To the Honorable Mayor and All Aldermen: Following are the recommendations of the Public Works and Safety Committee meeting called to order at 4:15 p.m. on February 26, 2014: 1. The City Council approve the plans and specifications for a portion of the 55th St NE Trunk Sanitary Force Main Sewer project (3490.3); and further authorize a call for bids. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 2. The City Council award the bid to West River Striping in the amount of $103,919 for the 2014 Pavement Markings project (3886). ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 3. The City Council approve the request from Candi and Jason Ziegler located at 109 23rd St NW, for a special use permit to allow 1 more dog than the four dog and/or cat ordinance limit ( 5 dogs total) ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 4. The City Council award the bid to Sanitation Products for the purchase of a truck and garbage packer for the Sanitation Department in the amount of $141,500; and further authorize the Public Works Department to complete the purchase. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE February 26, 2014 Page 2 5. The City Council award the bid to the lowest bid meeting specifications, Flexible Pipe Company, for the purchase of a truck mounted hydro-vac for the Water/Sewer Department in the amount of $299,500; and further authorize the Public Works Director to complete the purchase. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 6. The City Council award the bid to Sanitation Products for the purchase of the truck and roll-off with the auto-tarper in the amount of $127,974; and further authorize the Public Works Director to compete the purchase. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 7. The City Council place and pass the proposed Ordinance, on first reading, amending Sections 18- 166 (a) and 18-116 (b) of the Pawnbrokers, Second Hand Dealers, Scrap Dealers and Dealers in Precious Metals and Precious Gems ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 8. The City Council place and pass the proposed Ordinance, on first reading, amending Section 20-6 (Motor Vehicles and Traffic; Substantive Offenses; Moving Violations; Offenses Defined). ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 9. The City Council award the bid to Blue Stone Construction in the amount of $1,542,791 for the construction improvements to Hammond Park; and further authorize the Mayor to sign the contract on the City’s behalf. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 10. The City Council award the bid to E1/Fire Safety with the 75% prepay of $953,964.41 to be the lowest and best bid for the 95’ Mid Mount Aerial Platform Vehicle (FSARIL); and further authorize the Mayor to sign any documents on the City’s behalf. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE February 26, 2014 Page 3 11. The City Council award the bid to Westlie Motor Company for the purchase of the 2014 Police Patrol vehicles in the amount of $210,218; and further authorize the Police Chief to complete the purchase. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 12. The City Council approve the request to raise parking violation fines downtown to $20.00, place and pass a proposed ordinance amendment to the current Ordinance, on first reading. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 13. The City Council approve the request to apply for, and if awarded accept, a grant from the Minot Area Community Foundation in the amount of $5,664 for the purchase of a ballistic vest for Police Service Dog, two (2) first aid/ trauma kits for K-9s and one (1) Roca training bite suit. In addition, the grant would also cover travel expenses to Winnipeg, Manitoba to have the vest properly fitted. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 14. The City Council authorize the Public Works Director to apply to the NDDOT for a Section 5311 State Aid for Public Transit grant; adopt a resolution to be included in the application; authorize the Mayor to sign any documents on the City’s behalf; and further authorize the Public Works Director to accept any grant funds awarded. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 15. The City Council approve the City of Minot enter into an encroachment agreement with the ND State Fair and the NDDOT and allow Indigo Signs to alter the face of the sign. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 16. The City Council approve the encroachment request by Carissa Opperude for the installation of two awning/signs on the north side of the building face on the property located at 2 South Main St or at the southwest corner of the intersection of Main and Central; and further authorize the City Attorney to prepare the encroachment permit subject to the following: The permit contains the usual language protecting the City form any liability that may result from the encroachment, the applicant pays a processing fee of $100. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE February 26, 2014 Page 4 17. Ordinance No. 4803 - Amending 2014 Annual Budget – Increase Fire Control Revenue and Expenditures – FY2013 State Homeland Security – Travel and Overtime Fire Department c. Ordinance No. 4804 - Amending 2014 Annual Budget – Increase Fire Control Revenue and Expenditures – FY2013 State Homeland Security – Training, Travel and Overtime - Fire Department d. Ordinance No. 4805 - Amending 2014 Annual Budget – Increase Parking Authority Expenses For Van Purchase e. Ordinance No. 4806 - Amending 2014 Annual Budget – Increase Department Budgets for Funds Spent Using Corresponding Revenues f. Ordinance No. 4807 - Amending 2013 Annual Budget – Street Department Capital Purchases - Operations Supply Budget g. Ordinance No. 4813 - Amending the 2013 Annual to increase expenditures for Street Improvement Fund for an upgrade a current railroad signal, the Southwest Railroad Quiet Zone, and the installation of sidewalks for Safe Routes to School and to move budgeted money from Police Patrols Travel and Education to Capital Equipment Purchase Account for the purchase of the K-9 Drug Dog, Piko. h. Ordinance No. 4778 – Rezoning 55th Crossing 6th Addition, Block 2, Lot 2 i. Ordinance No. 4779 – Rezoning 55th Crossing 6th Addition, Block 1, Lots 2A-15B j. Ordinance No. 4780 – Rezoning 55th Crossing 6th Addition, Block 1, Lots 16-18 k. Ordinance No. 4781 – Rezoning 55th Crossing 6th Addition, Block 1, Lot 1; Block 2, Lot 1 ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid, and carried unanimously. 18. The City Council place and pass the proposed Ordinance, on first reading, prohibiting minors from purchasing or possessing electronic cigarettes. ********** The above motion by Alderman Hatlelid, seconded by Alderman Withus. Kelly Schmidt of STAMP Coalition appeared before the Committee to express her concern on the fact that some of the electronic cigarettes being sold still contain nicotine and carcinogens. She continued by stating she would like to see an Ordinance which would require all retailers, regardless if they are licensed for tobacco PUBLIC WORKS AND SAFETY COMMITTEE February 26, 2014 Page 5 sale or not, to place all E-Cigarettes behind the counter. The acting City Attorney indicated the ordinance change could be included into the proposed ordinance on second reading. Whereupon a vote was taken on the above motion by Alderman Hatlelid, seconded by Alderman Withus and carried unanimously. At 4:30pm, Alderman Krabseth joined the meeting. 19. The City Council authorize the issuance of a Request for Qualifications for architectural and engineering services for a Southeast Fire Station and commit to funding the Southeast Fire Station when complete in 2015. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner. The Fire Chief appeared before the Committee to ask for authorization to issue a request for qualifications for the Southeast Fire Station project. He continued by saying the placement of this fire station would give access to essential locations in Minot via several major roadways. The Fire Chief concluded by stating most Council members have shown favor of this project moving forward, but Council must also understand and authorize the hiring of 12 additional firefighters which will add to the 2015 budget. The City Finance Director commented that any CDBG funding for this project would need to be refunded if the fire station were not fully staffed and operational at the time of completion. Whereupon a vote was taken on the above motion by Alderman Hatlelid, seconded by Alderman Lehner and carried unanimously. General Information Alderman Hetlelid motioned, Alderman M. Miller seconded, to hold the request to waive requirements for the fire access road and water supply at the Minot Country Club has been placed on hold for 30 days and will be addressed at the March Committee/April Council meeting. The request by William and Carlita Robinson to allow a Pit Bull at their residence within City limits is a non- actionable item due to current City Ordinance. The Assistant City Attorney stated the current City Ordinance does not allow Council to give special use permits for restricted animals, and the only way to allow this would have been to amend the current Ordinance.
