The City Council approve the plans and specifications for the Fire Station Two remodel; and further authorize the Fire Chief to call for bids (FD0023). ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 2. The City Council award the bid to Wagner Construction in the amount of $1,273,750 for the 55 th Crossing Sewer Lift Station project (3965); and further approve the use of water and sewer revenue bonds to pay a portion of the project. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 3. The City Council authorize the Fire Chief to trade-in a rescue box as surplus property for new aerial equipment budgeted in 2015. ************** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 4. The City Council place and pass an ordinance on first reading, to restrict parking on the west side of 25th Street NW to buses only on school days during school hours at the bus loading zone, described as between approximately 60 feet north of 5th Avenue NW and approximately 250 feet north of 5 th Avenue NW. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 5. The City Council grant the encroachment of the fence for the Souris Valley Golf Course on Outlot 53 to be in the public right of way. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE November 25, 2014 Page 2 6. The City Council award the bid to Sanitation Products in the amount of $178,085 for a street sweeper for the Street Department (STR027). ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 7. The City Council authorize the Compliance Officer at the Minot Police Department to investigate whether existing taxi companies in the City of Minot are in compliance with the requirements outlined above; in the event the existing taxi companies are not in compliance, it is recommended each taxi company comply or face suspension or revocation proceedings relating to their taxi license issued by the City of Minot. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 8. The City Council place and pass the following ordinances on second reading: a. Ordinance No. 4904 – Amending 2014 Annual Budget – Increase Fire Capital Purchases Revenues and Expenditures – Decrease Fire Control Salaries – Fire Department Training Grounds – Transfer Funds From General Fund to Fire Capital Purchases Fund (FD0013) b. Ordinance No. 4905 – Amending 2014 Annual Budget – Decrease Police Capital Equipment Purchases Fund Budgeted Revenues and Expenditures – FY12 State Homeland Security Grant – Command Truck and Radio – Increase Police General Fund Revenues and Expenditures (PD0034) c. Ordinance No. 4906 – Amending 2014 Annual Budget – Increase Criminal Investigations Revenues and Expenditures – North Dakota Bureau of Criminal Investigations Grant – Minot Police Department (PD0072) d. Ordinance No. 4907 – Amending 2015 Annual Budget – Increase Criminal Investigations Revenues and Expenditures – North Dakota Bureau of Criminal Investigations Grant – Minot Police Department (PD0073) e. Ordinance No. 4908 – Amending 2015 Annual Budget – Decrease Police Department Budgeted General Fund Revenues and Expenditures – Community Oriented Policing Program (COPS Grant) ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 9. The City Council approve the agreement with North Prairie Rural Water (NPRW) for the Bluffs Addition Water Service; and further authorize the Mayor to sign the contract for water service to the Bluffs Development. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. Alderman Jantzer stated the agreement presented was acceptable and he has spoken to many home owners who were told they would have City services, with the exception of water, which would be NPRW, and he wants to make sure homeowners are aware of the boundaries. The Public Works Director stated this agreement uses a mixed approach as the Rural Water System supplying water is protected under State and Federal laws. He said the City has an agreement to supply NPRW a certain amount of water, but the City is not allowed to go in to service their area. He continued by saying when developers start meeting with the City, the territories of both NPRW and the City are discussed, and developers are well aware of who the water provider is. The Public Works Director said rural water users are charged a flat fee of $29-$39 per month plus water usage. He said Minot water users are charged $10.75 fee plus an additional $3.75 per 100CF of water usage. He concluded by saying the rural water sewage charge is based on usage as is Minot’s. PUBLIC WORKS AND SAFETY COMMITTEE November 25, 2014 Page 3 \10. The City Council place and pass the proposed ordinance on first reading, thereby amending Chapter 23 (Offenses – Miscellaneous), Article IV ( Weapons Offenses), Division II (Other Weapons), Section 23-67 of the Code of Ordinances relating to offenses- miscellaneous – Held Until February Council Meeting. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner. To open discussion, Alderman Hatlelid made the motion to place and pass the proposed ordinance on first reading, thereby amending Chapter 23 (Offenses – Miscellaneous), Article IV ( Weapons Offenses), Division II (Other Weapons), Section 23-67 of the Code of Ordinances relating to offenses- miscellaneous. Motion seconded by Alderman Lehner. Alderman Lehner stated he received several calls on this item from people concerned about infringing on rights. He also has concerns for safety in the event an arrow goes over a fence. He inquired if the ordinance is not passed are pellet allowed guns in town, and are people allowed to shoot small animals with a small game permit. Alderman Connole stated his understanding is that people are not allowed to hunt within 440 yards of an inhabited building. Gary Panasuk of 208 13th St. SW appeared before the Committee to protest this ordinance stating it will not allow people to do archery in the backyard and feels this ordinance will take away a person’s basic right. He stated if the City is looking to mirror other cities such as Bismarck and Mandan, then Minot should provide facilities for these past times. Alderman Lehner asked Captain White to provide some data of incidents in regards to BB guns in Minot. Whereupon Alderman Lehner moved the Committee hold this item until the February City Council meeting. Motion seconded by Alderman Schuler and was carried unanimously. 11. The City Council hold the item regarding the 2035 Transportation Plan and implementation of the policies within the plan until the January 2015 Committee meeting. ********** The City Engineer stated the consultant’s flight was cancelled and they will be returning for the Public Works meeting in January. Alderman Hatlelid moved the Committee hold this item until the January Committee meeting. Motion seconded by Alderman Lehner and was carried unanimously.
