Call to Order, Roll Call, and Confirmation of Compliance with the Open Meetings Law. Chair Weier called the meeting to order at 4:30pm. Motion carried, all voting aye (3-0). DISCUSSION AND CONSIDERATION OF AMENDING SECTION 50.06(A)(4) OF THE MUNICIPAL ORDINANCE RELATED TO YARD WASTE AND BRUSH. Administrator Honer stated that this amendment is changing the yard waste information in the ordinance to align with the City’s brush pick-up policy from 2024. Motion (Allendorf/Weier) to recommend Council approval of amending Section 50.06(A)(4) of the Municipal Ordinance related to yard waste and brush. Motion carried, all voting aye (3-0). DISCUSSION AND CONSIDERATION OF AMENDING CHAPTER 73 OF THE MUNICIPAL ORDINANCE RELATED TO THE LOCATION OF A STOP SIGN AT THE INTERSECTION OF NICHOLS AND WATER STREETS. At the intersection of Water Street and Nichols Street, there is no designation for a stop sign. This amendment designates the placement for the stop sign. Motion (Allendorf/Graber) to recommend Council approval of amending Chapter 73 of the Municipal Ordinance related to the location of a stop sign at the intersection of Nichols and Water Streets. Motion carried, all voting aye (3-0). DISCUSSION AND CONSIDERATION OF AMENDING CHAPTER 74 OF THE MUNICIPAL ORDINANCE RELATED TO NO PARKING DESIGNATIONS FOR ALICE, COPPER, FRONT, HENRY, SOUTH IOWA, MAIDEN, AND S. WISCONSIN STREETS, ALTERNATE SIDE PARKING EXEMPTION ON HENRY STREET, AND VIOLATION FORFEITURE. Alice Street: There is a tenant that parks in the street instead of using the apartment building parking lot. The snow plow drivers have a hard time with cars parked there with as narrow as the street is. The proposed amendment requests no parking on either side of Alice Street. The signs are currently there, however, there is no current ordinance in place for this. Front Street and South Street: Around the school section of Front Street and South Iowa Street, there are no parking signs from 7:30am – 8:10am on Front Street and South Iowa Street near the intersection. The School and the bussing company requested that there be no parking for the duration of the school day instead of just the morning period. South Wisconsin Street: Between 9th and Filardo Court is more narrow than the rest of S. Wisconsin Street. There are now tenants who park multiple vehicles on this section of street, which makes it harder for the street crew for plowing purposes. Henry Street: There have been issues with plowing due to the narrow street. The Street Department would like to see no parking during the winter, which would follow the alternate side parking schedule, from November 15 – April 1. This would be one location with no overnight parking during the winter months, which is the same as the 300 block of High Street. This essentially helps the street get cleaned with snow storms. Committee agrees to no parking at all in Winter on Henry Street. Maiden Street: Changes were made to allow handicap parking in front of the church. At the time, the City felt the street wasn’t wide enough, so parking on the south side of the street was limited. Afterward, the Church board wanted to leave the handicap space and open up the parking spots on the South side of the street. The police department doesn’t see a problem with opening the south side of the street to parking again. The ordinance also proposes increasing the parking penalty from $10 to $20. Motion (Allendorf/Graber) to recommend Council approval of amending Chapter 74 of the Municipal Ordinance related to no parking designations for Alice, Copper, Front, Henry, South Iowa, Maiden, and S. Wisconsin Streets, alternate side parking exemption on Henry Street, and Violation forfeiture, with the exception of Henry Street becoming no parking at all from November 15 through April 1, and increasing the violation forfeiture to $25. Motion carried, all voting aye (3-0). DISCUSSION AND CONSIDERATION OF AMENDING SECTION 92.05(E) AND 92.05(M) OF THE MUNICIPAL ORDINANCE RELATED TO TREE LIMBS AND WEED REMOVAL AS PUBLIC NUISANCES. This amendment is reflecting our tree ordinance so that it provides specifically when branches are considered a public nuisance. A public nuisance is defined as anything less than 14’ above a street and anything less than 10’ above a sidewalk or a trail. The fee is specific to mowing. The committee would like to add removing limbs to the special assessment. Motion (Weier/Allendorf) to recommend Council approval of amending Section 92.05(E) and 92.05(M) of the Municipal Ordinance related to tree limbs and weed removal as public nuisances. Motion carried, all voting aye (3-0). The junk ordinance doesn’t define what a motor vehicle is. The City is looking to, at minimum, put the definition in the ordinance. This also clarifies that you cannot throw brush or yard waste into the street, which brings the ordinance into compliance with the Resolution that was passed previously this year. Motion (Graber/Allendorf) to recommend Council approval of amending Section 130.33(B) of the Municipal Ordinance to define motor vehicles and section 130.035 of the Municipal Ordinance to amend language regarding littering. Motion carried, all voting aye (3-0). DISCUSSION AND CONSIDERATION OF AMENDING SECTIONS 130.066(A), 130.067(A), AND 130.068(A) OF THE MUNICIPAL ORDINANCE TO AMEND THE VALUE THRESHOLDS OF PROPERTY OFFENSES. Chief Weier recommends setting the threshold at $750. Motion (Graber/Allendorf) to recommend Council approval of amending Sections 130.066(A), 130.067(A), and 130.068(A) of the Municipal Ordinance to amend the value thresholds of property offenses at $750. Motion carried, all voting aye (3-0). DISCUSSION AND CONSIDERATION OF DISALLOWING CLAIM AGAINST THE CITY OF MINERAL POINT, IOWA COUNTY, WISCONSIN BY PAUL MOHLMANN SEEKING REIMBURSEMENT FOR PROPERTY DAMAGE. The City was advised to officially disallow this claim. In June, a walnut tree came down, which took out Mr. Mohlmann’s service line, which was ripped off of this property. A claim was made on this as it was a City tree. The insurance company did not approve the claim, stating it was “an act of God”. The tree was a healthy tree. The insurance company suggested the City not make a payment as to not set a precedent. By not disallowing this claim, Mr. Mohlmann would have the ability to come back to the city for six years. If the City disallows the claim, he would have 120 days. Motion (Allendorf/Graber) to recommend Council approval of disallowing a claim against the City of Mineral Point, Iowa County, Wisconsin, by Paul Mohlmann seeking reimbursement for property damage.
