671 MINUTES I' REGULAR MEETING I MINERAL WELLS CITY COUNCIL ! \ CITY HALL ANNEX December 19, 2017 - 6:00 pm City Councilmembers present were Mayor Mike Allen, Mayor Pro-Tern Tammy Underwood, Councilmembers Brian Shoemaker, Regan Johnson, Jerrel Tomlin, John Upham, and Doyle Light. A quorum of City Councilmembers was present. Staff members present were City Manager Lance Howerton, Finance Director John Moran, Public Works Director Kelly Jones, Fire Chief Mike Pool, Administrative Clerk Peggy Clifton, City Clerk Juanita Formby, and City Attorney Mack Reinwand. Police Chief Dean Sullivan was absent. Mayor Allen called the meeting to order, Pastor Gary Word of City View Church of Mineral Wells led the invocation, and the Pledges of Allegiance to the U.S. and Texas flags were recited. Before considering official business, Mayor Allen recognized outgoing City Clerk Juanita Formby, who was retiring at the end of December 2017, and this would be her last City Council meeting. Councilman Doyle Light presented Juanita with a card and a gift of cash which was collected from current and f orrner City Councilmembers who had served the City of Mineral Wells. Juanita told the City Council that it had been her honor and privilege to work for the City, and that she knew that those elected to this City Council and those in the past served for only one purpose; to make Mineral Wells the best community that it could be, and for that she was most grateful. CITIZEN COMMENT No one had signed to speak Following a motion made by Mr. Upham, seconded by Mr. Light, the following CONSENT AGENDA was approved by a vote of 7-0: 1. Consider approval of minutes of previous meeting held on December 5, 2017. 2. Consider approval of budgeted expenditures over $500. I. _____, 3. Consider approval of Professional Services Agreement and . I Payment to Schrickel, Rollins, and Associates, Inc. in the amount of $12,000.00 in association with the Lake Mineral Wells Spillway repairs. ITEMS FOR INDIVIDUAL CONSIDERATION 5. Mr. Howerton said that the Planning and Zoning Commission had met on December 4, 2017 and among their items of business was a replat, brought by Roger J. Smith, of 0.227 acres, being Lot lOOxlOO S.W. ~ of Block 29, Lot B, of the Wiggins Addition, which is located at 800 N.W. 4th Avenue, and also 0.115 acres, being Lot W2 of SE/2 of Lot B 50xl00 of Block 29, also of the Wiggins Addition, located at 406 N.W. 7th Street. Mr. Smith sought to replat these two lots into one, which would be known at Lot B-Rl, Block 29 of the Wiggins Addition to the City of Mineral Wells, Palo Pinto County, Texas. The Planning and Zoning Commission recommended approval of the replat. Mr. Upham moved that it be approved, Mr. Light seconded, and the motion carried 6-0-1. Councilmember Underwood, an employee of the applicant, abstained from the vote. 6. Mr. Howerton said that the Planning and Zoning Commission had also consider a replat of 3.726 acres of land out of Section No. 13, T&P RR Co. Survey, Block A, E.O.B, Abstract No. 701, Mineral Wells, Palo Pinto County, Texas. Mr. Roland Schultz and Abundant Life Christian Ministr~es hope to construct a church at this site, which is located off of Ram Boulevard. If approved, the newly replatted site would become Lot 1, Block 1 of the Abundant Life Christian Ministries Addition to the City of Mineral Wells Palo Pinto County, Texas. The gas and electric utilities would require access to their· equipment located there and any current easements or rights ~f way through the property. Mr. Shoemaker moved and Mr. Upham seconded to approve the replat, with the required easements/rights of way, and the motion carried 7-0. 7. Mr. Howerton introduced Ms. Tracy Fine of the Sandstone Foothills Senior Housing Limited Partnership/National Church Residences. National Church Residences has approached the City to ask for support for a housing tax credit application to the Texas Department of Housing and Community Affairs (TDHCA) for the renovation of the Mineral Wells City Council Minutes 12/19/2017 Page 2 of 5  673 Sandstone Foothills Apartments. Sandstone Foothills is a senior living facility located at 402 Brazos Drive in Mineral Wells, and is about thirty years old, and in need of refurbishment. Mr. Fine gave a brief presentation, reminding the City Council that she was before them about two years ago with the same request, but this project was not approved at that time. She is hopeful for this current round of applications, but will not hear the results of the scoring until summer of 2018. She presented some detailed information regarding the subject apartment complex, and said that the City's support, in addition to passing a resolution, would include a minimum contribution of $250 and perhaps a waiver of building permit fees, if the project is funded. The City's support will enable the project to _receive additional points in the competitive scoring process. Following the presentation, Mr. Shoemaker moved and Mr. Light seconded to adopt the subject resolution supporting the submission of an application to the 2018 competitive Housing Tax Credit Program through the TDHCA for the Sandstone Foothills Apartments. Motion carried 7-0. 