PERSONAL APPEARANCES William Eagan of 806 38th St SE, stated he submitted proposals to the Planning Department but has not heard back from them. The Mayor said he has received his emails and will set up a time to meet personally with him. Dan Meschke of 827 2nd Ave NW, came forward with concerns over the safety of children being picked up at Longfellow School. He stated, there is no parking allowed on the side of the street closest to the school forcing kids to run across a busy street. The Mayor said he would contact the school district the following day and work with the Police Chief to resolve the issue. Kristi Burgess of 921 13th Ave SE, came forward to request the City help to provide free testing for hepatitis C. She asked for support and stated, community members could have the virus and not be aware. The Mayor said he would contact First District Health Unit to find out what is available and will let the public know. Tina Lillemon of 9 Scramble St SE, came before the Council to request a pedestrian signal near the newly built John Hoeven Elementary. She explained, she had discussed it with the Traffic Engineer and he said there currently aren’t any funds in the budget to install a signal. The City Engineer stated, there are lots of kids in the area and it would be a valid improvement. He continued by saying, the City would need a funding source and gave an example of a similar situation which happened near Minot State. He said the cost was split 50/50 and equaled about $15,000-$20,000 share for the City. The Mayor requested the City Engineer provide the necessary information for the first reading of the budget. Jessica Ehli of 3416 Woodside Circle, came forward in support of a stop sign or flashing pedestrian signal. MAYOR’S REPORT The Mayor thanked the Park Board for sponsoring a First Responders Golf Outing at Souris River Golf Course. He stated, he will be attending a meeting with the governor the following day to discuss cost shares on flood protection. He then called upon the HR Director to give an update on the search for City Manager. Ms. Jundt explained, the City Manager search has continued for about 6 ½ weeks. The recruitment agency, Prothman, has sent out 1,200 mailers to potential applicants, have posted on several websites and are personally calling individuals. They have received eight applications, of which only two are qualified. They will conduct preliminary interviews and forward them to the City if they are recommended. She said the tentative date for final interviews was set for September 14th and 15th but that cannot be accomplished at this point. The Mayor then called upon the City Engineer to give an update on the roof of the parking structures. Mr. Meyer stated, after meeting with the developers, they understand the roof must meet the City’s building codes. He also said it would be in their best interest financially, to complete the roof and construct the retail space. Page | 7  September 6, 2016 CITY MANAGER REPORT The Acting City Manager, Cindy Hemphill, reminded the public of the upcoming Special City Council meetings regarding the budget. These meetings will take place on September 12th and 19th. The ad-hoc committee to discuss the changes in City Government will begin meeting on September 13 th at noon. She then gave updates on the different departments. She said the Fire Department recently did live fire training as part of an FAA mandate. There will also be firefighter test recruitment open house on October 4 th. She explained, the Auditorium lighting project will be delayed due to a supplier issue. The South Hill Complex will open bids for the field improvements in early 2017. The Library has events scheduled including an adult coloring club. The Hazard Mitigation Grant project should have the section near 16th St completed by September 20th. Construction downtown is progressing near Central Campus but there have not been any issues so far relating to student traffic. RESOLUTION NO. 5312 – INITIAL RESOLUTION AUTHORIZING ISSUANCE OF GENERAL OBLIGATION HIGHWAY BONDS – APPROVED Alderman Frantsvog moved the City Council adopt resolution no. 5312 authorizing the issuance of General Obligation Highway Bonds in a principal amount estimated not to exceed $12,670,000 to finance federal aid highway projects to be undertaken pursuant to North Dakota Century Code, Chapter 21-03, and particularly Section 21-03-07, subdivision 4, described as follows: Oak Park Bridge Replacement, 37th Avenue Southwest Reconstruction and 36th Avenue Northwest Road. Alderman Shomento moved the City Council approve the appeal for a variance to the City of Minot Zoning Ordinance Section 21-8 a) which states, an accessory building shall be subordinate to the existing primary building, on Goheens Addition, Block 6, Lot 5. Alderman Sipma stated, after speaking with Mr. Watts, he believes the situation was a miscommunication and can be rectified without causing damage to the existing cement slab. Page | 13  September 6, 2016 BURDICK EXPRESSWAY RECONSTRUCTION SELECTION OF PREFERRED ALTERNATIVES (4179) – APPROVED Alderman Schuler moved the City Council choose the following options for the Burdick Expressway Reconstruction: Alternate B: Build Project and Realign the Road at the Oxbow; Option 1: Replace signal at Burdick/9th St; Option 2b: Remove Traffic Signal and Install a Pedestrian Signal. Motion seconded by Alderman Shomento Josh Wolsky of 1340 S. Main St, came forward to discuss some concerns over the project. He does not believe there was proper consideration from the public due to a lack of public notice. He also acknowledged that there was a public forum but it took place at the same time as a City Council meeting therefore, no members could attend. He stated, he submitted comments to the Council from the organization, Friends of the Souris, but did not get any response. He brought up the issues that were discussed at the Public Works and Safety Committee meeting, including potential stormwater flow, uncertain excavation, and the necessity to purchase a lot owned by MSU. He concluded by saying, filling in this area of river is the opposite of the vision for greenspace and recreation. Kelly Burgardt, of 313 9th St SE, also spoke against the project. He stated, it will shift the turning lane of Burdick closer to his home. He said, when the surveying was done near his house, he was told it would not affect his property. The City Engineer stated the project is a cooperation between the City and the NDDOT. He explained, the City has a 10% cost share and their opinions will be considered heavily but the Department of Transportation will make the final call. He responded to each of the concerns by stating, the notification for the project was published in the official paper as was required. He said, staff has already met