No speakers from the public addressed the Board. Clark Resolution No. 206-25 BOARD OF TRUSTEES INCORPORATED VILLAGE OF MINEOLA -----------------------------------------------------------------X In the Matter of the Application of XC ENGINEERING PC DECISION For a Special Use Permit pursuant to Chapter 550, Section 550-12.B of the Code of the Incorporated Village of Mineola, to establish a music school at premises known as 259 Mineola Boulevard, Mineola, New York, known and designated on the Nassau County Land and Tax Map as Section 9, Block 398, Lot 134. -----------------------------------------------------------------X NAME OF APPLICANT: XC Engineering PC SUBJECT PROPERTY: Section 9, Block 398, Lot 134 STREET LOCATION: 259 Mineola Boulevard Mineola, New York 11501 ZONING DISTRICT: "B-1” District RELIEF REQUESTED: Application For a Special Use Permit pursuant to Chapter 550, Section 550-12.B to establish a music school at the Property. PUBLICATION & POSTING: All in accordance with applicable laws, rules and regulations. DATE OF HEARING: July 9, 2025 APPEARANCE: Jing Xie, Architect DECISION: XC Engineering PC (hereinafter, “Applicant”) is before this Board, pursuant to Chapter 550, Section 550.12.B of the Municipal Code of the Incorporated Village of Mineola, for a special use permit to establish a music school upon the property known as 259 Mineola Boulevard, Mineola, New York (known and designated on the Nassau County Land and Tax Map as Section 9, Block 398, Lot 134) (hereinafter, the “Property”). By Notice of Disapproval, dated June 1, 2025, Applicant’s building permit was denied. The Building Inspector determined that the proposed application is contrary to the Village’s zoning 2 regulations. Applicant was thus required to seek relief before the Board of Trustees for a special use permit to establish a music school upon the Property. Based upon the evidence adduced at the public hearing, and the documentation submitted to the Board in support of the application, the Board makes the following findings of fact: 1) Applicant is seeking a special use permit to establish a music school upon the property known as 259 Mineola Boulevard, Mineola, New York; 2) The school will have sixteen (16) classrooms and one (1) recital hall; 3) The hours of operation will be 3:00 pm to 9:00 pm seven days a week. During the summer months, camp, will be held from 9:00 am to 3:00 pm Monday-Friday; 4) Applicant has five (5) dedicated parking spaces on-site; and 5) The proposed use, subject to the conditions imposed by this Board, will provide a desirable service and convenience to the Village. Based upon the above findings, it is hereby determined that the proposed use, subject to the conditions stated below, is harmonious to the “B-1” District, will conform to the general character of the neighborhood, and that the public health, morals, safety and general welfare of such neighborhood will be secured by the granting of the requested Special Use Permit. Further, it is hereby determined that the Special Use Permit will provide a desirable facility to the area and will not be incongruous to the neighborhood by reason of excessive traffic. IT IS THEREFORE RESOLVED, that the Special Use Permit is GRANTED subject to the following conditions: 1) The operation and use of the Property shall be exclusively limited to Applicant. The Property shall not be rented, leased, sublet, or otherwise made available for use by any outside individuals, groups, or organizations. 2) The Applicant shall operate a daily shuttle-van service between the Mineola Train Station and the Property for the exclusive purpose of transporting teachers. This service shall be provided at the Applicant’s sole cost and expense and shall comply with all applicable State and Village transportation and safety regulations. 3) The Applicant shall be permitted to conduct no more than twenty (20) recitals per calendar year at the Property. All recitals shall be limited to enrolled students only. For each recital, the Applicant shall, at its sole cost and expense, provide valet parking service for all attendees. The valet service shall utilize off-street municipal parking lots exclusively and shall not operate on or utilize local residential streets. All valet operations shall comply with applicable Village parking regulations. 4) The Applicant shall designate an on-site employee to manage class drop-off and pick-up activities. This employee shall be responsible for facilitating the safe and orderly flow of vehicular and pedestrian traffic during these periods, in coordination with applicable Village safety guidelines. 5) The Village Board of Trustees shall maintain jurisdiction over the site, particularly with respect to the safety and convenience of traffic flow to the Property. In the event that such traffic flow plan shall require modification, the Applicant shall 3 make further application before the Board of Trustees for an amendment of this approval or the Board of Trustees shall direct such modification; 6) The premises shall be maintained in a clean condition at all times; 7) Ambient noise/music emanating from the Property shall not be audible from a point beyond a ten (10’) foot radius; 8) Each of these conditions is material to the approval granted by the Board of Trustees. Violation of any of these conditions shall subject the applicant or it successors to enforcement pursuant to the Village’s Municipal Code, including possible revocation of this Special Use Permit; 9) The representations made by Applicant on the record in this proceeding have been deemed material to this application and have been relied upon by the Board of Trustees in its deliberations and decisions. Said representations are deemed to be part of the conditions of this Special Use Permit; and 10) Violation of a condition set forth in this decision shall be deemed a violation of the Village Zoning Law and shall subject the owner or occupant of the premises to all penalties set forth in the Zoning Law. Resolution No. 207-25 NOTICE OF INTENT OF THE BOARD OF TRUSTEES OF THE INCORPORATED VILLAGE OF MINEOLA TO DECLARE ITSELF LEAD AGENCY IN THE COORDINATED REVIEW OF THE APPLICATION OF EDEN BLUE, LLC (THE “APPLICANT”) FOR THE CONSTRUCTION OF A SIX-STORY, 204 UNIT RESIDENTIAL BUILDING LOCATED UPON THE PROPERTY KNOWN AS 110 WILLIS AVENUE, MINEOLA, NEW YORK, KNOWN AND DESIGNATED ON THE NASSAU COUNTY LAND AND TAX MAP AS SECTION 9, BLOCK 452, LOT 615 WHEREAS, the Incorporated Village of Mineola Board of Trustees (hereafter, the “Board of Trustees”) has received an application for the construction of a six-story, 204 unit residential building located upon the property known as 110 Willis Avenue, Mineola, New York, known and designated on the Nassau County Land and Tax Map as Section 9, Block 452, Lot 615, as reflected in the application documents submitted to this Board; and WHEREAS, in accordance with 6 NYCRR §617.6(a) and (b), the Board of Trustees has reviewed this proposed action and has determined that same is a Type I Action pursuant to the New York State Environmental Quality Review Act; and WHEREAS, the Board of Trustees seeks to commence a coordinated environmental review of the proposed project under the New York State Environmental Quality Review Act; and WHEREAS, the Board of Trustees intends to declare itself as Lead Agency in the environmental review of the proposed action.
