EMERGENCY ACTION TO REPAIR STORM SEWER AT 9TH STREET NW-BETWEEN 7TH AVENUE NW AND UNIVERSITY AVE – APPROVED Alderman Hatlelid moved the City Council declare an emergency situation to repair the storm sewer at 9th Street NW – between 7th Ave NW and University Ave and authorize the Public Works Director to proceed immediately, foregoing the normal bid process. Motion seconded by Alderman Krabseth. The Public Works Director reported on the sewer line at 9th Street NW has collapsed in three locations and would need to be replaced this year to prevent flood damage to homes in this block. He further explained the required bidding process would generally take two to three months to complete before this project could move ahead which would be too long with the emergency situation the collapse presents. He went on to reference City Code 2-134c3 which eliminates the bid process when a governing body declares an emergency situation under state statute 48-01.2-04(2). He recommended the City start the replacement of the sewer line immediately. Material costs are estimated to be $30,000 and installation costs will be approximately $135,000. He stated funds for this project will come from the storm sewer replacement budget. OTHER BUSINESS VARIANCE REQUEST – THE BEACON – J2 VENTURES - DENIED Alderman Krabseth moved he City Council approve the variance request by J2 Ventures for a change in allowed unit density of 67 units to 132 units and parking density of 400 spaces to 340 spaces and 48 motorcycle spaces on the Beacon Addition, Lot 1. Motion seconded by B. Miller Jodi Winters and Joowan Lee representing J2 Ventures, appeared before the Council to request the density variance. They stated the property should qualify for a hardship variance because of the size and shape of the property. The also indicated they had completed the process to receive NDDOT approval on some of the traffic concerns. They had also hired a civil engineer to address the water and sewer capacity issue, and have been told this project will only take up to 50% of water and sewer capacity for the development. Alderman Connole and Alderman B. Miller spoke in favor of the project. Planning Commission Chairman, Pankow, expressed his concern with allowing a 97% variance over the recently approved building and zoning ordinance. He indicated this would set a bad precedent for any future development requests. Alderman Knudsvig stated he would not support the request which would invalidate the work done to achieve a good Comprehensive Plan for future development. Whereupon, a vote was taken on the above motion by Alderman Krabseth seconded by Alderman B. Miller and was defeated by the following roll call vote: ayes: Connole, Jantzer, Krabseth, B.
