By Notice of Disapproval, dated July 17, 2025, Applicant’s building permit was denied. The Building Inspector determined that the proposed application is contrary to the Village’s zoning regulations. Applicant was thus required to seek relief before the Board of Trustees for a Special Use Permit to establish a medical office/exam rooms upon the Property. A referral of the application was made to the Nassau County Planning Commission. The Nassau County Planning Commission has recommended that this Board take whatever action it deems appropriate. Based upon the evidence adduced at the public hearing, and the documentation submitted to the Board in support of the application, the Board makes the following findings of fact: 1) Applicant is seeking a Special Use Permit to establish a medical office/exam rooms upon the property known as 85 East Jericho Turnpike, Mineola, New York; 2) Applicant is proposing to establish a medical office of Dr. Louis Nkrumah, neurosurgery and spine specialist; 3) Applicant shall utilize the space at 85 East Jericho Turnpike and 89 East Jericho Turnpike as one medical office; 4) 85 Jericho Turnpike will service as an administrative office with a conference room and 89 Jericho Turnpike will have eight to ten exam rooms; 5) The hours of operation shall be 9:00 am to 5:00 pm Monday-Friday with no appointments on weekends; 6) Applicant will utilize a medical van to assist in patient transportation. Applicant shall designated a parking space in the parking lot to service the medical van; and 7) The proposed use, subject to the conditions imposed by this Board, will provide a desirable service and convenience to the Village. Based upon the above findings, it is hereby determined that the proposed use, subject to the conditions stated below, is harmonious to the “B-1” District, will conform to the general character of the neighborhood, and that the public health, morals, safety and general welfare of such neighborhood will be secured by the granting of the requested Special Use Permit. Further, 3 it is hereby determined that the Special Use Permit will provide a desirable facility to the area and will not be incongruous to the neighborhood by reason of excessive traffic. IT IS THEREFORE RESOLVED, that the Special Use Permit is GRANTED subject to the following conditions: 1) The Special Use Decision for 85 East Jericho Turnpike is expressly conditioned upon, subject to, and incorporated by reference into the Decision issued for 89 East Jericho Turnpike. All terms, findings, and conditions applicable to 89 East Jericho Turnpike shall be deemed applicable to 85 East Jericho Turnpike to the extent relevant; 2) Applicant shall encourage its staff to utilize municipal parking in the area; 3) Applicant shall obtain and maintain all necessary licenses, permits and approvals from all agencies having jurisdiction with respect to the practice; 4) The Village Board of Trustees shall maintain jurisdiction over the site, particularly with respect to the safety and convenience of traffic flow to the Property. In the event that such traffic flow plan shall require modification, the Applicant shall make further application before the Board of Trustees for an amendment of this approval or the Board of Trustees shall direct such modification; 5) Each of these conditions is material to the approval granted by the Board of Trustees. Violations of any of the conditions of this Special Use Permit shall subject the applicant or its successors to enforcement pursuant to the Village’s Municipal Code, including possible revocation of this Special Use Permit; 6) The representations made by Applicant on the record in this proceeding have been deemed material to this application and have been relied upon by the Board of Trustees in its deliberations and decision. Applicant’s representations are deemed to be part of the conditions of this Special Use Permit; and 7) Violation of a condition set forth in this Special Use Permit shall be deemed a violation of the Village Zoning Law and shall subject the owner or occupant of the premises to all penalties set forth in the Zoning Law. Closed Sunday; and 4) The proposed use, subject to the conditions imposed by this Board, will provide a desirable service and convenience to the Village. Based upon the above findings, it is hereby determined that the proposed use, subject to the conditions stated below, is harmonious to the “B-1” District, will conform to the general character of the neighborhood, and that the public health, morals, safety and general welfare of such neighborhood will be secured by the granting of the requested Special Use Permit. Further, it is hereby determined that the Special Use Permit will provide a desirable facility to the area and will not be incongruous to the neighborhood by reason of excessive traffic. IT IS THEREFORE RESOLVED, that the Special Use Permit is GRANTED subject to the following conditions: 1) The operation of the facility shall be self-contained within the interior of the building; 2) Music, if any, shall be played at a low volume and shall not be audible outside of the building; 3) The Applicant will not sell, prepare or cook food upon the property; 9 4) Each of these conditions is material to the approval granted by the Board of Trustees. Violation of any of these conditions shall subject the applicant or it successors to enforcement pursuant to the Village’s Municipal Code, including possible revocation of this Special Use Permit; 5) The representations made by Applicant on the record in this proceeding have been deemed material to this application and have been relied upon by the Board of Trustees in its deliberations and decisions. Solosky Press Observer: Mineola-Williston Times Sunshine Observers: 26 Observers A continuation of the Public Hearing of July 9, 2025 was held at 7:15 PM at the Village Hall, 155 Washington Avenue, Mineola, New York, 11501 in order to receive public comment upon the following: APPLICATION OF EDEN BLUE LLC FOR A SPECIAL USE PERMIT PURSUANT TO CHAPTER 550 OF THE CODE OF THE INCORPORATED VILLAGE OF MINEOLA, ENTITLED “ZONING”, SECTION 550-15.1 ENTITLED “DOWNTOWN OVERLAY DISTRICT” TO CONSTRUCT A SIX-STORY, 204 UNIT RESIDENTIAL BUILDING LOCATED UPON THE PROPERTY KNOWN AS 110 WILLIS AVENUE, MINEOLA, NEW YORK, KNOWN AND DESIGNATED ON THE NASSAU COUNTY LAND AND TAX MAP AS SECTION 9, BLOCK 452, LOT 615. 8 speakers from the public addressed the Board. 10 Resolution No. 256-25 THE BOARD OF TRUSTEES OF THE INCORPORATED VILLAGE OF MINEOLA DECLARING ITSELF LEAD AGENCY IN THE COORDINATED REVIEW OF THE APPLICATION OF EDEN BLUE, LLC (THE “APPLICANT”) FOR THE CONSTRUCTION OF A SIX-STORY, 204 UNIT RESIDENTIAL BUILDING LOCATED UPON THE PROPERTY KNOWN AS 110 WILLIS AVENUE, MINEOLA, NEW YORK, KNOWN AND DESIGNATED ON THE NASSAU COUNTY LAND AND TAX MAP AS SECTION 9, BLOCK 452, LOT 615 WHEREAS, the Incorporated Village of Mineola Board of Trustees (hereafter, the “Board of Trustees”) has received an application for the construction of a six-story, 204 unit residential building located upon the property known as 110 Willis Avenue, Mineola, New York, known and designated on the Nassau County Land and Tax Map as Section 9, Block 452, Lot 615, as reflected in the application documents submitted to this Board; and WHEREAS, SEQRA §617.6 provides a means for an agency to coordinate with other involved agencies to determine the most appropriate lead agency for review of an Action; the regulation provides a thirty (30) day time period from the date of service, or if all involved agencies respond prior to the expiration of the 30 day time period, the Lead Agency may be designated; and WHEREAS, the Village Board of Trustees circulated a letter of coordinated review to the other potentially involved agencies, and in that correspondence, declared its Notice of Intent to serve as Lead Agency in connection with the environmental review of the Proposed Action; and WHEREAS, no agencies responded to the coordination request expressing opposition to the Village Board of Trustees assuming lead agency status for review of the Proposed Action and the 30 day time period from the date of service of the letter of coordinated review has elapsed; NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees hereby declares itself Lead Agency in the review of the Proposed Action.
