MINUTES REGULAR MEETING MINERAL WELLS CITY COUNCIL CITY HALL ANNEX August 21, 2018 - 6:00 pm Audio recordings of the City Council meetings are available on the City's website at mineralwellstx.gov City Councilmembers present were Mayor Christopher M. Perricone, Mayor Pro-Tern Tammy Underwood, Councilmembers Brian Shoemaker, Regan Johnson, Jerrel Tomlin, Beth Watson and Doyle Light. A quorum of City Councilmembers was present. Staff members present were City Manager Lance Howerton, Finance Director John Moran, Police Chief Dean Sullivan, Fire Chief Mike Pool, Public Works Director Bob Neal, City Clerk Peggy Clifton, and City Attorney Courtney Kuykendall. Mayor Perricone called the meeting to order. Reverend Brian Nierman of the First Christian Church of Mineral Wells led the invocation, and the Pledges of Allegiance to the U.S. and Texas flags were recited. CITIZEN COMMENT Five people had signed to speak and Mayor Perricone recognized each in turn. Thomas Lively (address confidential by law) spoke asking the City Council to compromise with each other. Neil Davis (address confidential by law) spoke of his displeasure with the conduct that the Mayor was allowing during Council meetings. Dustin Richardson address confidential by law) spoke on behalf of the Police Officer's Association showing their overwhelming appreciation of Police Chief Dean Sullivan. Karen Horton of 1040 Horton Lane in Mineral Wells stated how proud she was of the City Council. Ryan Roach of 3907 Highway 281 North in Mineral Wells spoke on recognitions the Mineral Wells Area Chamber of Commerce received being: Best People's Choice for video, advertising, tourism promotion, and local awareness; Judges Choice for best overall local awareness program. Mayor Perricone stated that Item #3 would be moved to Individual Consideration. Following a motion made by Mayor Perricone, seconded by Ms. Johnson, the following CONSENT AGENDA was approved by a vote of 7- 0: ll P age 1. Consider approval of minutes of meeting held August 7, 2018. 2. Consider approval of budgeted expenditures over $500. 4. Consider approval of Bond Report for the month ended July 2018. ITEMS FOR INDIVIDUAL CONSIDERATION 3. Mayor Perricone questioned the Investment Report for the Quarter ended June 2018. He asked where the $800,000 went from March to June. Mr. Howerton stated that property tax payments were made in January and February and are typically drawn down the later part of the year. These are collected at one time and spent over the course of the calendar year. Mrs. Underwood moved and Mrs. Watson seconded to approve the Investment Report for the Quarter ended June 2018. Motion carried 7-0. 5. Mayor Perricone opened a Public Hearing at 6:24 to consider an ordinance for the approval of a Rezone of a 1.497 acre tract of property, being Lot 1, Block 1, of the Jacks Addition to the City of Mineral Wells, Palo Pinto County, Texas, from (WP-A) Wolters Park Zone A to (WP-B) Wolters Park Zone B, to allow construction of a single family home. Mr. Howerton stated that at its meeting on August 6, the Planning and Zoning Commission approved this request to build a brick home on the property. Mayor Perricone closed the Public Hearing at 6:28. Mr. Shoemaker moved and Mr. Tomlin seconded to approve an ordinance of the City of Mineral Wells, Texas, amending the City of Mineral Wells Zoning Ordinance to change the zoning classification on a 1.497 acre tract of property, being Lot 1, Block 1, of the Jacks Addition to the City of Mineral Wells, Texas, from Wolters Park Zone a (WP-A) to Wolters Park Zone B (WP-B); providing a penalty not to exceed $2,000 for each offense; providing severability, repealing and savings clauses; providing an effective date; and providing for the publication of the caption hereof. Motion carried 7-0. 6. Mr. Howerton stated that at its meeting on July 17, Council approved a Specific Use Permit for 2020 South Oak and the City Attorney said we needed an ordinance to go with it. Mrs. Underwood questioned a trailer on the property. Ms. Johnson questioned the extra cargo containers on the property. Russell Hess said that three months would be adequate time to clean up the property. Mrs. Underwood moved and Ms. Johnson seconded to approve the ordinance with the stipulation that Mr. Hess has 90 days to remove other items from the property. Motion carried 7- 0. Mrs. Underwood then moved and Mr. Light seconded to approve an ordinance adopting Specific Use Permit 2018-01 for a cargo 21 Page  container on certain property known as 2020 South Oak Avenue, Mineral Wells, Texas zoned General Retail (GR); amending the zoning district map accordingly; providing for a penalty not to exceed $2,000 for each violation; providing this ordinance be cumulative; and providing for severability, governmental immunity, injunctions, publication, and an effective date. Motion carried 7-0. 7. Mr. Howerton stated that at its most recent meeting the Council approved recommendations from Councilmember Light regarding Residential Certificates of Occupancy and changes to be made in the Property Maintenance Code relating thereto. Mrs. Underwood moved and Ms. Johnson seconded an ordinance of the City of Mineral Wells, Texas amending Section 26-331 (same-amendments) of article XII (Property Maintenance Code) of Chapter 26 (Buildings and Building Regulations) of the City of Mlneral Wells Code of Ordinances; and providing a penalty clause; providing a savings clause; providing a cumulative clause; providing a severability clause; providing a repealer clause; and providing for an effective date. Motion carried 7-0. 8. Mr. Howerton stated that at the same meeting Council approved Councilmember Light's recommendation regarding the Residential Code. Mr. Shoemaker moved and Mrs. Watson seconded to approve an ordinance of the City of Mineral Wells, Texas amending Section 26-77 (same-amendments) of article IV (Residential Code) of Chapter 26 (Buildings and Building Regulations) of the City of Mineral Wells Code of Ordinances; and providing a penalty clause; providing a savings clause; providing a cumulative clause; providing a severability clause; providing a repealer clause; and providing for an effective date.
