PERSONAL APPEARANCES Shaun Sipma of 920 4th Ave NW spoke before the Council on behalf of MakeMinot. He stated, the petition regarding a five person Council was certified on December 2nd and he requested an amendment be made to the Home Rule Charter. He explained that in 1985 a clause for changing the governing body was added to the Century Code but Minot has not adopted the clause. He continued by saying he would like to see a vote since the City has authority to adopt the clause and has not done so. He indicated, as a precedent, former Mayor Backes introduced a tax amendment in 2011 which was then voted on a proposed ballot initiative along with an amendment of the Home Rule Charter. Mr. Sipma stated MakeMinot would like to use a similar format to vote on their measure. Mayor Barney stated the City will contact the County to determine a date for a vote. He will then schedule a Special City Council Meeting if necessary to propose an amendment to the Home Rule Charter. Upon questioning by Alderman Seymour, Mr. Sipma described his idea for the ballot by using the previous ballot from 2011 as an example.  December 7, 2015 Alderman Shomento questioned whether it is possible to use a 3 option ballot, in order to choose the preference between leaving council as it is; changing to a 5 person Council as MakeMinot suggests or changing to an 8 person Council as former Mayor Orlin Backes suggested. Mayor Barney responded that discussion is underway as to how to best utilize a ballot. Josh Wolsky of 1340 S. Main St. came before the Council as a citizen concerned over the enforcement of current policies, specifically regarding liquor licensing laws. He stated, that on Wednesday, December 2nd, there was a hearing during the meeting of the Liquor and Gambling Committee, at which, the Committee decided to allow Sidekicks to continue operating despite having several violations brought against them. Mr. Wolsky applauded the decision as pro-business, but stated his concern for the precedent it may have set. He explained that as a result of the lack of enforcement, it gives bar owners the impression there is little reason to comply with liquor laws; that in order for a hotel/motel license to be authorized, the bar simply needs to be located “near” a motel; and that the Liquor and Gambling Committee has the ability to enact new laws. Mr. Wolsky continued by saying this is the second incident in the past year where regulations on liquor have been discussed. In 2014 regulations were loosened to allow the growing Renaissance Zone to compete downtown. Since then, he stated, SupperClub regulations have become more restrictive causing locations to close. Mr. Wolsky believes the liquor laws are archaic and should undergo a complete rewrite to send a message encouraging a free market for business and investment. Rob Schutt of 2413 7th Ave SW, came before the Council to discuss an application that has been submitted to move a property to his neighborhood. He brought up concerns about the current property values being affected by introducing an older home to the area. Mayor Barney stated he would meet with him after the meeting as that item has been pushed back for discussion at a later date. MAYOR’S REPORT The Mayor stated he and the City Manager had returned from a productive visit to Washington D.C. where they attended meetings with Senator Hoeven and the U.S. Army Corps of Engineers. He stated their meetings regarding energy and water bills could result in funding for studies on local flood protection. They also met with the Office of Management and Budget. When asked by Alderman Hatlelid whether the studies would delay the start of any projects, the Mayor replied, it would not. Mayor Barney welcomed a Boy Scout Troop in attendance for their citizenship badge. He concluded by acknowledging Fire Chief CJ Craven with a letter of recognition of 35 years of excellent service. CITY MANAGER REPORT The City Manager gave a presentation highlighting each of the City departments. He stated Human Resources is emphasizing recruitment, especially for the new airport. Engineering is finishing with the 6th Street Underpass project which should be open by the end of the year. The Downtown Parking structures are continuing with construction as a result of the cooperating weather. The Renaissance structure will have one level of parking open to the public on December 15th at 2:00 pm. It will consist of 35 spaces and will be free of charge until its completion in January. The Police Department has focused attention on texting a driving which yields a fine of $100 per offense. The Assessor’s office has assessed about 2500 properties throughout Minot. The new Airport Terminal is currently on track for a February 20th Open House, a Soft Opening on February 29th and a Grand Opening on May 6, 2016. He concluded his report by stating an application was submitted for the Resilience Americorps 100 Resilient Cities, which should be awarded in April. RESOLUTION NO. 3464 – EXTEND AN INTERIM USE PERMIT FOR AN ADDITIONAL YEAR TO MINE/EXCAVATE AGGREGATES ON WHISPERING MEADOWS 4TH ADDITION, LOT 2 – APPROVED Alderman Jantzer moved the City Council approve the request by Sundre Sand & Gravel represented by Dennis Nussbaum, to extend an Interim Use Permit for an additional year to mine/excavate aggregates that was originally approved by City Council in October 2014 on Whispering Meadows 4th Addition, Lot 2.  