8. Mr. Howerton reminded the City Council of the Downtown Redevelopment Plan prepared by the Institute of Urban Studies of the University of Texas at Arlington. The next step would be the adoption of a Historic Overlay or Historic Preservation District for the redevelopment of the Downtown area. A Historic Resources Survey would help _ identify historically or architecturally significant structures/sites in the downtown area. Mr. Howertdn presented a Request for Proposals to solicit a consulting firm to do the historic resource survey. The price range for this project is expected to be $20,000 - $40,000, and this could be paid for with the Tax Increment Fund which was established in 2008. The Tax Increment Reinvestment Zone #2 Board of Directors met on December 11, 2017 and approved a resolution authorizing the use of up to $40,000 from the Fund for this purpose. The RFP would be advertised as required, with proposals being opened on January 16, 2018. Mr. Upham moved to approve the Request for Proposals to conduct a Downtown Area Historic Resources Survey, Mr. Light seconded, and the motion carried 7-0. 9. Mr. Moran reminded the City Council that a subcommittee of the Council had reviewed proposals from various accounting L firms to perform the City's annual independent financial audit for the fiscal year ending September 30, 2018, and Mineral Wells City Council Minutes 12/19/2017 Page 3 of 5 674 recorrunended engaging Carr, Riggs and Ingram Certified Public Accountants out of Dallas, Texas. Their fee is $28,900, unless the City receives $750,000 or more of grant assistance from the federal government, in which case their fee would increase to $34,220 to perform the required single audit for receipt of federal grant funds. Mr. Moran said that the engagement letter may be approved, contingent upon final approval by the City Attorney. Mr. Upham so moved, Ms. Regan seconded, and the motion carried 7-0. 10. At the previous City Council meeting, it was determined that the City Council would name a citizen corrunittee to review various projects that could become the subject of a future bond election, and it was decided that each City Councilmember would nominate three citizens to serve on the Corrunittee. This Corrunittee may meet several times to determine the most desirable projects for the corrununity. Ms. Johnson moved and Mr. Shoemaker seconded to name the 21 nominees to the Citizen Bond Corrunittee (2017) and the motion carried 7-0. The Corrunittee will consist of the following citizens, nominated by Councilmembers as indicated. Mr. Moran presented a resolution designating the Mayor, Mayor Pro-Tern, and City Manager as authorized signatories for documents associated with a Texas Community Mineral Wells City Council Minutes 12/19/2017 Page 4 of 5  675 Block Grant recently funded, to provide water improvements. This contract is identified as Texas Community Development Block Grant Program Contract 7217319. Mr. Upham moved and Mr. Light seconded to approve the resolution as presented, and the motion carried 7-0. 12. Mr. Moran presented a resolution that ensures no person or group is denied benefits such as employment, training, housing, and contracts generated by the grant activity on the basis of race, color, religion, sex, national origin, age, or disability. This is required for the successful funding of Community Development Block Grant Funds; and the City of Mineral Wells has submitted several application for such funds in recent months. Adoption of the resolution would include 1) Citizen Participation Plan and Grievance Procedure; 2) Section 3 Policy; 3) Excessive Force Policy; 4) Section 504 Policy and Grievance Procedures; 5) Code of Conduct Policy; and 6) Fair Housing Policy. A proclamation naming April as Fair Housing Month is also part of the package. Mr. Upham moved to adopt the subject resolution as presented, Ms. Johnson seconded, and the motion carried 7-0.
