The City Council approve the plans and specifications for the SE Fire Station and authorize the Minot Fire Department to call for bids. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 2. The City Council approve the proposed meeting schedule for 2015, copies of which are kept on file at the City Clerk’s office. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 3. The City Council authorize the Public Works Director to negotiate a scope and fee with Ackerman- Estvold for the design and construction observation of Phase VI (3020.5) of the Puppy Dog Sewer system, adopt a proposed resolution approving the use of utility bonds for the City’s share of payment; and further authorize the Mayor to sign the contract on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 4. The City Council approve the plans and specifications for this portion of the 55th St. and 30th Ave. Water Transmission Line (3681) project and authorize a call for bids. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 5. The City Council authorize the Public Works Director to negotiate a contract for design and construction engineering services for the watermain upsizing – 16th Ave SE between 42nd & 46th St. project (4029) with Ackerman-Estvold Engineers, adopt proposed resolution approving the use of Water and Sewer Utility bonds to pay for the engineering services; and further authorize the Mayor to sign the agreement on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE October 29, 2014 Page 2 6. The City Council authorize the Public Works Director to negotiate a contract for design and construction engineering services of the Dakota Square Pump Station Rehab (4030) for this project with Houston Engineering, adopt proposed resolution approving the use of Water and Sewer Utility bonds; and further authorize the Mayor to sign the agreement on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 7. The City Council place and pass a proposed ordinance on first reading to revise the speed limit on 30 th Avenue NW to 35 mph between Broadway and the US 83 Bypass, and the speed limit be reduced to 30 mph on 16th Street SW between 31st Avenue and 37th Avenue SW. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 8. The City Council approve plans and specifications and authorize the Public Works Director to call for bids for the Water Treatment Plant – Hazard Mitigation Grant Program project (3673.0); and further adopt a proposed resolution approving the use of water and sewer utility bonds. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 9. The City Council approve the site access agreement form for the EPA Brownfields Assessment and EPA Brownfields Area Wide Planning Grants, and authorize City staff and Stantec to utilize this form on properties that may qualify for the grants. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 10. The City Council approve the Construction Engineering Supplement No. 2 with KLJ for the 13th St. SE Reconstruction; and further authorize the Mayor to sign the necessary documentation on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 11. The City Council place and pass the proposed ordinance on first reading amending Section 9-16 of the City of Minot Code of Ordinances relating to appeals from an order of the Building Official. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 12. The City Council place and pass the following ordinances on second reading: a. Ordinance No. 4890 – Amending 2014 Annual Budget – Allocated Budgeted Expenditures in Library Fund – Increase Expenditures in Capital Equipment Purchases Fund – Purchase of Library Self- Checkout Kiosk (LIB017) b. Ordinance No. 4891 – Amending 2014 Annual Budget – Increase Revenues and Operational Supplies in General Fund – Decrease Revenues and Expenditures in Capital Equipment Purchases Fund – Minot Police Department – North Dakota Criminal Justice Oil Impact Grant (PD0058) c. Ordinance No. 4892 – Amending 2014 Annual Budget – Decrease Capital Equipment Purchase Fund – Increase General Fund – Minot Police Department – Minot Area Community Foundation Grant (PD0064) d. Ordinance No. 4893 – Amending 2014 Annual Budget – Increase Police Department and Capital Equipment Purchases Fund Revenues and Expenditures – FY14 State Homeland Security Grant – PUBLIC WORKS AND SAFETY COMMITTEE October 29, 2014 Page 3 Upgrade Software and Components of the ANDROS F6 Robot – Purchase Equipment (PD0070) e. Ordinance No. 4898 – Adopting a One Year Moratorium Relating to Opioid Treatment Programs, Including Programs Licensed Pursuant to Chapter 75-09.1-10 of the North Dakota Administrative Code, Within the City and its Extraterritorial Zone f. Ordinance No. 4881 – Rezoning Bryn Mawr 2nd Subdivision, Lots 1-3 ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 13. The City Council instruct the Police Chief and Assistant City Attorney to draft an ordinance prohibiting the use of BB guns and arrows within City limits. ********** The above motion by Alderman Hatlelid, seconded by Alderman Shomento. Chief Olson stated there was a past ordinance which did prohibit the use of BB guns and arrows within City limits, but it was revised about 15 years ago due to unknown reasons. He said the fact there is no ordinance on BB guns and arrows does not mean hunting within City limits is allowed and hunters still need to acquire a proper hunting license. Alderman Schuler expressed her concern this would exclude target practice for archery in a backyard. Alderman Hatlelid stated the City definitely needs to abolish broad head arrows completely within City limits under any and all conditions. Alderman Lehner stated even target practice in a backyard could be a safety issue. He said a line of sight could be off or an arrow could slip through and go into a neighbor’s yard. Whereupon a vote was taken on the above motion by Alderman Hatlelid, seconded by Alderman Shomento and was carried by the following roll call vote: ayes: Berg, Connole, Hatlelid Jantzer, Lehner, Shomento. nays: Schuler. 