CITY MANAGER REPORT The City Manager listed upcoming meeting dates including the Nuisance Weeds and Sales Tax ad hoc committees, the Flood Control MI-1 Meeting on February 9th and the Strom Sewer District 122 Public Meeting February 13th. He also mentioned, City offices will be closed on February 20th for Presidents Day. He gave a brief update on the Flood Control Project by stating the Water Treatment Plant is nearly complete, with only minor touches for spring of 2017. Phases 1-3 will be bid in late summer and he explained the state funding has not yet been allocated. He said, depending on the outcome of litigation, if the City has to pay for the Biota Plant, we would need $40.6M in additional funds. If the Biota Plant is paid for with State and/or Federal funds, the City will need to provide $12M in additional funding for NAWS. He said, the two major projects which are funded by sales tax collections, NAWS and Flood Control, will require funding of between $362M and $390M to complete. He explained, the purpose of the Sales Tax ad hoc Committee is to decide if the first and second penny should be reallocated from their current distributions to keep the projects on track. He then described some updates for the National Disaster Resilience Program in which a governance structure was developed to organize the program and establish areas of responsibility. He said, he hopes to establish a new position, for Council Page | 6  February 6, 2017 approval, called an NDR Program Manager which will be a full time position for the duration of the project. It would be financed out of the $3.7M of federal funding allocated for administration costs and therefore, would not take away from any projects and would not cost anything to the City. He also described City program staff, including our Public Information Officer and Federal Compliance Officer to handle public outreach and information and program compliance. He also said, Cindy Hemphill, former Finance Director, has agreed to work in a part-time interim capacity, up to six months to help train the NDR Program Manager and maintain momentum for the program. The position will be financed about 90% by NDR administration funds and she could potentially help transition the new Finance Director which would be paid for out of general fund using cost savings during the interim period providing a no net increase to the budget. Mr. Barry provided an update on the automated trash collection by saying, it could potentially roll out earlier than expected. A mailer was sent out to the community explaining some frequently asked questions and requesting residents to select which size container they prefer. He also said the City will offer a valet service for residents with disabilities. He said the goal of the program is to be cleaner, safer, and lower costs. He explained the Build Minot Campaign which uses building blocks to get ideas from the community as to what they would like to see Minot look like in the future. He plans to use the information as well as some visioning exercises to develop a strategic plan for the City. He emphasized the need to develop a communication strategy and said he is working with the Public Information Officer to provide frequent community education. He then said, City staff is attentive to the legislative session including monitoring bills, writing statements, analyzing issues, participating in conference calls, forums and testifying and legislative committees. He concluded by announcing the retirement of Cindy Hemphill, and said Sue Greenheck and Penny Johnson will be co- managing the Finance Department until a replacement is hired. Rick Hair, the Street Superintendent retired on February 1st and Kevin Braaten has been promoted to the position. Hospitals require a Conditional Use Permit to locate and operate in C2 zones. 4. Since efficiency is of utmost importance to providing the best possible hospital services, the building can operate more efficiently as it grows vertically by adding stories and maintaining a compact footprint, as opposed to sprawling out across a large footprint adding more distance between functional areas. OPTIONAL RELOCATION POLICY #2 – APPROVED Alderman Frantsvog moved the City Council approve the City of Minot Optional Relocation Policy #2, and further authorize the City Manager to sign the policy. Motion seconded by Alderman Hedberg. Milton Bowan came forward to ask the Council about the policy. He said, after the flood, the neighborhood was told it could rebuild. At that time, construction prices were much higher but the current assessment value does not reflect that. He said, he used his personal savings and 401k in order to pay to rebuild. Chris Owen, Federal Compliance Officer, explained, the policy is structured to use the fair market value at the time as the assessment, which does not account for the cost of materials because it couldn’t be applied uniformly. The changes in this policy address the issues when an owner becomes upside down in their mortgage as a result of the buyout. For example, if a property is valued at $150,000 but, because of modifications, the mortgage on the property is $200,000 an adjustment would be made to make sure the owner does not have to pay the difference. He added, the homeowners are also eligible for relocation benefits. He added, cases are analyzed individually. Upon questioning by Mr. Milton, Mr. Owen stated, this policy does not account for use of personal savings as there needs to be something attached to the house to be paid off. Patty Bender, who also used personal savings to rebuild her home said, they applied for assistance but it was not granted. Alderman Olson asked if the area in question is going to be bought out or if it is still just one possible option. Mr. Owen responded by saying, it is a buyout area, meaning it is needed for the project. The homeowners can decline the offer now but in the future if an agreement has not been made, eminent domain could be a possibility. The Mayor suggested Mr. Bowan and Ms. Bender make an appointment to discuss the details of their properties with Mr. Owen. Motion seconded by Alderman Pankow. Alderman Schuler stated, despite the recommendation from the Committee, she would like to see the project move forward with construction. She said, she understands the attempt to save money but it is a difficult, high traffic intersection. The neighborhood has held several meetings about the issue and are under the impression it is being constructed this year. She added, the project has already been bonded for and there is no need to wait another year. She expressed concerns, if the project is delayed now, it may continue to be pushed off down the road and never get done. Alderman Pankow mentioned how dangerous the line of sight issues can be. The City Engineer stated, due to budget restrictions, staff was asked to identify projects to delay. Since the intersection improvements are not an emergency, it was selected to be removed. He said, in his opinion, the project can go either way but so far they have not come up with other projects to postpone. The Mayor reminded the Council, there will be a lot of difficult decisions to make over the next six months and they will need to start thinking about prioritizing projects. Alderman Straight suggested holding the item for one month to determine if other projects might be more pressing. He said, the intersection at least has a traffic light and he appreciates that Council needs to start prioritizing. When asked what other projects the City Engineer has planned, Mr. Meyer replied by saying, the annual street maintenance is already budgeted, the City is obligated to continue the downtown reconstruction due to funding and a Storm Sewer is in the works but does not affect bonding since it uses special assessments. Alderman Lehner asked about the Burdick Expressway project, to which Mr. Meyer said, it is on track and they are working with the DOT.
