The City Council approve the amendment to the Vehicle Maintenance Budgets to include the Minot Commission on Aging and Souris Basin Transportation fuel and maintenance charges; and further place and pass the proposed ordinance, on first reading, amending the 2014 Annual Budget to increase the vehicle maintenance expenditures and revenues in the General fund for the Minot Commission on Aging & Souris Basin Transportation fuel and maintenance. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 2. The City Council ratify the application and authorize acceptance of grant in the amount of $40,000 for a 2014 STOP Violence Against Women Grant to cover the officer’s salary and benefits; and further authorize the Mayor to sign the necessary documentation on the City’s behalf. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 3. The City Council reject the bid, and rebid the 1st St SE street improvements project in the near future. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 4. The City Council award the bid to Excavating Inc in the amount of $624,466 for the Cook’s Court site improvements; and further authorize the Mayor to sign the contract on the City’s behalf. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 5. The City Council approve the connection for Magic City Implement into the Apple Grove Sewer System, providing they pay the 100% surcharge as required by other entities outside of City Limits and they sign a no protest of annexation. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE July 30, 2014 Page 2 6. The City Council place and pass the following ordinances on second reading: a. Ordinance No. 4867 - Amending 2014 Annual Budget – Increase Police Administration Expenditures and Revenues – Copy Machine Maintenance Agreement – Decrease Capital Purchases Equipment Revenues and Expenditures ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 7. The City Council approve a formal notice be sent to the property owners to request they install/repair sidewalks adjacent to their properties with the exception of Myron and Orlys Nilsen, Timothy and Debra Helstedt, and Mark Clemens. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 8. The City Council require Mr. Clemens to install sidewalks at his expense with required improvements for ADA compliance paid by the City. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid. Mark Clemens of 805 2nd Ave SE appeared before the Committee to state he had to remove his sidewalk after the flood to replace his sewer line. He said he has no problem with replacing the sidewalk but he has been told he needs to replace the curb with improvements for handicap accessibility required. He noted this is an extra cost he cannot afford. The Public Works Director stated the improvements to bring to ADA standards should be at the City’s expense. He stated Mr. Clemens’ contractor will break those costs out and bill to the City, and the costs will be paid for under the curb and gutter repair funds. Whereupon, a vote was taken on the above motion by Alderman Lehner, seconded by Alderman Hatlelid and was carried by the following roll call vote: ayes: Berg, Connole, Hatlelid, Jantzer, Lehner, Schuler. nays: none 9. The City Council require Timothy & Debra Helstedt and Myron & Orlys Nilsen to put in sidewalks as instructed by the notice received from the City. ********** The above motion by Alderman Lehner, seconded by Alderman Hatlelid. Timothy Helstedt of 905 27th St NW appeared before the Committee to state he received a letter to install the sidewalks in 2013. He said his contractor met with a representative from the City and was told the sidewalks were not needed, and having been told that, he replaced his full yard. He continued by saying he was not aware the sidewalks were now required in his subdivision. He stated he is concerned with now having to pay the extra cost of putting in sidewalks after the yard is already completed. The City Engineer stated Mr. Helstedt told him the contractor spoke with a City representative, who was told that sidewalks were not needed. He said he has no way of knowing who the City representative he spoke to was, but the information was provided in error. He continued by stating there are some divisions that do not require sidewalks, but this depends on the date they were developed. In this particular case, Mr. Helstedt’s property does require sidewalks according to the change in ordinance. The City Engineer outlined the three options for the property owner which were to put a sidewalk in on their own, Mr. Helstedt could hire a City contractor to replace the sidewalks and PUBLIC WORKS AND SAFETY COMMITTEE July 30, 2014 Page 3 have the costs special assessed to property, or the final option would be to request the sidewalk requirement be waived by the Committee and Council. He stated he was unsure if there are sidewalks on the adjacent properties and that some of the properties of 27th St NW were platted in the 1990’s, which would determine the presence of sidewalks or not. Alderman Lehner stated it would be odd to waive the need for sidewalks at the Helstedt and Nilsen properties when the other surrounding neighbors have already installed them. Mr. Helstedt stated his closest neighbor to the north of him put in sidewalks but there are 2 empty lots in between the two properties. He also noted there were no sidewalks across the street. Alderman Schuler asked if it would be possible to push the need for the Helstedt and Nilsens to install the sidewalks until there is further development. Alderman Connole stated it would not be right to push back the need for sidewalks when the current ordinance states the sidewalks are required. Whereupon a vote was taken on the above motion by Alderman Lehner, seconded by Alderman Hatlelid and was carried by the following roll call vote: ayes: Berg, Connole, Hatlelid, Jantzer, Lehner, Schuler. nays: none 10. The City Council place and pass the proposed ordinance, on first reading restricting parking on the south side of 16th Avenue SE between 2nd Street SE and approximately 100 feet west of 5 th Street SE (where the roadway widens). ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner. The Traffic Engineer stated the City has recently met with several neighbors who said they would prefer the parking be removed from the south side rather than the north side. She recommended the proposed ordinance be changed to remove parking form the south side of 16th Ave SE. Alderman Lehner moved to amend the motion to place and pass the proposed ordinance, on first reading restricting parking from the south side of 16th Ave SE from 2nd St SE to 100’ West of 5th St. SE.