with MSU regarding the purchase of the lot in question and if necessary can be purchased at the appraised price. He also explained by saying, these improvements will correct issues relating to ADA compliance, narrow lanes and insufficient geometrics for the impending traffic increase. Upon concerns about stormwater drainage, he explained, staff knows how much water comes in and can calculate what is necessary to pump out. They are comfortable with the amount of drainage that will be provided and it will be monitored like any other area. He further explained, it will be a volume for volume replacement. The DOT has done preliminary geotechnical analysis and took soil borings to ensure the project is technically feasible. Like any other project, if issues arise later in the process, alternatives will be discussed. Jarrod Olson, came forward on behalf of the Park District. He expressed concern over the traffic signal at the intersection of 13th Street. The City Engineer stated, based on numerous traffic calculations, studies do not warrant a signal at that location but the DOT is open to the concept of a pedestrian flasher. Others spoke in opposition to the project for reasons regarding drainage and the desire to keep the river as is. Alderman Hedberg suggested the Council delay the decision until the following month when more research can be done. The City Engineer explained, they have done as much as they can up to this point. The engineers will need some direction on which alternatives to pursue further. Alderman Lehner gave his support for the options chosen and stated, there was some confusion at the Public Works meeting but as the project was explained during the discussion, he no longer has any concerns. Whereupon a vote was taken on the motion by Alderman Schuler, seconded by Alderman Shomento and carried by the following roll call vote: ayes: Berg, Frantsvog, Hedberg, Jantzer, Kossan, Lehner, Olson, Pankow, Podrygula, Schuler, Shomento; nays: Sipma, Straight MAYORAL COMMITTEE APPOINTMENT- NUISANCE COMPLAINTS- WEEDS AND DEBRIS – APPROVED Alderman Schuler moved the City Council request the Mayor appoint a committee to discuss a systematic organized mechanism to deal with the issue of weeds and debris on undeveloped property. Motion seconded by Alderman Podrygula. Page | 14  September 6, 2016 It was agreed by all that there is an issue with weeds, debris and nuisances around town but it was questioned if a committee is the best way to find a solution or if City staff should investigate the problem. Alderman Podrygula further explained the extent of the issue by stating, it is occurring in every part of town. There are locations with noxious weeds, piles of debris, and construction materials abandoned by developers. Enforcement mechanisms are beyond the capability of Public Works and there are authority and jurisdictional issues at play. The Public Works Director stated, staff has attempted to contact the developers and have made little headway. They were told a contractor was hired to maintain an area around Ballantyne Lake but so far nothing has been done. When asked what would be needed to accomplish a solution, Mr. Jonasson said, there is an ordinance but it does not address properties of this magnitude. The City does not have the equipment to mow or spray for weeds nor the manpower to complete it. Upon the suggestion to contract the work and assess the costs, the City Attorney stated, that can be done but the City would be responsible for payment up front and would not be guaranteed the owner will pay the bill. Several residents of the northwest area of town described the experiences they had with the weeds throughout the summer. Foxtails have affected homes, pets and the health of residents. Lauren Tiffany of 900 25 ½ Ave NW, stated, she contacted one of the developers who own one of the properties. She said they told her the land was given to the City in an easement. The City Engineer responded by saying, once the development is complete, the lake will be deeded to the City, but the developer has been told it needs to be cleaned up. The Mayor offered his opinion that after hearing discussion, recommends a committee be appointed. SPECIAL ASSESSMENT COMMISSION REPORT- PAVING DISTRICT 493 – SENT TO SPECIAL ASSESSMENT COMMISSION Alderman Olson moved the City Council approve the assessment of Paving District 493. Motion seconded by Alderman Lehner. Chris Strange, the Manager of the Minot Country Club came forward to appeal the assessment of the property. He said, the Country Club received a disproportionate amount of the assessment because it was based on square footage, opposed to frontage. He also stated, the golf course is a seasonal business and the street value assessed to them is not the primary route for traffic. He suggested the assessment include some other properties that were not part the district but will also benefit from the roads. Mark Hildahl, President of Golf Minot, Inc. stated, it is an unfair assessment for one street when other residential properties were only assessed $3,000-$5,000. Peter Hankla, the attorney for the Minot County Club, stated, the Country Club was added to the paving district because of the benefit from the road system specifically for truck traffic. He said however, because there is no signage and it is not the most direct route, deliveries do not use that road. He suggested the Council consider modifying the assessment formula. Denise Martin of 1620 35th Ave SE, said she also attended the Special Assessment Commission meeting and urged the Council to reconsider the assessment for her home. She cannot access her house from that street and does not get any benefit from its construction. The interim City Manager explained, according to the ND Century Code, Council cannot change the total value of the assessment nor can they remap the properties included. They would only be able to allocate the values differently among the other properties. Upon questioning as to whether or not the item can be tabled until a later date, Ms. Hemphill explained, the assessments need to be certified by November 1 st or else the City will have to carry the cost. Alderman Frantsvog commented, the Country Club was added to the paving district at the request of the other property owners. He added, the assessment can be reviewed and approved in time for the deadline. Ms. Hemphill stated, notification letters must be sent to all of the properties and staff will schedule another meeting. Alderman Sipma asked why the new townhomes were not included to which the City Engineer explained, the paving district was first approved in 2014 and at that time, the area had not been annexed into the City. Alderman Shomento moved the City Council send the report back to the Special Assessment Commission for further review.
