To the Honorable Mayor and All Aldermen: Following are the recommendations of the Public Works and Safety Committee meeting called to order at 4:15 p.m. on November 28, 2012: 1. That the City Council place and pass an ordinance amending the list of City Council created traffic restrictions provided for in Section 20-2 of the City of Minot Code of Ordinances; No Parking Zones, by removing the parking restrictions on the south side of 2nd Avenue SW from 10th Street SW and Maple Street, on first reading. ********** The above motion by Alderman Hatlelid, seconded by Alderman Withus, and carried unanimously. 2. That the City Council place and pass an ordinance amending the Traffic Ordinance to remove the intersection of 8th Street NW and 30th Avenue NW from the list of yield controlled intersections and add the intersection of 8th Street NW and 30th Avenue NW to the list of stop controlled intersections, on first reading. ********** The above motion by Alderman Hatlelid, seconded by Alderman Withus, and carried unanimously. 3. That the City Council place and pass an ordinance amending the Traffic Ordinance to add the intersection of eastbound 19th Avenue NW and Sunset Boulevard to the list of yield controlled intersections, on first reading. ********** The above motion by Alderman Hatlelid, seconded by Alderman Withus, and carried unanimously. 4. That the City Council authorize the Fire Chief to negotiate a scope of service and rate with Kadrmas, Lee, and Jackson/JLP for the architectural and engineering services for the new Fire Training Grounds; and further, authorize the Fire Chief to negotiate the same services with EAPC should a suitable agreement not be reached with Kadrmas, Lee, and Jackson/JLP. ********** The above motion by Alderman Hatlelid, seconded by Alderman Withus, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE November 28, 2012 Page 2 5. That the City Council authorize the Public Works Director to call for bids for the sale of a surplus handicap accessible van. ********** The above motion by Alderman Hatlelid, seconded by Alderman Withus, and carried unanimously. 6. That the City Council waive the formal bid process for the purchase of a used forklift and authorize the Public Works Director to obtain written quotes for the equipment and from the quotes, purchase the equipment that best suites the needs of the department. ********** The above motion by Alderman Hatlelid, seconded by Alderman Withus, and carried unanimously. 7. That the City Council place and pass the following ordinances on second reading: a. Ordinance No. 4557 – Rezoning Lakeview 4th Addition, Lots 1 & 2 from R-1 (Single- Family Residence District) to R3-C (Townhouse Residence District). b. Ordinance No. 4631 – Amending 2012 budget in the amount of $2,620,050 for FEMA, oil and gas, court bond, and inspection proceeds. The above motion by Alderman Hatlelid, seconded by Alderman Withus, and carried unanimously. 8. That the City Council approve a request from Charles Avers to relocate a 2013 27’ x 40’ manufactured home from Iseman Homes to 107 20th Street NW (Garden Valley Addition, Block 6, Lot 5 and north ½ Lot 6); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. Home must be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c. All work associated with the request to be complete within four months. ********** The above motion by Alderman Hatlelid and seconded by Alderman Lehner. Alderman Moen stated she had received several calls from concerned neighbors protesting the request. Tom Ripplinger, representing Iseman Homes, appeared before the Committee to answer questions regarding the structure. He stated the structure would be attached with a new anchor system to prevent shifting and an insulated skirting would be installed to look like a foundation. He commented the new structure would be assessed at a much higher value of the flooded home currently on the site. PUBLIC WORKS AND SAFETY COMMITTEE November 28, 2012 Page 3 Marlen Bratvold, 1620 20th Street NW, appeared before the Committee to present a protest petition with neighborhood signatures. He stated his main concern is the economic impact on the homes in the neighborhood. David Shelkey, 5 20th Street NW, appeared before the Committee to express concern with the value of the neighborhood homes if a manufactured home was installed. The City Assessor stated there is no data showing a decrease in home values with a manufactured home in the neighborhood. Alderman Connole expressed concern over manufactured homes being placed in neighborhoods with lack of flood protection. Daryl Somerville, 424 Homestead Road, and Becky Nelson, 100 20th Street NW, expressed concern over the placement of manufactured homes in established neighborhoods. Following discussion, a vote was taken on the above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried by the following roll call vote: ayes: Hatlelid, Knudsvig, Krabseth, Lehner, M. Miller, Withus. nays: Connole. 9. That the City Council approve a request from Delmore Lafontaine to relocate a 2013 27’ x 40’ manufactured home from Iseman Homes to 1520 3rd Avenue SE (Lenox Park Addition, Lot 96); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. Home must be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c. That the City Council approve a request from Del Loughead to relocate a 2013 40’ x 70’ manufactured home from Homes America to 5117 14th Street SE (Joyce’s Subdvision, Lot 18); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. That the City Council approve a request from Miranda VanWinkle to relocate a 2013 28’ x 52’ manufactured home from Iseman Homes to 1109 43rd Street SE (Section 28-155-82, NW 1/4NW1/4 Outlot 13); and further, approve a variance along the north and south property lines to reduce the side yard setbacks from 6.5’ to 4’; subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. Home must be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c. That the City Council approve a request from Doug and Donna White to relocate a 2012 32’ x 80’ manufactured home from Lifeway Homes to 4925 33rd Avenue SE (East Side Estates Addition, Block 4, Lot 1); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. General Information Alderman Krabseth informed the Committee the issue of development requirements for Home Acres 2nd Addition, Lots 13 and 14 (Dennis Smetana) would be on hold until after the beginning of 2013 per the applicant. The City Engineer stated the drainage issues should be addressed before spring.
