Miller effective August 18, 2014, leaving a vacancy in Ward 4; and further authorize the Mayor to fill the vacancy by appointment. The Assistant City Attorney reviewed the process to fill the vacancy. She stated after 15 days of the date of vacancy, the City Council can appoint a new Alderman until the next City Election per NDCC 40-08-08. Mayor Barney mentioned having concerns with the 4th Ward not having any representation. He stated he had two individuals, Richard Sabol and Dave Schmento, express interest in filling the position. He then gave each individual an opportunity to address the Council. Richard Sabol of 2205 Crescent Drive appeared before the Council to state he contacted the Mayor to express his interest in filling the vacant Alderman position for Ward 4. He and his family have resided in the City of Minot for 34 years. He stated he served on the Park Board for 1 term, and served for 2 terms on the All Seasons Arena Committee as a representative of Ward County. He also served on the City Forestry Committee and is familiar with City Government. David Shomento of 1381 28th St. NW appeared before the Council to express his interest in filling the vacant Alderman position for Ward 4. He stated he has resided in Minot since 1959. He is the owner of Sammy’s Pizza and previously worked in the area of finance. He stated he has never participated in the City government but would like the opportunity to serve in his Ward. CITY MANAGER REPORT The Acting City Manager welcomed newly appointed Alderman David Shomento and informed him his first meeting would be the first reading of the budget on Monday, September 8 at 6:30pm. She reminded the audience the second reading of the budget would be on September 15th at 6:30pm. She stated the North Dakota League of Cities Conference is meeting September 26th and 27th in Minot. She also informed attendees that Jackie Velks last day in Senator Hoeven’s office would be September 12th. She concluded by stating representatives from the office of Inspector General for HUD would be in Minot starting September 16th to audit CDBG funds received. CITY ATTORNEY’S REPORT Upon questioning by Alderman Seymour, the Assistant City Attorney explained the next steps to be taken in the nuisance abatement process. She met with the staff of the Engineering Department to discuss the matter. She stated almost all of the approximately 400 notices have been mailed out to property owners and the next step is to re-analyze the properties and prioritize those with the greatest safety concerns. She said the City may need to seek administrative search warrants to enter these properties. The Assistant City Attorney continued by saying City staff may need to coordinate with First District Health unit if a safety issue does exist. UNDERPASS FORCEMAIN (3236) – APPROVED Alderman Connole moved the City Council approve the plans and specifications for the 6th Street Underpass forcemain project (3236); and further authorize a call for bids. Motion seconded by Alderman Lehner. Upon questioning by Alderman Hatlelid regarding the progress on the 6th St. Underpass project, the City Engineer stated the goal is to get the underpass open by the end of September. He said staff is currently working on the sidewalks and the work on Burdick Expressway and 6th St. is complete and staff is waiting for the concrete to cure. He continued by saying the only portion of the project remaining is the lift station and forcemain which will be completed next year. Whereupon a vote was taken on the above motion by Alderman Connole, seconded by Alderman Lehner and carried by the following roll call vote: ayes: Berg, Connole, Frantsvog, Frey, Hatlelid, Jantzer, Lehner, B. PROJECT CONCEPT REPORT AND DECISIONS DOCUMENT – PERKETT SIDEWALK PROJECT (3874) – APPROVED Alderman Connole moved the City Council approve the concept with proposed building alternative for the Perkett Sidewalk project (3874); approve the locations of the sidewalks as presented in the application and authorize the City Engineer to move forward with plan preparation and the bidding of the project. Motion seconded by Alderman Frantsvog. Richard Rodman of 432 21st St. SW appeared before the Council to state he has lived on the property since 1975. In early 2000 he was told sidewalks would be needed in his neighborhood, but the majority of homeowners objected to this so sidewalks were not installed. He said he was put a lot of money into his house and his yard and he is asking for modification of this project to save his landscaping and trees. He concluded by stating there are very few children in his area that would use a sidewalk on 21 st St. SW. Alderman Lehner stated in the Public Works Committee meeting, there was discussion in regards to saving his trees and island planter. Alderman Connole stated the neighborhood was built when no sidewalks were required but the Ordinance now states the sidewalks are required, and should be installed since the neighborhood is close to a school. He concluded by stating he would like to see the trees saved and asked the Engineering Department to work with neighbors on the project. The Traffic Engineer stated working around the trees will not jeopardize funding and the concept of the project states the City is trying to work around at least of the trees in question. She stated Mr. Rodman’s planter is 1-1 ½ feet off the property line and the pavers in planter will need to be compromised but not the planting. She concluded by stating the City will work around as much as possible. Mr. Rodman stated he can’t just take out pavers, he would need to have a landscaper rework the planter. Upon questioning by Alderman Lehner in regards to if a pedestrian traffic study had been completed the Traffic Engineer stated no pedestrian count has been done at this time and would not have been accurate since the school was not in session.
