, for the follow- ing storefront improvement professionals: 1. Qualified commercial storefront facade sign makers with experience, knowledge and the ability to design, craft and install decorative commercial building signs that meet the guidelines and specifications of the Village, qualified to work in Nassau County and satisfy requirements of federal HUD regulations, as may apply; and, 2. Experienced commercial building electricians with know-how and ability to supply and install commercial sign and wall light fixtures as may be ordered to meet the guidelines and specifications of the Village, qualified to work in Nassau County and satisfy requirements of federal HUD regulations, as any may apply; and, 15 3. Experienced awning supply and installation companies with know-how and ability to supply and install commercial awnings that meet the guidelines and specifications of the Village, qualified to work in Nassau County and satisfy requirements of federal HUD regulations, as any may apply; and, 4. Experienced exterior facade improvement contractors with the know-how and ability to install or improve commercial building wall surfaces (e.g., painting, stucco, brick pointing, etching), store front windows, doors, etc. We anticipate that we will require these services on a limited basis and either recommend them to commercial building owners for private payments or include such work where necessary and approved as part of Facade Improvements and, in those instances, in separate contracts with application and adherence to Davis-Bacon regulations; Procurement will seek to reach out and include opportunities for qualified women and minority owned business enterprises, particularly Long Island based, Nassau County approved firms. It is the intent of the Village to engage one or two professionals in each category under nonexclusive two-year requirements contracts, twice renewable for one-year intervals, to supply and install items and materials as specifically ordered and scheduled. Qualifications will include satisfaction of all applicable Village, Nassau County and HUD regulations including adequate certificates of insurance naming as additional insured: the Village of Mineola, Nassau County or New York State, counsel, consultants and other involved project parties, including property owners, as requested. The following guidelines apply to Facade Improvements: 1) The Village will offer select commercial building owners the opportunity to participate in Facade Improvements to receive an award equal to the cost of 75% of items, materials and installation, as approved and contracted. Owners will contribute a minimum of 25% of final eligible and approved costs; 2) The Village’s Facade Improvements contribution will have maximums per storefront side of $15,000 for signs, lights, awnings and related accessories (i.e., all non-Davis-Bacon contract work) plus up to $30,000 for projects that also include painting or structural work done by a contractor paying laborers Davis-Bacon prevailing wages; 3) Non-eligible participants will include any building, owner or tenant with an active unsatisfied debt or violation of the Village or Nassau County code, law or ordinance. If they are currently adjudicating such violation without final decision, the prohibition for participation is not applicable. The Village will retain the right to stop any project if such violation is not satisfied when required; 4) Vision Accomplished will administer Facade Improvements and communicate in follow up with all applicable building owners and tenants to encourage and facilitate participation as needed; 5) All participants will enter into a written agreement with the Village in order to confirm terms of work, including estimate project cost, payments and payment schedules; 6) The Village will specifically declare that it accepts no responsibility, warranty or guarantee for the materials, installation, performance or quality of any work; 7) Vision Accomplished will oversee and monitor CDBG budgets to determine available Facade Improvement funds and expense allocations to carefully track, schedule and coordinate expenditures during the CDBG fiscal year (September - August); 8) Administration of the program will be in conformance with policies and procedures of the Village of Mineola currently in place and hereinafter enacted. The Village reserves the right to amend, modify and/or waive any Village requirements it deems necessary in order to meet the goals of the Program; the requirements of Nassau County; New York State and/or federal HUD regulations; 16 9) The Village reserves the right to suspend, modify and/or terminate the Facade Improve- ment Program at any time and for any reason. SUMMARY: Resolved to renew/continue the Village’s Commercial Facade Improvement Program, authorizing Tom Savino, Community Development Coordinator, to issue necessary RFPs to qualified sign makers, electricians and awning companies for the Village to form multi-year contracts with each, renewable for two additional one-year terms, for them to craft and install custom exterior building improvements as approved and ordered. In addition, Tom will acquire a proposal from urban architectural design professional, Jonathan Martin, PhD, AICP, and seek to have his contract with the Village renewed to continue to provide exterior facade storefront improvement recommendations in professional renderings to be used to form estimate costs for approved improvements, work out agreements with owners and tenants and form the basis for work order specifications later issued to contracted trade professionals in the program. The Facade Improvement Program will be funded through: federal Community Development Block Grants (CDBG) issued from HUD, Nassau County Community Development; New York Forward (NYF) funding awarded through New York State, Empire State Development; or other grant funds that provide like funding and enable similar authority, as any of those may be acquired in the future.