December 7, 2015 This property is located west of 6611 37th Ave SE. Conditions: 1. Responses to IUP standards shall be submitted by the applicant and approved by staff. 2. Only excavation shall occur on site, no processing or crushing activities shall occur on site 3. The outer limit or edge of any extraction operation shall not be closer than one hundred feet (100') to any abutting property line. Soil excavation may occur within one hundred feet (100') of any property line when the proposed grading plan has been approved by the City Engineer. 4. Finished slopes or any edge contiguous to property owned by others shall not be less than a ratio of three feet (3') horizontal to one foot (1') vertical, or as approved by the appropriate regulating authority. 5. No extraction operations shall be closer than one hundred feet (100') to the right of way line of any existing street, road or highway, except upon approval by the city council. 6. The operator shall be responsible for lowering any well so as to provide potable water for each individual whose well is affected by the proposed operations. 7. All rocks which are not crushed and which are one foot (1') or larger in size shall be removed from the site, buried after termination of operations, or used on site as a landscape feature. 8. The owner or applicant shall prevent water runoff damage, including erosion on adjacent property and the deposit of material by water runoff on adjacent property. A storm water management plan shall be approved by the City Engineer. 9. The applicant or owner shall submit a landscape screening plan consisting of suitable trees which shall be placed to eliminate unsightly view of the operations. 10. The operator shall operate and maintain all equipment in such a manner as to minimize air pollution. Any emission which can cause any damage to health, animals or vegetation or other forms of property or which can cause an excessive silting at any point or any emission of any solid or liquid particles in concentrations exceeding air quality regulations shall be prohibited. 11. All excavated materials shall be removed from the premises especially within highways, streets or other public ways as the council shall order and direct. 12. No noise resulting from the excavation use shall exceed the most current noise control regulations. 13. Any vibration resulting in any combination of amplitude and frequencies beyond the "safe" range of the most current standards of the United States bureau of mines for any equipment or structure shall be prohibited. 14. The slope of banks during the excavation of material shall be kept in such a condition so as not to be dangerous because of overhangs, sliding or caving banks. Such dangerous conditions shall be declared to be a nuisance and the city may give notice to the operator or owner to abate the same. 15. Upon closing operations or leaving any particular excavation or area in the site, the applicant shall regrade the area which he has excavated or disturbed in order that no slopes are steeper than three feet (3') horizontal to one foot (1') vertical 16. The hours of operation (limited to only excavation) shall occur only between 8:00 a.m. to 5:00 p.m. daily, provided that no excavation or trucking shall be conducted on Saturdays, Sundays or legal holidays with the exception of Columbus Day and Veterans Day except upon approval by the city council. Certain activities such as loading, maintenance and repair of equipment and hauling may be allowed; provided that these activities do not cause undue noise or disturbances to adjoining property or facilities and that these activities are specified in the operations plans and approved by the city at the time of issuance of the permit. 17. All fill material shall be clean, compactable fill, and shall not contain refuse, construction debris, or any other items (tires, barrels, furniture, etc.) not found in soils. The fill material must be approved by the city engineer and protective inspections division if the fill area will be used for a road or building construction site. 18. Security Requirement: The council shall require the applicant, owner or user of the property on which the proposed operation is located, to post a letter of credit acceptable to the city or cash escrow in such form and sum as the council shall determine, conditioned to pay the city the extraordinary cost and expense of repairing, from time to time, any highways, streets or other public ways where such repair work is made necessary by the special burden resulting from the hauling and removal of material from any operation; the amount of such cost and expense to be determined by the city engineer; and conditioned further to comply with all the requirements of this chapter, and the particular permit, and to pay any expense the city may incur by having to do anything which the applicant fails to do to comply with the terms of the conditional use permit. 19. Interim Use permit shall valid for two years from date of issuance and begin once the Zone Change is complete. 20. All conditions approved with the previous permit still apply to this application. See attached IUP. Finding of Fact:  December 7, 2015 1. The subject property is zoned AG which allows mining with an Interim Use Permit. 