He noted an updated survey was approved with the ten foot setback, and he used local engineer KLJ to be in compliance with City Zoning Code. The City Engineer explained the original plan to staff did not indicate there were garage structures, as no dimensions were provided and staff cannot determine what the structures are. He said staff cannot override zoning ordinances administratively and a variance request never came to the Planning Commission. The Building Official informed them the structures were in the setback. The City Engineer stated the applicant was told they needed to correct the plan, but the garages had not been built at the time the setback issue was discovered. CITY MANAGER REPORT City Manager Lee Staab indicated he will have the results of the HUD Resiliency Application by June 15 th. He noted the Comprehensive Plan, the Transportation Plan and the River Front and Center Plan remain priorities. He said the City is tightening the procedures related to nuisance and zoning enforcement and the City has recently participated in the Beautify Minot campaign. Mr. Staab also reviewed several departments and some of the work they have been involved in. He stated the Police Department has put in a lot of work and emphasis on traffic citations, the Fire Department has had the recent retirements for senior staff members and the Engineering Department is working on maintaining parking structure progress. He also said the Public Works Department will review GPS vehicle tracking at the next City Council Meeting. He concluded by reminding Council members of the upcoming Airport tour on May 5th. Bobby Roberts of 1217 7th Ave NE, asked if this ordinance includes a grandfather clause on pitbulls as service dogs so as not to open up opportunity for individuals to specifically pick the breed as a service animal. The City Attorney stated that Special City Attorney Pat Seaworth had researched the issue and found that strict bans of breeds as service animals have been challenged in court. This ordinance has added specific language describing the owners’ responsibility in having this breed as a service dog such as fencing requirements. Motion seconded by Alderman Connole. Daniel Haff of Souris River Brewing and Shauna Downing of The Landing appeared together before the Committee representing several downtown supper club licensees and bar licensees to come to a compromise. They reviewed the ordinance to look at the intention of the supper club license. Upon questioning by Alderman Frantsvog on who was invited to participate, Ms. Downing stated she has contacted all the bar owners and Mr. Haff contacted most of the Supper Club owners. Mr. Haff noted some of the supper club owners chose not to participate in the discussion but they are in agreement and larger restaurants have their own business practices so they chose not to participate. The City Attorney expressed her concerns about some category licenses having different restrictions in different parts of town. She stated the Council can also direct a committee be appointed to review the issue. Alderman Frey suggested this ordinance be sent back to the Liquor and Gambling Committee. Alderman Lehner raised concern of the issues that will face the county club in getting their license if delayed. The City Attorney stated if this ordinance is sent back to the committee, it will still return to Council for a second reading. She expressed concern of the current renewal process that is approaching and the need to have the compliance issue addressed before renewals are issued. Alderman Hatlelid moved the City Council move this item back to the Liquor and Gambling Committee. Motion seconded by Alderman Connole. Scott Knudsvig of Pringle Herigstad Law Firm, representing Dakota Dave’s, stated they were not invited to participate in the negotiations with other supper clubs and bar owners. He stated they just received their recommendation tonight and they are not in agreement with the terms. He noted they are okay with sending the item back to committee for further discussion. Mike Miller of the Minot Country Club asked if he can still make an application for the Country Club. The City Attorney stated he will need to wait on the application as a private golf course designation does not exist. Alderman Olson commended the groups in coming together. She stated the recommendations don’t address the need for supper clubs to serve food and some downtown supper club owners have already stated they will work around the ordinance if need be. Mayor Barney stated he believes the supper club owners clearly understand what the spirit of the ordinance is and he trusts they will follow the ordinance as it is passed. He agreed a special City Council meeting be called to approve the Country Club application as necessary. He stated there is not a specific timeline because it is determined by river flow and the ability to take equipment into the river. He said the City would be repairing a walkway fence along 27th St. SE, which had been damaged by the driver of a stolen vehicle. The Public Works Director stated the City was having difficulty in getting this covered by insurance and would most likely be paying for the repairs outright. Alderman Frantsvog moved the City Council award the bid to Utility Systems of America in the amount of $172,450 for the Puppy Dog Sewer Phase VI; and further authorize the Mayor to sign the contracts on the City’s behalf.
