The Mission Hills Board of Zoning Appeals (BZA) provides that the BZA shall determine whether or not an ARB decision was reasonable
based upon the evidence presented to the ARB and the record of the ARB proceedings. Testimony at the BZA hearing will be limited to a
discussion of the evidence presented to the ARB. No new evidence will be considered.
#1 Dan & Donita Miller 2335 Guilford Lane
The Millers are requesting approval for a generator they installed in their rear yard.
This project was continued at the June 4th ARB meeting so an alternate location could be found for the
generator. See plans for the new location.

The Millers propose locating their generator 10 feet from the rear property line. New landscaping is
proposed to screen the generator from the rear neighbor’s view.

There are no conflicts between the proposed project and the City of Mission Hills Design Guidelines.

#2 Cathleen & Timothy Beaver 2312 Tomahawk Road
The Beavers are proposing an interior remodel that includes new windows at the rear of the house.

Summary of Project:
They propose to relocate an existing triple casement and add a second one to match. The existing brick
siding will be patched as needed.
Ordinance Compliance:

There are no conflicts between the proposed project and the City of Mission Hills Design Guidelines.

#3 Andrew & Allison Remak 6439 Overbrook Road
The Remaks are proposing a new arbor over their existing garage doors.

Summary of Project:
The proposed arbor is a simple post-and-beam structure that is supported by brackets attached to exiting
columns. The arbor extends out from the face of the house 30 inches and aligns with the underside of an
existing soffit.
Ordinance Compliance:
There are no conflicts between the proposed project and the City of Mission Hills Code of Ordinances.
Design Guideline Review:
There are no conflicts between the proposed project and the City of Mission Hills Design Guidelines.

#4 Jon & Kelly Lambert 5650 High Drive
The Lamberts are returning to the ARB with changes to their previously approved new home.
Summary of Property:

Summary of Project:
The front door material has changed to steel in lieu of wood.
The eave condition at the 1-story balcony at the southeast has changed to allow for a center drain in place of
exterior gutters.
The southeast chimney at the balcony has shifted to the east to accommodate interior structural members.
Two small windows were removed by the doors under the covered porches. (North & West elevations)
They have confirmed that all but one of the arched units, in the southwest sunroom, will be fixed windows to
look like doors, but without the hardware.
Ordinance Compliance:
There are no conflicts between the proposed project and the City of Mission Hills Code of Ordinances.
Design Guideline Review:
There are no conflicts between the proposed project and the City of Mission Hills Design Guidelines.

#5 Farid Namin 6520 State Line Road
Mr. Namin is proposing to replace his existing driveway and add a new portion to create a circle drive.
This project was reviewed in 2022 before the homeowner withdrew. The ARB requested that the driveway be
redesigned to reduce the new drive width to be no more than 12 feet at the property line.
Project was continued from the 8/13/24 meeting.
Summary of Property:

• Location of Common Green Space: Front
• Any Special Frontages: None
Summary of Project:
The new circle drive will be formed by connecting a new 12-foot-wide drive to his existing 18-foot-wide
driveway. The new circle portion of the driveway is 12 feet wide.
Ordinance Compliance:
There are no conflicts between the proposed project and the City of Mission Hills Code of Ordinances.

Design Guideline Review:
Section 2.5 on pages 72 through 75 of the Design Guidelines provides specific recommendations for the
Suburban character area.
Subsection G suggests that driveways occupy as little of the Primary Landscape Area as possible. On lots
wider than 140 feet the driveway should be located off the side property line a distance no less than 8% of
the lot width. Circle driveways should have an interior green with a width no less than 80 feet wide,
measured at the front property line, and depth of 40 feet measured from the curb. The proposed driveway
has an interior green 60 feet wide and 57 feet deep. This recommendation has not been met.
Section 2.7.2.B on page 102 recommends drives to be no more than 12 feet wide at the front property line.
This recommendation has not been met for the existing driveway that is being replaced.
Section 2.7.3.A on page 106 recommends that LS-1 and 2 properties have a greenspace no less than 60%
of the lot area. This recommendation has been met. Please note, that the owner did not include any rear
decks or patios in their greenspace study, these have been added by the city staff.

The new resolution gives authority to the City Administrator or designee to approve window wells as
long as they “are predominately below grade as long as no more than ___ inches of the window, or
accompanying well, is above grade.”
