PERSONAL APPEARANCES None MAYOR’S REPORT The Mayor mentioned the Legislative forums which have been ongoing through the Chamber of Commerce at the State Fair Center every two weeks. There is one Saturday, March 18th at 9:00 am and he encouraged the Council and audience to attend. The Mayor listed his recent meetings including a meeting with the American Petroleum Institute, Northrup Grummen on improvements at the Air Force Base, a welcome at the North Dakota Fire Fighter School with all the State Chiefs, a dinner with General Fred Stoss, Director of Operations for Global Strike, he also read to four year olds at Head Start, and welcomed the Special Olympics to Minot at MSU Dome. He participated in a meeting with Legislators in Bismarck and discussed issues that affect Minot on March 2nd. This upcoming week he and City Staff will go to Bismarck to talk about water issues. He also had a meeting with the City Attorney about an upcoming deposition regarding the Hepatitis C issue that was discussed last fall. The Mayor recognized Evidence Technician, Rebecca Heringer, as being the Outstanding Police Employee of 2016. He thanked her for her dedication and presented her with a City coin. Next month the Outstanding Police Officer will be recognized if he is available to attend. CITY MANAGER’S REPORT The City Manager began by listing important upcoming dates including the FEMA Spring Flood Awareness/Preparedness meeting on March 14th, Senate Committee Hearing for House Bill 1020 on March 16th, and the Chamber Legislative Forum on March 18th. He said, the Broadway Bridge construction begins on March 20th, the North Dakota League of Cities will hold a March Madness conference March 28th and 29th and the standing committees will meet at their regularly scheduled dates. Mr. Barry then announced David Lakefield as the new Finance Director and shared a memorandum explaining the process leading up to his appointment. He continued to discuss the City’s finances by introducing a budget workshop. He said the goals are to encourage more data driven decision making, long term planning and create an adaptive management style. He listed the details of the workshop and requested Council members send information to him regarding what questions they have and what information they would like staff to present. He said, he would like to make a smooth transition with the budget, especially considering the change in governance that will take place in June. He commented that Council packets are due April 10th and so far 15 have been picked up but none have been submitted. He stated, staff remains attentive to the legislative session including weekly conference calls, testifying at Legislative Committees and attending forums. He emphasized the interest in HB1020 which could allocate state funding for the first four phases of flood control. He said, the Sales Tax ad hoc committee has suspended further meetings until more information is available. He then gave the flood forecast and explained the favorable conditions currently in place. He said FEMA is updating the hazard data and is remapping the Souris Valley flood risk which means more citizens will be required to get flood insurance on their homes. Flood insurance premiums will increase over the next few years so Minot will continue to work towards flood control which will improve the community rating system and will provide a discount. He encouraged homeowners to keep in mind, they can lock in 2017 premiums and they would be transferrable upon the sale of the home. The Public Information Officer provided documents to the Council to improve citizen communication. He included information on frequently asked questions and phases of construction. Mr. Barry explained the progress to the National Disaster Resilience Program. He stated, applications are being accepted and a few interviews have been scheduled for a Program Manager. The Affordable Housing Study has been released and was also provided to City Council. All property owners have been notified for the Buyouts and Acquisitions. Staff has been conducting an analysis of downtown properties and has a meeting with Trinity about the potential of using one of their sites for the Downtown Gathering Space. He notified those in attendance about the upcoming construction projects including the Broadway Bridge which begins March 20th, the 83 Bypass which will be widened to include turning lanes and Burdick Expressway which is scheduled to open bids in April. He said, the injunction was lifted on the Biota transfer facility which is a major victory for the NAWS projects and allows design work to begin. He added, the NAWS project is still in litigation. Lastly, he said, Phase 3 of the Downtown Infrastructure Project will conduct a preconstruction meeting on March 30th and will include two blocks from the previous phase and eleven new blocks in 2017. The City Manager discussed the current leadership and described an exercise which developed the goals and objectives for each department. He said those goals will be refined for review and will produce performance metrics to hold department leaders accountable. He also talked about his listening tour where he spoke with 50 groups and individuals throughout different areas of the City and came up with some issues