MINUTES REGULAR MEETING MINERAL WELLS CITY COUNCIL CITY HALL ANNEX July 5, 2016 – 6:00 pm City Councilmembers present were Mayor Mike Allen, Mayor Pro-Tem John Upham, Councilmembers Clif Wright, Brian Reagan, Thomas Lively, Tammy Underwood, and Wayne Johnson. A quorum of City Councilmembers was present. Staff members present were City Manager Lance Howerton, Police Chief Dean Sullivan, Fire Chief Mike Pool, Finance Director John Moran, Public Works Director Kelly Jones, City Clerk Juanita Formby, and City Attorney George Gault. Mayor Allen called the meeting to order, Councilman Brian Reagan of the North Oak Church of Christ of Mineral Wells gave the invocation, and the Pledges of Allegiance to the U.S. and Texas were recited. CITIZEN COMMENT No one had signed to speak. Mr. Upham moved and Mrs. Underwood seconded to approve the following Consent Agenda and the motion carried 7-0: 1. Consider minutes of previous meeting held June 21, 2016. 2. Consider approval of budgeted expenditures over $500. ITEMS FOR INDIVIDUAL CONSIDERATION 3. Mr. Howerton told the City Council that the Parker County Appraisal District intends to add 3,500 square feet to its offices on Santa Fe in Weatherford, the cost not to exceed $750,000 and to be defrayed by the taxing entities it services. The bulk of the City of Mineral Wells is in Palo Pinto County, and the much smaller portion situated in Parker County results in a small fee paid by the City to the Parker County Appraisal District each year for its services. The City’s portion of the cost of the proposed addition would be $119 annually. Given that it is a small amount staff recommended that the Council grant its approval of the small expenditure for the renovations. Mr. Upham then moved and Mr. Reagan seconded to adopt a resolution ratifying a resolution of the Parker County Appraisal District Board of Directors to construct an addition to the current Appraisal District office facilities in Weatherford, Texas. Mayor Allen opened a public hearing at 6:05 pm regarding approval of documents regarding Tax Abatement Reinvestment Zone No. 4, providing for abatement of ad valorem taxes for American Precision Ammunition, LLC. Mr. Howerton and Steve Butcher of the Area Growth Council addressed the City Council, presenting instruments that would enable the City to offer tax abatement to this new manufacturing concern seeking to locate in Mineral Wells. Mr. Butcher pointed out that the metes and bounds description of the real property in question was amended just prior to the meeting. No one was present to speak, and the public hearing was closed at 6:12 pm. Following the presentation, actions were taken by the City Council as follows: • Mr. Reagan moved and Mr. Upham seconded to adopt a resolution declaring that the City elects to participate in tax abatement, and the motion carried 7-0. • Mr. Reagan moved and Mr. Upham seconded to adopt a resolution approving guidelines and criteria for tax abatement, and the motion carried 7-0. • Mr. Reagan moved and Mr. Upham seconded to pass and approve and ordinance designating a certain area within the City of Mineral Wells as Tax Abatement Reinvestment Zone Number Four; establishing the boundaries of such zone; ordaining other matters relating thereto; and providing an effective date; to include the revised legal description of the subject zone, and this motion carried 7-0. • Mr. Reagan moved and Mr. Upham seconded to adopt a resolution approving terms and conditions of a tax abatement agreement by and between the City of Mineral Wells, Texas and American Precision Ammunition, LLC, and this motion carried 7-0. 5. Following a brief presentation from Mr. Moran, Mr. Upham moved and Mr. Reagan seconded to adopt an ordinance appointing a special prosecutor, as the City’s municipal prosecutor has recused himself from prosecuting four cases currently pending in the City of Mineral Wells Municipal Court. Motion carried 7-0. 6.
