MG Power provided a background on the Taskforce and commented on the real world issues faced by the Taskforce. They indicated Minot Air Force Base has a $500 million impact on the City of Minot and thanked the Council for its support. CITY MANAGER REPORT The City Manager presented the Council with the Public Information Officer’s flood recovery report and provided updates on the 55th Street/NE Bypass project and the traffic signal repairs. He indicated the majority of the bypass work would be completed in September 2012 with the bridge to be completed in late fall. He commented the traffic signal repairs to the 27th Street SE and 8th Avenue SE intersections with Burdick Expressway and the pedestrian crossing would be completed before the North Dakota State Fair. He reported the remaining highway intersections would all be completed by the end of August. The City Manager reported on the recent Civil Service Commission meeting and stated the next meeting would be held on July 5, 2012. Dwayne Sikich, representing Evergreen Neighborhood Development, appeared before the Council and gave a presentation on the proposed development. He answered questions from the Council regarding access, number of homes, erosion control methods, and cul-de-sac lengths. Upon questioning, the City Planner stated the Planning Commission denied the request due to protests against the request. She clarified the difference between R-1 (Single-Family Residence District) and R-4 (Planned Residence District). She indicated traffic patterns would change with the improvements to 19th Avenue NW and the construction of the Marketplace Foods complex and should alleviate traffic issues. John Bills, 504 27th Street NW, appeared before the Council to express opposition to the request citing the smaller lot sizes, potential park access, storm water management, and density concerns. Rhonda Murray, 523 27th Street NW, appeared before the Council to express her concern with the traffic increase the subdivision would add. Aldermen discussed traffic increase, density, storm water, and access concerns. Alderman Moen expressed her opposition to the motion. Alderman B. Miller expressed his support for the request. Motion seconded by Alderman Lehner and carried unanimously. Alderman Knudsvig moved that the City Council pass Ordinance No. 4542 on second reading. ADMINISTRATIVE APPROVALS – RATIFICATION Alderman Krabseth moved that the City Council ratify the following administratively approved requests for June 2012: a. ND State Hog Rally for a local permit to conduct raffle on July 14, 2012 and July 13, 2012 at Grand International (1505 North Broadway). b. Minot Family YMCA for a local permit to conduct raffle on September 1, 2012 at the Minot YMCA (3515 16th Street SW). c. Roosters Nightclub for a special event permit on June 7, 2012 at Otis and James Studio (7 South Main Street). d. The Pour Farm for a special event permit on June 24, 2012 at 401 5th Avenue NE. e. Sweet and Flour Patisserie for a special event permit on June 16, 2012 at MAYSA Arena (2501 Burdick Expressway West) f. Grand International for a special event permit on July 3, 2012 at the Dakota Air Museum (100 34th Avenue NE). Miller, Moen, Olson, Seymour, Withus. nays: none. EXECUTIVE SESSION – ROBERT AND DONNA IRWIN LITIGATION Mayor Zimbelman stated the next item on the agenda would be an executive session. This item may be discussed in an executive session. The legal authority for closing this portion of the meeting is N.D.C.C 44-04-17.1, 19.1, and 19.2. The topic of this executive session is the Robert and Donna Irwin Litigation – Attorney Consultation and Discussion of Potential Litigation Strategy and/or Negotiation Strategy/Instructions. The Mayor stated, at this time, a motion would be in order to discuss the next topic in executive session rather than in an open meeting. Whereupon, Alderman B. Miller moved that the City Council move to an executive session. Motion seconded by Alderman Hatlelid, and carried by the following roll call vote: ayes: Connole, Frantsvog, Frey, Hatlelid, Jantzer, Knudsvig, Krabseth, Lehner, B. Miller, M. Miller, Moen, Olson, Seymour, Withus. nays: none. The Mayor then stated the executive session will be recorded and all members of the governing body are reminded to limit their discussion during the executive session to the announced topic. Any collective decision, collective commitment, or other final action by the governing body must occur after it reconvenes in an open meeting, unless final action is specifically required by law to be taken during the executive session. The prohibition on taking final action during the executive session did not apply to providing guidance or instructions to our attorney or counsel. Mayor Zimbelman asked the members of the public attending the meeting to leave the room. He stated the Council anticipated adjourning the executive session, and reconvening the open portion of the meeting in approximately 30 minutes. The executive session began at 7:31 pm and was attended by all members of the City Council, City Manager, City Clerk, Finance Director, Public Works Director, City Attorney, and City Clerk Secretary. The executive session adjourned at 8:28 pm and the public was invited to return to the meeting room with the City Council meeting back in session. The Mayor indicated the executive session had discussed the litigation strategy and negotiation/instructions with legal counsel, and that instructions had been given to counsel which did not require final action at this time. ADJOURNMENT There being no further business, Alderman B. Miller moved that the City Council meeting be adjourned. Motion seconded by Alderman Withus and carried unanimously.