to focus on improving. NDR FUNDS APPROVAL FOR PARK SOUTH PROJECT (NDR007) – APPROVED Alderman Frantsvog moved the City Council approve the request to commit $1.85M of National Disaster Resilience Grant funds as the City share of the Park South affordable housing project and further authorize the Mayor to sign the development agreement. Motion seconded by Alderman Olson. Bruce Walker, 1415 10th ST SW, representing the Essential Living Group, said, they are requesting NDR funds to complete the rehabilitation project for affordable housing. Park South fits the definition and goals of the resilience program. There is a desire to upgrade neighborhoods in the community and this project will rehabilitate and completely renovate an existing building. In the renovations they are planning to install an elevator and four handicap apartments. There will be a total of 40 apartments when complete and 30 of those apartments will be rent restricted for the next 30 years. The other 10 will be market rate apartments. The project will improve the exterior of building, install energy efficient windows throughout, replace a coal fired heating system with an energy efficient system and renovate and improve all apartments and interior spaces. Of the 7 ½ acres only 2 ½ will be used for this project leaving the rest for possible future development when the housing market demonstrates the need. Mr. Walker noted, if they do not receive approval from Council, just over $2M dollars from State funding will not be available for Minot. Upon further questioning by the Council, Mr. Walker provided more information. He said the other five acres would be set aside for affordable housing in the future, based on HUD guidelines. Mr. Walker believes there is still a need for affordable housing. The current owner of the property is Park South Holdings but it will belong to Essential Living, which is a nonprofit. He said, the only utilities expected of residents is electricity. Alderman Frantsvog asked if the property would be exempt from property tax, therefore removing income to the City, to which the City Assessor explained the tax process for nonprofits. He said the apartments will be taxed differently from normal tax rolls, it will go on a pilot tax that will pay 5% of rents after deducting utilities. When a nonprofit receives a certified letter under section 43, the nonprofit apartment will go from the tax roll to then make a payment in lieu of tax which generally amounts to 50-75% of what the taxes would have been. Mr. Walker explained, after a rough survey of the current tenants, most will qualify for affordable housing and can stay in the building. The tenants who will not qualify for affordable housing have the option to stay in one of the ten market rate apartments. The renovation will be done in phases so the tenants only need to relocate once and they will be assisted in the move. Cindy Hemphill addressed the City Council to discuss any lack of communication on the project. It was intended to bring the project to City Council in April but because of the need for state funding, the plans were pushed up. This project was included in the National Disaster Resilience application last year, after over 60 public input meeting were held. She said she is aware the vacancy rate is higher than desirable at this time and that is why another housing study was conducted. She recognized, there is still a need for low to moderate income housing, which is why a project including renovations is preferable to a project constructing a new building. She said the grant requires the funds be spent by September 30, 2022 and explained the process for moving funds to other projects. She stated, if they request to move over $1M to another project, the entire application would be rerated by HUD and the City could lose the funds. Page | 14  March 13, 2017 Alderman Pankow asked whether funds could be used to address the voucher system, to which Ms. Hemphill replied by saying, the voucher system is not a sustainable, resilient program. The purpose of the grant is to promote resiliency and that is what the Park South project does. Doug Pfau, President for the Magic City Apartment Association, came before the Council in opposition to the proposal. He discussed concerns the project would adversely affect current property owners. He also said the minutes and decisions should be available to the public in an abbreviated form rather than a 108 page analysis. He stated, the City should receive the maximum value for each dollar spent. Upon questioning from Alderman Hedberg, the City Manager explained how this project will meet the City’s goals. Mr. Barry stated, the NDR application allocated $21M would target multifamily housing in 183 units, which equates to $114,000 per unit. This project impacts multifamily housing at a rate of $61,000 per unit, which is significantly lower than the estimate. It encompasses 16% of the total target for only 9% of the funds. He emphasized, the grant is not just about spending dollars but is based on improving the resilience of the City. The Council requested a process be utilized for future proposals to make sure everyone can be involved and informed of future projects. The City Manager agreed to provide a process at the April City Council meeting.
