APPEALS HEARING BOARD MEETING

CALL TO ORDER Chair Stocker called meeting to order at 10:10 AM
PUBLIC APPEARANCE: None
1. APPROVAL OF MINUTES: from January 14, 2013 meeting (City Attorney’s Office 701-
09). Villalpando made motion to approve minutes, Hawkins seconded. Minutes
approved.
PUBLIC HEARING
2. Recommend that City Council Approve the Updated Americans with Disabilities Act
(ADA) Updated Transition Plan (Plans & Public Works 202-18) (Plans & Public Works -
202-18)
Mr. Kuehl introduced new Board Member Michael Castaneda and thanked the Board for their
input and participation on the transition plan.
After a brief summary of the last meeting and an overview of the proposed project he advised
that funding is available and he is hopeful to get the Chamber transition under way within the
next 60 days.
Mr. Kuehl advised the purpose of the transition plan is to give the City a roadmap to identify and
prioritize projects to bring them into compliance with Americans with Disabilities Act (ADA)
regulations; it is a living document that would continuously be revised and updated. The Board
is tasked with making a recommendation to the City Council on whether or not the proposed
plan meets the criteria necessary for the City to proceed and maintain a compliant ADA plan.
Mr. Kuehl introduced the City’s consultant Arfaraz Khambatta, with Sally Swanson Architects,
Inc. Mr. Khambatta gave overview of the evaluation process, including how buildings,
intersections, sidewalks, etc. were evaluated and prioritized.
He stated there are 366 intersections (map handouts) and gave explanation on prioritization and
severity levels of as per US Department of Justice Guidelines and ADA regulations. He also
discussed possible implementation plans, such as prioritizing by higher traffic areas and how
utilizing GIS software can help with the process. Additionally, commented on importance of
documenting barrier mitigation.

Mr. Khambatta addressed the Board’s concern regarding City owned properties that are leased.
He advised these are not currently included in the transition plan and suggested the City include
specific language and guidelines in future lease contracts to ensure accessibility.
BOARD COMMENTS
Chair Stocker commented that parts of the report were difficult to cross reference.
Member Dwight recommended that all the information regarding a specific project or address,
be compiled together to improve report clarity and a summary for each project be provided. She
also stated the report should include a way to differentiate between non-compliant areas and
those that currently have no compliance at all.
Mr. Khambatta acknowledged the Board’s suggestions would improve the clarity of the report
and stated he will revise and reassemble report to address Board comments.
Member Villalpando made the motion to recommended approval of the transition plan for the
Council’s consideration, pending edits as directed by the Board. Member Hawkins seconded.
Motion passed unanimously.

PUBLIC COMMENTS
PUBLIC COMMENTS allows you, the public, to speak for a maximum of three minutes on any
subject which is within the jurisdiction of the City of Monterey and which is not on the agenda. Any
person or group desiring to bring an item to the attention of the Board may do so by addressing
the Board during Public Comments or by addressing a letter of explanation to: Permits &
Inspection Services, 580 Pacific St, Room 4, Monterey, CA 93940. The appropriate staff person
will contact the sender concerning the details.
DISABLED ACCESS PUBLIC HEARING
PUBLIC ACCESS PUBLIC HEARINGS are held to receive public comment on certain items
pending Board action related to access to public accommodations by physically disabled persons.
You are welcome to offer your comments after being recognized by the Chair. The Board may
limit the time allocated to each speaker.

BOARD MEMBER COMMENTS
Board members may ask a question for clarification, make a brief announcement or make a brief
report on his or her activities. In addition, the Oversight Board may provide a referral to staff or
other resources for factual information, request staff to report back to the body at a subsequent
meeting concerning any City matter, or direct staff to place a request to agendize a matter of
business on a future agenda (G.C. 54954.2).

Members of the public have the right to address the Appeals Hearing Board on any item on the Agenda,
before or during its consideration [G.C. §54954.3(a)]. The Chair will formally open the floor for public
comment on items such as "Public Appearance" and "Public Hearings." If you wish to speak to items in
any other categories, please advise the Secretary to the Board or the Chair prior to the Appeals Hearing
Board's action on that item, and you will be recognized. Notification as much in advance as possible is
appreciated.
The Appeals Hearing Board meeting packet may be reviewed by the public at the Monterey Public
Library. Information distributed to the Board becomes part of the public record. A copy of written material,
