No speakers from the public addressed the Board. 1  Resolution No. 171-25 RESOLUTION AUTHORIZING THE VILLAGE OF MINEOLA TO RENEW A CABLE FRANCHISE AGREEMENT WITH CABLEVISION SYSTEMS LONG ISLAND CORPORATION TO OPERATE A CABLE SYSTEM IN THE VILLAGE OF MINEOLA, NY WHEREAS, the Village of Mineola, NY (the “Village”) is a “franchising authority” in accordance with Title VI of the Communications Act of 1934, (the “Communications Act”), and is authorized to grant one or more nonexclusive cable television franchises pursuant to Article 11 of the New York Public Service Law, as amended, and Title 16, Chapter VIII, Parts 890.60 through 899, of the Official Compilation of Codes, Rules and Regulations of the State of New York, as amended (collectively the “Cable Laws”); WHEREAS, the Village, executed a franchise renewal agreement with CABLEVISION SYSTEMS LONG ISLAND CORPORATION (the “Franchisee”) on November 18, 2009, which was thereafter confirmed and made effective by the New York State Public Service Commission on April 16, 2010 for a term of fifteen (15) years (Case No. 09-V-0836) and WHEREAS, said franchise agreement thereafter expires on April 16, 2025 and WHEREAS, Franchisee has submitted a proposed franchise renewal agreement (the “Franchise Renewal Agreement”) to continue operating said cable system within the Village; and WHEREAS, The Village and Franchisee have mutually agreed to the terms of said Franchise Renewal Agreement; and WHEREAS, the Village has determined that the Franchisee is and has been in substantial compliance with all terms/provisions of its existing franchises and applicable law; and WHEREAS, the Village has determined that Franchisee has the requisite legal, technical and financial capabilities to operate cable systems within the Village and that Franchisee’s proposals for renewal of the franchises meet the cable related needs of the Community; and WHEREAS, a duly noticed Public Hearing, affording an opportunity for all those interested parties within the Village to be heard on the proposed Franchise Renewal Agreement was held before the Village on June 11, 2025. NOW, THEREFORE, be it RESOLVED, that the Village determines that it is in the best interest of the public to award the Franchise Renewal Agreement to the Franchisee; and be it FURTHER RESOLVED that the Village hereby authorizes the Mayor to enter into the Franchise Renewal Agreement with CABLEVISION SYSTEMS LONG ISLAND CORPORATION and to execute any other documents necessary to effectuate the granting of the franchise renewal on behalf of the Village of Mineola. DATE OF HEARING: June 11, 2025 APPEARANCE: Maggie Regan, business owner DECISION: Pickleball Prime/Vassar Place Domestic LLC (hereinafter, “Applicant”) is before this Board, pursuant to Chapter 550, Section 550.16.A of the Municipal Code of the Incorporated Village of Mineola, for a special use permit to establish an indoor pickleball gym with a juice bar upon the property known as 165 East Second Street, Mineola, New York (known and designated on the Nassau County Land and Tax Map as Section 9, Block 437, Lot 346) (hereinafter, the “Property”). By Notice of Disapproval, dated March 14, 2025, Applicant’s building permit was denied. The Building Inspector determined that the proposed application is contrary to the Village’s zoning 4 regulations. Applicant was thus required to seek relief before the Board of Trustees for a special use permit to establish an indoor pickle ball gym with a juice bar upon the Property. Based upon the evidence adduced at the public hearing, and the documentation submitted to the Board in support of the application, the Board makes the following findings of fact: 1) Applicant is seeking a special use permit to expand establish an indoor pickle ball gym with a juice bar upon the property known as 165 East Second Steet, Mineola, New York; 2) The hours of operation will be 5:00 am to 11:00 pm seven days a week; 3) The proposed use, subject to the conditions imposed by this Board, will provide a desirable service and convenience to the Village. Based upon the above findings, it is hereby determined that the proposed use, subject to the conditions stated below, is harmonious to the “M” District, will conform to the general character of the neighborhood, and that the public health, morals, safety and general welfare of such neighborhood will be secured by the granting of the requested Special Use Permit. Further, it is hereby determined that the Special Use Permit will provide a desirable facility to the area and will not be incongruous to the neighborhood by reason of excessive traffic. IT IS THEREFORE RESOLVED, that the Special Use Permit is GRANTED subject to the following conditions: 1) Applicant shall cause all refuse to be removed from the premises by a private carter at Applicant’s expense. All putrescible waste, if any, shall be refrigerated until pick-up. All waste pick-ups shall take place between the hours of 7:00 a.m. and 6:00 p.m. only; 2) Any garbage dumpster on the premises shall be maintained in a fully-enclosed area and the gates to the dumpster shall be closed at all times except during loading and pick-up. The garbage dumpster and surrounding area shall remain free from debris, odors or litter at all times. 3) The Village Board of Trustees shall maintain jurisdiction over the site, particularly with respect to the safety and convenience of traffic flow to the Property. In the event that such traffic flow plan shall require modification, the Applicant shall make further application before the Board of Trustees for an amendment of this approval or the Board of Trustees shall direct such modification; 4) The premises shall be maintained in a clean condition at all times; 5) Ambient noise/music, if any, emanating from the Property shall not be audible from a point beyond ten (10’) foot radius; 6) Each of these conditions is material to the approval granted by the Board of Trustees. Violation of any of these conditions shall subject the applicant or it successors to enforcement pursuant to the Village’s Municipal Code, including possible revocation of this Special Use Permit; 5  7) The representations made by Applicant on the record in this proceeding have been deemed material to this application and have been relied upon by the Board of Trustees in its deliberations and decisions. Said representations are deemed to be part of the conditions of this Special Use Permit; and 8) Violation of a condition set forth in this decision shall be deemed a violation of the Village Zoning Law and shall subject the owner or occupant of the premises to all penalties set forth in the Zoning Law. The Building Inspector determined that the proposed application is contrary to the Village’s zoning regulations. Applicant was thus required to seek relief before the Board of Trustees for a Special Use Permit to establish an acupuncture office upon the Property. A referral of the application was made to the Nassau County Planning Commission. The Nassau County Planning Commission has recommended that this Board take whatever action it deems appropriate. Based upon the evidence adduced at the public hearing, and the documentation submitted to the Board in support of the application, the Board makes the following findings of fact: 1) Applicant is seeking a Special Use Permit to establish an acupuncture office upon the property known as 331 Willis Avenue, Mineola, New York; and 2) The proposed use, subject to the conditions imposed by this Board, will provide a desirable service and convenience to the Village. Based upon the above findings, it is hereby determined that the proposed use, subject to the conditions stated below, is harmonious to the “B-1” District, will conform to the general character of the neighborhood, and that the public health, morals, safety and general welfare of such neighborhood will be secured by the granting of the requested Special Use Permit. Pereira thanked the Department of Public Works for installing a Peace Pole in Memorial Park which was donated by the Mineola-Garden City Rotary Club to commemorate their 100th anniversary, announced the Who’s Next Concert in the Park on June 13, the Mineola Arts Festival on June 21, the pool opening on June 14 and the Lovesong Concert in the Park on June 20. Trustee Paul S. Cusato added that Troop 45’s annual Father’s Day breakfast is on Sunday, June 15 from 7:30 AM to 12:00 noon at Mineola High School. Mayor Paul A.
