The City Council reject all bids for the downtown infrastructure inprovements due to the substantial overage compared to the Engineer’s estimates, authorize the projects to be bid and awarded in multiple phases, approve the plans and specifications and authorize a call for bids on the first phase of the project; and further make a request to EDA for a disbursement of funds prior to the tender of all construction contracts. (3608, 3630, 3631) ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 2. The City Council approve the contract amendment with HMjv for Downtown Infrastructure Improvements in the amount of $147,497, approve the resolution declaring official intent; and further authorize the mayor to sign the amendment. The City Council place and pass the proposed ordinance on first reading enacting a new subsection (e) to Section 22-1 in Chapter 22 of the City of Minot Code of Ordinances, relating to declaration of nuisances and barricading or fencing of open pits or excavations. ************** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 4. The City Council award the bid to Sanitation Products in the amount of $145,500 for the truck and packer for the Sanitation Department. The City Council award the bid to Acme Tools in the amount of $70,500 for the two tractors with flail mowers. The City Council award the bid to Westlie Truck Center in the amount of $164,584 for the two tandem axle trucks for the Sanitation Department. The City Council award the bid to Craft Builders in the amount of $184,960 for the general construction of the Station Two remodel, award the bid to C&C Plumbing in the amount of $123,256 for the mechanical construction of the Station Two remodel, award the bid to Gefroh Electric in the amount of $35,805 for the electrical construction of the Station Two remodel; and further authorize the Mayor to sign the contracts on the City’s behalf. The City Council award the bid to Titan Equipment in the amount of $199,550 for the Case 921F Industrial Wheel Loader. The City Council award the bid to Swanston Equipment in the amount of $36,464 for the Case DV36 tandem vibratory asphalt roller. The City Council authorize the Minot Police Department to accept the 2014 ND Office of the Attorney General Criminal Justice Oil Rig Personal Protective Equipment (PPE) Grant in the amount of $5,470. The City Council award the bid to Wagner Construction, Inc. in the amount of $2,970,180 for the 55 th St. and 30th Ave. Water Transmission Line; and further authorize the Mayor to sign the contract documents on the City’s behalf. The City Council approve the change order in the amount of $47,922 for the 55th St. Forcemain and Gravity Sewer Improvements project. The additional costs will be project costs. The City Council approve the engineering amendment with Houston Engineering for the design of the Water Plant Flood Protection project; and further authorize the Mayor to sign the amendment on behalf of the City. The City Council approve the Cost Participation and Maintenance agreement for the Perkett sidewalk project and authorize the Mayor to appropriately finalize the agreement, approve the plans and specification and call for bids for the project, authorize the City Engineer to solicit Requests for Qualifications for Construction Engineering Services for the project; and further approve the Resolution declaring official intent. The City Council approve the engineering services contract amendment with Houston Engineering for Paving District 473 in the amount of $32,710; and further authorize the Mayor to sign the amendment. The City Council approve the City Project Submittal List of requested Urban Roads Projects for submittal to the NDDOT. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 17. The City Council authorize Bill Houim, Magic City Harley Davidson to connect into the City’s sewer system, providing he pay the required connection fee as determined by the City Engineer, as well as sign a form stating they will not protest possible property annexation in future City growth; and further sign a developer agreement for upgrading the lift station if required. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 18. The City Council approve the plans and specifications for the City WI-FI Ring Network; and further authorize the Public Works Director to call for bids. The City Council award the bid to Jamestown Communications in the amount of $29,722.40 for the City Wide WI-FI Siren Upgrade; and further authorize the Mayor to sign the contracts on behalf of the City. The City Council approve a contract for advertising with Jessica Declercq – State Farm Insurance Agent, and further authorize the Mayor to sign the contract. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 23. The City Council award the bid to First Dakota Enterprise, Main Electric and C&C Plumbing for the 55th St. Fire Station, and further approve the use of $117, 298.80 budgeted under Land for NW Station in the Fire Department Capital Improvements budget to complete the funding for this project. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 24. The City Council place and pass the following ordinances on second reading: a. Ordinance No. 4916 – Amending 2014 Annual Budget – Increase Capital Equipment Purchases Revenues and Expenditures – Decrease Traffic Department Maintenance Signs, Signals and Markers Account – Minot State University Crosswalk Warning System (3597) b. Ordinance No. 4917 – Amending 2014 Annual Budget – Increase Department Budgets – Funds Spent Using Corresponding Revenues and Cash Reserves ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 25. The City Council award the bid to Sanitation Products in the amount of $292,129 for the truck mounted hydro-vac; and further place and pass a proposed ordinance on first reading, amending the 2015 Annual Budget to increase the Storm Sewer Maintenance budget expenditures for the additional cost of the purchase. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 26. The City Council award the bid to Titan Machinery in the amount of $51,400 for the wheel loader, approve the use of the remaining funds in the amount of $1,900 from the Station Two Remodel project; and further authorize the Fire Chief to complete the purchase. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. The Fire Chief stated this is for snow removal and is a wheel loader similar to a Bobcat. He said this item is needed since the Ward County building has now reduced space for snow removal. PUBLIC WORKS AND SAFETY COMMITTEE January 7, 2015 Page 5 27. The Public Works Committee moved to hold the item concerning ADA Taxi Cab Compliance Updates until the February 25th Public Works and Safety Committee meeting. ********** Alderman Lehner moved in order to ensure Minot taxi companies are in compliance with the ADA requirements, each taxi company shall certify, in writing, the company is currently in compliance with the ADA. If, after investigation, the City learns a taxi company is not in compliance, the City would have the option to suspend or revoke the taxi company license pursuant to section 30-58 of the City of Minot Ordinances. Motion seconded by Alderman Jantzer. Upon questioning by Alderman Lehner, the Assistant City Attorney, Kelly Hendershot stated the compliance officer of the Police Department will send letters to current taxi cab companies informing them of requirements and asking for their certification saying they are ADA compliant. She also stated the same rules that are in place will apply to existing and future companies. Brandom Rowenhorst of 1909 31st Ave SW #122, appeared before the Committee to state is he currently looking into North Dakota case law concerning this. He stated the memo provided is based on Federal Law and does not address the ND Human Rights Act in place. He noted he has also been having discussions with several state Senators and Souris Basin Planning concerning this issue. Alderman Lehner stated his understanding is that Minot does not have the authority to require cab companies to provide handicap accessible transportation, but cab companies can certainly make that decision on their own. Mr. Rowenhorst stated he feels the absence of City support would imply this service is not needed. He feels one handicap accessible vehicle for current cab companies does not seem unreasonable. Alderman Lehner moved the Committee hold this item until the February City Council meeting. Motion seconded by Alderman Jantzer. This motion and second were later rescinded to allow for further conversation. Alderman Connole referenced the handicap accessibility requirements for housing. He stated he thinks providing more handicap accessible transportation could be accomplished by changing current ordinances. Whereupon Alderman Lehner moved the Committee hold this item until the February 25th Public Works and Safety Committee meeting.