14. The City Council approve a resolution for an extension to maintain THU at 2005 Westfield Ave until June 1, 2015. ********** Terry Bernsdorf of 2005 Westfield Ave appeared before the Committee to request an extension until March 30, 2014 for his THU to remain on his property. Alderman Lehner asked if the time extension would be long enough as it could potentially still be winter in Minot during that time. He asked Mr. Bernsdorf if he had a way of removing the THU, to which Mr. Bernsdorf said the THU is sold and would be pulled off the lot. Whereupon a motion was made by Alderman Lehner to approve a resolution for an extension to maintain THU at 2005 Westfield Ave until June 1, 2015. Motion seconded by Alderman Jantzer. Whereupon a vote was taken on the above motion by Alderman Lehner, seconded by Alderman Jantzer and was carried unanimously. 15. The City Council approve a resolution for an extension to maintain THU at 818 6th Ave NW until June 1, 2015. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE October 29, 2014 Page 4 16. The City Council approve a resolution for an extension to maintain THU at 2109 1st Ave SW until June 1, 2015. ********** Alderman Lehner gave an overview of the situation stating Eldore Leier is the property owner and is living in her home, her daughter, who provides her care is living in the THU. He stated this is a violation, as the property owner must be the one living in the THU. He said he spoke to the daughter and suggested she send a representative to the Committee meeting as the daughter also has some health issues. Alderman Lehner told the daughter of the issues of non-compliance and expressed the need for her to find a solution, as well as gave her a few suggestions on how she could resolve it. The City Planner stated it is difficult to gauge each owner’s situations as each is different. She commended all the residents on the progress that had been made. She stated the house on the main floor level is about 99% complete, but the basement, where the daughter resided prior to the flood, has not been finished and still has an odor due to the flood. She said she has given the homeowner information and resources which could help her finish the home, although the church group volunteers are starting to leave for winter She agreed with the Committee as to the fairness of the proposed extension. Alderman Shomento stated a neighbor of Mrs. Leier has complained about the THU still being on her property. The City Planner stated she will notify the homeowners of the deadline notice and asked if she should have any more inspections scheduled. Alderman Lehner stated there should not be a need for more inspections, as homeowners are aware of the final deadline. Whereupon a motion was made by Alderman Lehner to approve a resolution for an extension to maintain THU at 2109 1st Ave. SW until June 1, 2015. Motion seconded by Alderman Jantzer. Whereupon a vote was taken on the above motion by Alderman Lehner, seconded by Alderman Jantzer and was carried unanimously. 17. The City Council review and adopt the Minot River Front and Center Downtown and Neighborhood Study. ********** Phil Carlson, a representative of Stantec, appeared before the Committee and gave an overview on the results of the study. Stantec met with six different neighborhoods to discuss recommendations on how to revitalize their specific neighborhoods. He stated the neighborhoods had similar ideas of what they would like to see done. He noted the downtown area also addressed issues with parking and the importance of redevelopment. Mr. Carlson continued by saying Stantec has been working on this project for approximately 1 year. He concluded by saying there has also been a historic survey done by the 106 Group on properties in 3rd and 4th Ave NW as well as the 5th and 9th St. NW area, but none of the properties qualified for the National Register of Historic Properties (NRHP) designation. Whereupon a motion was made by Alderman Lehner to adopt the Minot River Front and Center Downtown Neighborhood Study. Motion seconded by Alderman Schuler. Alderman Connole asked if Stantec was questioned on the River Channel remaining in its present state. Mr. Carlson stated Stantec conducted the study with neighborhoods working around the current channel, but understands there are proposed flood walls and channel widening that will affect the current situation. He noted this study did not address changing the current channel. PUBLIC WORKS AND SAFETY COMMITTEE October 29, 2014 Page 5 Alderman Schuler stated she was involved in the neighborhood meetings and appreciated the information she received from the meetings. Whereupon a vote was taken on the above motion by Alderman Lehner, seconded by Alderman Schuler and was carried unanimously. Other Business Alderman Lehner asked the Assistant Public Works Director to put together information of the study Minot has done on recycling.