2. Section 19-5: The conditions require approval of IUP 3. Motion seconded by Alderman Hatlelid and carried unanimously. Jake Maxson, representing Souris River Brewing, appeared before the Council to appeal the decision made by the Planning Commission. He stated the zoning ordinance forbids rooftop signs but does not give an adequate reason why. He explained the metalwork sign which he has planned for the building would only enhance the artistic feel in the Renaissance Zone. The location is zoned M2, heavy industrial, and is surrounded by a frac sand plant and a grain elevator. He said the area would not be harmed aesthetically by allowing a rooftop sign. To establish reasonable hardship, Mr. Maxson stated the location only has 12-14 parking spaces and a pole sign would take up valuable space. Upon questioning by Alderman Schuler about other options for signage if the variance doesn’t pass, Mr. Maxson stated he hasn’t looked into it yet. Alderman Jantzer asked about the dimensions of the sign and which direction it will face, to which Mr. Maxson explained it would be one sided, facing south/southwest, about six feet tall and contain three letters each of which would be about two feet wide. Alderman Miller stated the City Council should grant this variance due to the hardship issue. He said a variance was awarded to businesses on the Broadway viaduct due to the topography of the area and he explained this is a similar situation. He also cited it is a public safety issue if vehicles need to slow down to find a location without adequate signage. The Assistant City Planner stated the application was denied by the Planning Commission because according to the ordinance, roof signs are not permitted in City Limits. She explained the ordinance was passed in 2013 and that nationally, roof signs are not allowed. In 2014 there were two applications submitted for variances for roof signs that the Planning Commission denied, both of which City Council overruled. She continued, it is a combination of public safety and aesthetic reasons as to why roof signs are not permitted. It is the intention of the Planning Commission to preserve the skyline of the City. She showed examples of the surrounding areas’ use of overhang signs and signs on the face of the buildings. She also stated, Souris River Brewing was granted an encroachment permit in 2014, but the business did not move forward with a sign. She concluded by saying the rooftop sign would be a detriment to the plans for the City. Downtown is intended to be pedestrian friendly and ideally the sign should be at eye level for foot traffic. Upon questioning by Mayor Barney on the legality of overturning the decision by Planning Commission, the Assistant City Attorney replied that it would be contrary to the City ordinance to do so and that no real hardship was demonstrated to support the variance. Alderman Hatlelid voiced his support for the variance and stated it is an M2 (Heavy Industrial) zone. Alderman Pankow stated, the ordinance was adopted in 2013 with support from the Council which was elected by the people. It was written in order to be enforced according to the plans for the City’s future and not to make exceptions based on past wrongdoings. He stated, the committee that reviewed this ordinance was comprised of a cross section of public citizens and sign companies. Motion seconded by Alderman Shomento and carried unanimously. The City Manager raised concerns about the traffic that will be created at the intersection in question. The City Engineer explained the plans created for this project require a median to cut off access to the frontage road which runs parallel to Broadway. By adding the median it manages the intersection to separate traffic and reduce conflict zones. He explained that without the median the turning queue backs up into the highway. He gave examples of other areas in town which have cut off the frontage road to reduce conflicts, including 31st and 37th Avenues.  December 7, 2015 Alderman Hatlelid explained that as a result of his amendment during the Committee meeting, the plan is to eliminate the median. Alderman Schuler expressed her support for the median as she has witnessed traffic during Ramstad pick up times back up for about one mile. Upon questioning by Alderman Miller, The City Engineer responded the cost of installing a median later would be much greater than to install it during the initial construction. The difference would be an additional $2,000 to tear out the concrete plus about 4%-15% increase in construction costs which have gone up each year. Alderman Frantsvog amended the motion to approve the plans and specifications for the 36th Ave NW extension to Broadway as it was designed by the Engineering Department to include the median. OTHER BUSINESS Alderman Frey stated he received a call regarding the speed limit behind Butler Machinery. A citizen is concerned that with increased traffic it is becoming more dangerous for travel. The City Engineer stated if the speed is 25 mph no signage is necessary. Mayor Barney responded that The City Engineer can look into what the posted speed is in that area and the Police can add a portable speed tracking sign.
