To the Honorable Mayor and All Aldermen: Following are the recommendations of the Public Works and Safety Committee meeting called to order at 4:15 p.m. on January 29, 2014: 1. The City Council approve the request to allow the Minot Fire Department to donate the old training tower to the Burlington Fire Department subject to the following conditions: move is coordinated to not interfere in any way with the airport parking lot project, and moving contractor is licensed and bonded and the City of Minot assumes no liability during this project. ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. 2. The City Council reject the bids received in November 2013 for the Sander Bodies for the Street Department; and further authorize the Public Works Director to rewrite the specifications and rebid the equipment. ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. 3. The City Council approve KLJ to perform the engineering services for the 5th St NE sewer extension project (3879); and further authorize the Mayor to sign the contract once the fee is negotiated. ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. 4. The City Council approve the equipment rates and tower rental rates on file at the Public Works building, for the use of City equipment and personnel, for the period of March 1, 2014 through February 28, 2015. ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE January 29, 2014 Page 2 5. The City Council approve the Cost Participation Maintenance Agreement for the 37th Ave Reconstruction project (3647), approve the use of General Obligation and Revenue bonds to pay the City’s Cost share; and further authorize the Mayor and City Clerk to appropriately finalize the agreement. ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. 6. The City Council approve the plans and specifications and call for bids for the Broadway Viaduct Deck Replacement project (3767), approve the Cost Participation Maintenance agreements, approve the use of General Obligation bonds to pay for the City’s cost share; and further authorize the Mayor and City Clerk to finalize the agreement. ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. 7. The City Council approve the plans and specifications and call for bids for the 13th St SE Shared-Use path project, approve the use of General Obligation bonds to pay for the City’s cost share; and further authorize the Mayor and City Clerk to finalize the agreements. ********** 8. The City Council authorize the Police Department to accept the grant amendment for the 2013-2014 North Dakota Department of Transportation Traffic Safety Enforcement Grant for overtime, authorize the Mayor to sign the contract on the City’s behalf; and further place and pass a budget amendment ordinance, on first reading, to increase the Patrol Operations budget for a traffic safety grant for distracted driving. ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. 9. The City Council place and pass the proposed Ordinance, on first reading, amending Chapter 3 (Advertising and Signs), Article I (In General), Section 3-1 of the Code of Ordinances relating to advertising and signs. (Distribution of Handbills and Posters Prohibited) ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. 10. The City Council place and pass the proposed Ordinance, on first reading, amending Chapter 5 (Alcoholic Beverages), Article I (In General), Section 5-3 of the Code of Ordinances relating to alcoholic beverages (Open Container on a Street and Public Consumption Limited). ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE January 29, 2014 Page 3 11. The City Council place and pass the proposed Ordinance, on first reading, amending Chapter 23 (Offenses – Miscellaneous), Article VI (Noises), Section 23-107 of the Code of Ordinances relating to offenses-miscellaneous. (Unnecessary Noises) ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. 12. The City Council place and pass the proposed Ordinance, on first reading, amending Chapter 23 (Offenses – Miscellaneous), Article II (Traditional Offenses), Section 23-15, Subsection (b) of the Code of Ordinances relating to offenses-miscellaneous. ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. 13. The City Council place and pass the following ordinances on second reading: a. Ordinance No. 4793 – Rezoning Summit Park 2nd Addition, Lot 1 from Single Family Residential District (R1) & General Commercial District (C-2) to General Commercial District (C-2). b. Ordinance No. 4795 – Amending the 2014 Annual Budget to Increase the Police Patrol and Equipment Capital Purchase Budget Revenue and Expenditures for a FY2013 State Homeland Security Program Grants for Bomb Squad Operation and Capital Equipment. c. Ordinance No. 4796 – Amending the 2014 Annual Budget to Increase the Fire Control and Fire Equipment Capital Purchase Budget Revenue and Expenditures for a FY2013 State Homeland Security Program Grants for Operation and Capital Equipment. d. Ordinance No. 4798 – Amending Chapter 5 (Alcoholic Beverages), Article I (In General), Section 5-1 of the Code of Ordinances Relating to Alcoholic Beverages – Supper Club License ********** The above motion by Alderman Withus, seconded by Alderman Hatlelid, and carried unanimously. 12. The City Council approve the request from Swanston Equipment to delay the requirement to build 39th St. and related infrastructure until January 29, 2015, to allow for contract bids for the project, with completed construction in 2015; and allow the building permit for the new office/shop complex to be issued. ********** Alderman Hatlelid moved to deny the request by Swanston Equipment to delay or remove the requirement to build 39th St and related infrastructure and allow the building permit to be issued with the denial of the delay. Motion seconded by Alderman Lehner. The City Engineer indicated staff had met with Swanston Equipment several weeks ago to inform them of the need to complete surrounding infrastructure based on current policy. He stated access to the facility is currently off of the Burdick Expressway Frontage Road, a delay to complete the required street and PUBLIC WORKS AND SAFETY COMMITTEE January 29, 2014 Page 4 infrastructure construction would eliminate any approved access to the property. Chris Shea representative of Swanston Equipment appeared before the Committee to explain the request for the delay. He stated current construction is based on a bid already received without the completion of 39th St and related infrastructure because Swanston was not aware this would need to be developed. Swanston Equipment is not opposed to the completion requirements; they are just requesting a delay to obtain bids for this portion of the construction. He also stated that an approved access from 39th St would be included in the construction with elimination of the approach from the Frontage Road. Alderman Hatlelid withdrew his motion and Aldeman Lehner withdrew his second. Whereupon, Alderman Hatlelid amended his motion to approve the request from Swanston Equipment to delay the requirement to build 39th St. and related infrastructure until January 29, 2015, to allow for contract bids for the project, with completed construction in 2015; and allow the building permit for the new office/shop complex to be issued. Seconded by Alderman Lehner and carried unanimously.
