Committee Member Davis moved to place Item 7 on the Consent Agenda. Committee Member Jacoubowsky seconded the motion. Committee Member Latasa recused himself from Item 7 due to a conflict. The motion passed 3-0-3(Absent McKenzie, Arellano, Finklea)-1(Recused Latasa). Committee Member Davis abstained from the June 1, 2011 Minutes since he was not present at the meeting. Approve the Sign Permit application for installation of murals. ACTION: On consent, approved the application and adopted Findings for Decision. 4. 96 Fisherman's Wharf No. 1; Sign Permit Application 11-014; Applicant Merritt Palminteri for Benji Shake; Owner City of Monterey; Exempt from CEQA Requirements. Approve Sign Permit Application for modified roof sign, two wall signs and freestanding sign. ACTION: Approved the amended application with Conditions of Approval and adopted Findings for Decision. Conditions of Approval: 1. The approval is for the following signs: a. Roof-Mounted Sign: 26 square-foot sign that states Monterey Whale Watching. b. The Princess sign shall be painted yellow to match the building. c. Door-Mounted Sign: The 3 square-foot Next Trip Sign. d. Freestanding Sign: 7 square-foot door-mounted sign with recent sightings, join us and brochures. e. 32”x44” whale poster sign. f. 32”x46” Monterey Bay poster sign. All other signs are prohibited, regardless of past approvals. 2. The installation of the door-mounted sign constitutes a freestanding sign and the existing fisherman statue is no longer permitted, per the Wharf Master Plan. The statue shall be permanently removed. 3. Prior to installation of the signs, the exterior cameras shall be removed unless evidence of their prior approval by the ARC can be provided. 4. The approval of this project is conducted in accordance with Chapter 31 of the Monterey Municipal Code, which authorizes the Architectural Review Committee to impose Conditions of Approval and obligates the applicant to abide by such Conditions of Approval. Further, each lease on Fisherman’s Wharf No. 1 requires that the tenant abide by all local laws, including Chapter 31. As such, any violation of this approval may also constitute a violation of lease and any resulting action described in the lease and available to the City of Monterey, potentially including declaration of a breach of lease. In proceeding with this approval, the applicant acknowledges the imposition of Conditions of Approval, the importance of abiding by them, and any potential ramifications of violation of the approval. Staff Presentation/Committee Member Questions: Senior Planner Ebbs presented the staff report and answered Committee Members’ questions. Applicant: Dennis Hodgin was present. He handed out a photo proposing to add an additional “Princess” sign to the existing signage at the top of the building. He answered questions regarding the font and colors of the sign. ACTION: Approved the application with Conditions of Approval and adopted Findings for Decision. Conditions of Approval: 1. The trash receptacles should comply with the City of Monterey requirements with regards to recyclables. Staff Presentation/Committee Member Questions: Senior Planner Ebbs presented the staff report and answered Committee Members’ questions. Applicant: Hunter Harvath, Phil Wellman and representatives from Bellinger & Foster were present. Mr. Harvath explained the project with regards to traffic flows, having the shelters ready by the Jazz Festival and working with North Fremont Business District. He added that the construction drawings are about 60% completed and they have been working closely with Rich Deal, Traffic Engineer. Mr. Harvath asked for input on the possibility of the existing trash receptacle being replaced to match the proposal. All present answered questions regarding the trash cans having recycling components, rotating the posters throughout the shelters, lighting, solor panels, landscaping, streetscapes plans and the proposed budget. Public Comments: None. Committee Member Comments: A discussion was held with regards to the trash receptacles complying with the recycling requirements of the City of Monterey. All present explained the project with regards to the wing windows, proposed colors, the entry portal, and exterior finishes. Everyone answered questions regarding the planters, columns, the proposed blue and silver colors, the trellis, stone, the roof line, fascia, gutters and signage. Public Comments: None. Staff Presentation/Committee Member Questions: Senior Planner Ebbs presented the staff report and answered Committee Members’ questions. Applicant: Vince Balestreri and Mike Chico were present. They explained the project with regards to the business being in a smaller location, getting people into the restaurant and the clean design of the signs. Both answered questions regarding the location of the business, the lighting, the verbiage of the signs, and the size of the circular sign. Public Comments: None. Committee Member Comments: A discussion was held with regards to the size of the circular sign and the Hamburger Shakes Fries sign being precedent setting and discouraged by the sign guidelines. Committee Member Jacoubowsky moved to continue the item to the next meeting, Committee Member Latasa seconded the motion. After a discussion regarding the bracket and wall mounted signs, Committee Member Latasa withdrew his second. Committee Member Jacoubowsky moved to continue the Hamburger Shakes Fries sign to the next meeting. Vice Chair Dawson seconded the motion. The motion failed due to a split vote. Committee Member Jacoubowsky moved to continue the Hamburger Shakes Fries sign to the August 17, 2011 meeting and approve the bracket and wall signs. Vice Chair Dawson seconded the motion. On a motion by Committee Member Jacoubowsky, seconded by Vice Chair Dawson, and carried by the following vote, the Architectural Review Committee approved the bracket and wall signs and continued the Hamburger Shakes Fries sign to the August 17, 2011 meeting. Sign permit application for two wall signs. ACTION: Continued the Lighthouse Avenue sign to the August 17, 2011 meeting with direction and approved the Foam Street sign using a matte finish. 1. Lower the sign. 2. Letters need to be smaller with a matte finish. 3. Explore a more subdued background for the building. Staff Presentation/Committee Member Questions: Senior Planner Ebbs presented the staff report and answered Committee Members’ questions. Applicant: Tom Carr was present. He explained the project with regards to the proposed business and how the sign will be manufactured at a different location. He answered questions regarding the entrances to the building, the existing remodel, and the size of the letters. Public Comments: None. Committee Member Comments: Committee Member Jacoubowsky stated that the sign should be brought down so there is more space above the sign, the letters are too large, and possibly create a border around the sign. Committee Member Latasa stated that he will not vote for the project because it is a plain sign and the letters are too big. Committee Member Latasa moved to continue the application to the next meeting. After a discussion regarding the Foam Street sign, Committee Member Latasa amended his motion to continue the Lighthouse Avenue sign to the August 17, 2011 meeting with direction and approve the Foam Street sign using a matte finish. Committee Member Jacoubowsky seconded the motion. On a motion by Committee Member Latasa, seconded by Committee Member Jacoubowsky, and carried by the following vote, the Architectural Review Committee continued the application to the August 17, 2011 meeting with direction and approved the Foam Street sign using a matte finish. Vice Chair Dawson stated that a house on Olivier Street has painted a wall bright orange and installed a television outside. INFORMATIONAL REPORTS & STAFF COMMENTS Senior Planner Ebbs updated the Committee on the status of the Fresh & Easy Market application and stated that the sign ordinance will be brought back for review at the August 17, 2011 meeting.
