MINUTES REGULAR MEETING MINERAL WELLS CITY COUNCIL CITY HALL ANNEX February 19, 2019 - 6:00 pm Audio recordings of the City Council meetings are available on the City's website at mineralwellstx.gov City Councilmembers present were Mayor Christopher M. Perricone, Mayor Pro-Tern Tammy Underwood, Councilmembers Brian Shoemaker, Regan Johnson, Jerrel Tomlin, Beth Watson and Doyle Light. A quorum of City Councilmembers was present. Staff members present were Interim City Manager Margie Rose, Finance Director John Moran, Police Chief Dean Sullivan, Fire Chief Mike Pool, Public Works Director Bob Neal, City Clerk Peggy Clifton, and City Attorney Melissa Cranford. Mayor Perricone called the meeting to order . Pastor Gary Word of the City View Church of Mineral Wells led the invocation, and the Pledges of Allegiance to the U.S. and Texas flags were recited. CITIZEN COMMENT No one had signed to speak. PRESENTATION Mayor Perricone presented an award to the Public Works Department that was from the Mineral Wells Volunteer Fire Department for all of their help to the Department. Public Works employees Bob Neal, Chris Thibault, David Fitzhugh, Mark Sparks, Kelle Nimmo, and Benny Fisher were present to receive the award. Following a motion made by Mr. Shoemaker, seconded by Mrs. Watson, the following CONSENT AGENDA was approved by a vote of 7-0: 1. Consider approval of minutes of meeting held January 31, 2019 and February 5, 2019. 2. Consider approval of budgeted expenditures over $500. 3. Consider approval of Financial Report for the month ended October 2018. ll Page 4. Consider approval of the Investment Report for the Quarter ended December 2018. 5. Consider approval of the Bond Report for the Month ended January 2019. ITEMS FOR INDIVIDUAL CONSIDERATION 6. Mrs. Rose requested that this item on an assignment of a lease between Tru-Test, Inc. and Datamars, Inc. for property located at 524 Taylor Street be removed from the agenda. This item is for one property and the companies thought that it would be for two properties. Mrs. Underwood moved and Ms. Johnson seconded to remove Item #6 from the agenda. Motion carried 7-0. 7. Mr. Light stated that he plans to attend the Texas Department of Transportation's Texas Transportation Plan 2050 Workshop in Arlington, Texas. He hopes to keep plans and ideas for Mineral Wells moving forward and wants them to see how engaged the City is. Mrs. Underwood moved and Ms. Johnson seconded to approve the travel/reimbursement request for Councilmember Doyle Light to attend the Texas Department of Transportation's Texas Transportation Plan 2050 Workshop in Arlington, Texas. Motion carried 6-0-1 with Mr. Light abstaining. 8. Mr. Moran stated that the City has two municipal judges, one judge and one alternate judge. Alternate Municipal Judge Mike Smiddy has decided not to seek reappointment to the position this year when his term expires. The position of Alternate Judge will become vacant effective April 1, 2019. He requested that the City Council authorize staff to solicit applications for the position. Staff will provide the City Council with a summary of the applicants for further Council consideration. Mr. Light moved and Mrs. Watson seconded to authorize staff to solicit applications for position of Alternate Municipal Judge. Motion carried 7-0. 9. Mr. Moran stated that during this year's budget cycle, $25,000 was budgeted to outsource mowing services that had formerly been handled by the Street Department. This mowing generally consists of mowing abatement lots and other lots as identified by Code Enforcement. There may also be some minor mowing of right-of-way and other city owned property. This Request for Proposals is intended to free up Street 21 Pa ge  Department personnel from mowing duties and allow them instead to work on street infrastructure. This will be set up as a "rate per job" agreement. Chris Thibault said this would free up three to five employees per day. The Request for Proposals will be due from the respondents on March 19, 2019. Staff anticipates bringing a recommendation to the City Council at the April 2, 2019 meeting. Mr. Light moved and Mr. Tomlin seconded to authorize a Request for Proposals solicitation for Mowing Services. Motion carried 7-0. 10. At the previous Council meeting, Mrs. Underwood asked where we were in the process of the Historical District Program. Mr. Moran stated that the initial study was done but it had not gone any further. The first phase is to do a preliminary eligibility study at an approximate cost of $1000-$2000. If we are eligible, the cost would be $25,000 to hire a firm to complete the application process. TIRZ funds may potentially be available for this. Mr. Shoemaker moved and Mrs. Underwood seconded to move forward with the preliminary eligibility study regarding the City's participation in the National Register of Historic Places Program. Motion carried 7-0. 11. Future agenda items/requests by Councilmembers to be on next agenda: Item #6 Consider and take action on an assignment of a lease between Tru-Test, Inc. and Datamars, Inc. for property located at 524 Taylor Street, Mineral Wells, Texas to be placed on the next agenda. Mayor Perricone asked about a TIRZ meeting being set up to consider using TIRZ funds for the damage on the Women's Club building. No action taken. 12. Mayor Perricone announced that in accordance with Texas Government Code, Section 551.001, et seq., the City Council will recess into Executive Session (closed meeting) at 6:30 p.m. to discuss the following: a) §551.071 (1) (2): To consult with attorney regarding pending or anticipated litigation, or on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Texas Government Code regarding: City Manager hiring process and candidate selection. b) §551.074: Deliberation regarding the appointment and duties of a public officer or employee: City Manager hiring process and candidate selection. 3I Pag e 13. Mayor Perricone announced that in accordance with Texas Government Code, Chapter 551, the City Council will reconvene into Regular Session to consider action, if any, on matters discussed in Executive Session at 7:40 pm.
