MAYOR’S REPORT The Mayor reported that the trip to Norway with Minot State Contingency was very productive. The trip involved several meetings with companies with prospective interest in the Agricultural Park, Business Park and the Bakken Region. On September 2nd he traveled to Fargo with the City Manager, Public Works Director and Ryan Ackerman to meet with USACE General Bostick, General Wehr, Senators Hoeven and Heitkamp and Governor Dalrymple to discuss flood protection and start of the project. The USACE was very receptive. On September 3rd, he met with Governor Dalrymple concerning the NDDOT Broadway Bridge project and to update him on the HUD Resiliency Grant, and attend a groundbreaking for the HMGP Water Treatment Plant project. CITY MANAGER REPORT The City Manager gave an update on current priorities for the City. He stated public communication and transparency was expected to be greatly improved with implementation of the new City website. He also listed ongoing priorities involving the downtown parking and infrastructure and phase II of the HUD Resiliency Competition. The City Manager noted the increased case load in the Police Investigation Department and calls for service due to an increase in the crime rate for the City. He stated the Public Works Minot NE Sewer project was submitted and selected to be presented for a National Award and recognition at the National Association of Trenchless Technology Conference. He updated those in attendance on the status of the HUD Resiliency Application phase II which continues. Mr. Staab mentioned partnerships being formed with leverage commitments and said the City of Minot was one of the five communities selected to be filmed for a documentary for the Rockefeller Foundation. He gave an overview of progress on the downtown infrastructure projects and the parking ramps and stated the 6th Street underpass pump station continues. He noted 6th Street would be open during the winter months. Mr. Staab completed his report with a review of the Airport Terminal which is 87% complete and is slated to open in February 2016. Mr. Staab introduced the Public Information Officer who gave a brief demonstration of the new City of Minot website. REVISION TO RESOLUTION NO. 3435- REENACT A MORATORIUM ON BILLBOARDS – APPROVED Alderman Hatlelid moved the City Council revise the language in resolution 3435 concerning a moratorium on billboards/off-premises signage. Alderman Hatlelid asked the language be changed to place a moratorium on new signage only, not on existing signage. He stated the language will not include a change of effective date which will remain August 3, 2015 EXECUTIVE SESSION Mayor Barney stated the next item on the agenda would be an executive session. This item may be discussed in an executive session. The legal authority for closing this portion of the meeting is N.D.C.C 44-04-17.1, 19.1, and 19.2. The topic of this executive session is Robert W Irwin et al v. City of Minot – Attorney Consultation and Discussion of Potential Litigation Strategy and/or Negotiation Strategy/Instructions. The Mayor stated, at this time, a motion would be needed in order to discuss the next topic in executive session rather than in an open meeting. Whereupon, Alderman Hatlelid moved that the City Council move to an executive session. The prohibition on taking final action during the executive session did not apply to providing guidance or instructions to our attorney or counsel. Mayor Barney asked the members of the public attending the meeting to leave the room. He stated the Council anticipated adjourning the executive session, and reconvening the open portion of the meeting in approximately 20 minutes. The executive session began at 7:10 pm and was attended by all members of the City Council with the exception of B. Miller and Shomento, who were absent, as well as the City Manager, City Clerk, Finance Director, City Attorney, Public Works Director and Clerk Admin. The executive session adjourned at 7:25 pm and the public was invited to return to the meeting room with the City Council meeting back in session.  September 8, 2015 The Mayor indicated the executive session had discussed the litigation strategy and negotiation/instructions with legal counsel, and that instructions had been given to counsel on how to proceed.
