That the City Council approve the request by Bakken Hospitality, LLP for a Hotel- Motel Retail Liquor and Beer alcoholic beverage sales license, dba Souris Valley Suites (800 37th Avenue SW), effective July 1, 2012. ********** The above motion by Alderman Withus, seconded by Alderman Olson, and carried unanimously. 2. Bethany Lutheran Church for a local permit to conduct raffles on May 4, 2012 at Minot State University - Alshire Theater (500 University Ave). c. North Dakota Society of CPA Foundation for a local permit to conduct raffles on September 25, 2012 at Grand International Inn – Convention Center (1505 N Broadway). d. Capri Bar for a special event permit on May 18, 2012 at the Capri Bar parking lot (2030 Burdick Expy E). ********** The above motion by Alderman Withus, seconded by Alderman Olson, and carried unanimously. General Information Chairman Krabseth informed the Committee a hearing would be held for alleged violations by Ten, Inc. dba Dakota Lounge in serving alcohol to minors. He stated Alderman Olson would abstain from participating in the hearing due to a conflict of interest. The City Attorney called four witnesses to provide testimony on the alleged violations, as follows: Leah Dickman, Officers Titus Clouse and Jacob Lockrem, and Detective Matt McLeod. Glen Kluck and Rachel Gaddie appeared before the Committee on behalf of Dakota Lounge. They presented their argument that the three prior violations were based on hearsay and could not be proved that the individuals were in the bar. Following the witness testimony, both the City Attorney and Dakota Lounge representatives provided a summary of their arguments. Following discussion, Alderman Connole moved that the Committee find the violations did occur and to suspend the Ten, Inc. dba Dakota Lounge alcoholic beverage sales license for 6 days, with four days suspended and 2 days to be served on June 19 and 20, 2012. Motion seconded by Alderman Withus and carried unanimously.
