REGULAR MEETING
MINERAL WELLS CITY COUNCIL
CITY HALL ANNEX
June 21, 2016 – 6:00 pm
City Councilmembers present were Mayor Mike Allen, Mayor Pro-Tem John
Upham, Councilmembers Clif Wright, Brian Reagan, Thomas Lively, Tammy
Underwood, and Wayne Johnson. A quorum of City Councilmembers was
present.
Staff members present were City Manager Lance Howerton, Police Chief
Dean Sullivan, Fire Chief Mike Pool, Finance Director John Moran,
Public Works Director Kelly Jones, City Clerk Juanita Formby, and City
Attorney George Gault.
Mayor Allen called the meeting to order, Pastor Ted Oliver of the
Faith Fellowship Chapel of Mineral Wells gave the invocation, and the
Pledges of Allegiance to the U.S. and Texas were recited.
CITIZEN COMMENT
No one had signed to speak.
Mr. Reagan moved and Mr. Upham seconded to approve the following
Consent Agenda and the motion carried 7-0:
1. Consider minutes of previous meeting held June 7, 2016.
2. Consider approval of budgeted expenditures over $500.
3. Consider Interlocal Agreement with Palo Pinto County tax office
for assessment and collection of property taxes.
4. Consider approval of payment to Schrickel Rollins and Associates,
Inc. in the amount of $6,000 for professional services rendered
on the 16” waterline extension project on U.S. Highway 180 West.
5. Consider approval of Financial Reports for March 2016.
ITEMS FOR INDIVIDUAL CONSIDERATION
6. Mayor Allen opened a public hearing at 6:03 pm regarding a
request for a change of zoning from Heavy Industrial to
Commercial on property located at 7703 Highway 180 East in
Mineral Wells, Texas. The applicant and owner of the property,
Paula Sutton, made the request because the parcel owned by her is
divided into the two zones. She would have no particular use for
the Heavy Industrial Zoning, and the Commercial zoning is more
compatible with nearby property uses. The Planning and Zoning
Commission had met on June 6, 2016 to consider this request and
now recommends that the zoning be granted as requested. No one
was present to speak, and the Mayor closed the public hearing at
6:05 pm. Mr. Reagan moved and Mr. Upham seconded to pass and
approve an ordinance amending the Zoning Ordinance of the City of
Mineral Wells, Texas by changing the zoning designation of 5.864

acres out of Abstract No. 1552, T&P RR Company Survey No. 5,
located at 7703 Highway 180 East to the City of Mineral Wells,
Parker County, Texas from Heavy Industrial (HI) to Commercial
(C ) district. Motion carried 7-0.
7. Mayor Allen announced that the Mineral Wells City Council would
now begin a closed Executive Session on this 21st day of June,
2016 at 6:06 pm. The subject matter of the Executive Session
deliberation is as follows: Pursuant to Section 551.087 of the
Texas Government Code, the City Council will deliberate
incentives to American Precision Ammunition, LLC, a business
prospect, to include ad valorem tax abatement and an economic
grant to the Mineral Wells Industrial Foundation for land
acquisition for the benefit of the business prospect. With that,
the City Council adjourned into Executive Session.
8. Following the closed Executive Session, Mayor Allen reconvened
the Council into open session at 6:40 pm to consider any action
resulting from the Executive Session. Mr. Reagan moved and Mr.
Upham seconded to instruct the staff to prepare documents and set
a public hearing to be held on July 5, 2016; and further to
approve an economic development grant to the Mineral Wells
Industrial Foundation in the amount of $150,000 for land
acquisition to be dispersed by the City Manager at the
appropriate time. Motion carried 7-0.
9. There was no further business to be considered, and the meeting
was adjourned at 6:41 pm.

The Mineral Wells City Council will hold a regular meeting at 6:00 p.m. on Tuesday, June 21, 2016 in
the City Council Chambers at the City Hall Annex, 115 S.W. 1st Street, Mineral Wells, Texas to consider
the following agenda:
Call to Order
Invocation – Pastor Ted Oliver of Faith Fellowship Church of Mineral Wells
Pledges of Allegiance to the U.S. and Texas flags
CITIZEN COMMENT
Citizens must provide information required on Speaker Card. The Speaker Card must be given to the City Clerk
before the meeting starts. The Council requests that comments be limited to three (3) minutes. The Texas Open
Meetings Act provides the following:
(a) If, at a meeting of a governmental body, a member of the public or of the governmental body inquiries
about a subject for which notice has not been given as required by this subchapter, the notice provisions
of this subchapter do not apply to:
(1) a statement of specific factual information given in response to the inquiry; or
(2) a recitation of existing policy in response to the inquiry.
(b) Any deliberation of or decision about the subject of the inquiry shall be limited to a proposal to place
the subject on the agenda for a subsequent meeting.

7. Consider conducting a closed meeting pursuant to Section 551.087 of the Texas Government
Code to deliberate incentives to American Precision Ammunition, LLC, a business prospect to
include ad valorem tax abatement and an economic grant to The Mineral Wells Industrial
Foundation for land acquisition for the benefit of the business prospect.
8. Reconvene in open session to take action on matters deliberated in closed session.
