CONSENT ITEMS Approval of Minutes 1. May 18, 2011 ACTION: Approved the Minutes of May 18, 2011 as submitted. On a motion by Committee Member Dawson, seconded by Committee Member Jacoubowsky, and passed by the by the following vote, the Architectural Review Committee approved the Consent Agenda. PUBLIC APPEARANCE 2. 57 Fisherman's Wharf No. 1; Sign Permit Application 11-116; Applicant Kevin Phillips; Owner City of Monterey; Exempt from CEQA Requirements (Continued from May 18, 2011). Consider Sign Permit Application for Installation of New Projecting Signs. ACTION: Approved the application with the Conditions of Approval and adopted Findings for Decision. Conditions of Approval: 1. The light fixtures are not approved as part of this application. Rather, the applicant shall submit revised light fixtures to the Architectural Review Committee for approval that adequately and appropriately light the boat sign. The light fixtures for the boat sign shall either be mounted to the vertical surface of the boat or mounted inside the boat and wrap over the top to illuminate the signs.  Architectural Review Committee Minutes Wednesday, June 1, 2011 2. The light fixture for the small fin sign shall be integrated into the bracket of the sign and shall project light downward and towards the sign. The applicant shall submit a cut sheet of this bracket prior to installation. 3. The hood for the light illuminating the abalone sign shall be replaced or the entire light fixture shall be replaced. 4. The boat sign shall contain a flat bottom. 5. A building permit will not be issued for these signs until Items 1 and 2 are resolved with staff. 6. The approval of this project is conducted in accordance with Chapter 38, Article 25 of the Monterey Municipal Code, which authorizes the Architectural Review Committee to impose Conditions of Approval and obligates the applicant to abide by such Conditions of Approval. Further, each lease on Fisherman’s Wharf No. 1 requires that the tenant abide by all local laws, including Chapter 38, Article 25. As such, any violation of this approval may also constitute a violation of lease and any resulting action described in the lease and available to the City of Monterey, potentially including declaration of a breach of lease. In proceeding with this approval, the applicant acknowledges the imposition of Conditions of Approval, the importance of abiding by them, and any potential ramifications of violation of the approval. Staff Presentation/Committee Member Questions: Senior Planner Ebbs presented the staff report and answered Committee Members’ questions. Applicant: Kevin Phillips was present. He explained the project with regards to the revised plan and lighting and answered questions regarding the cut sheet for the lighting not being submitted for review, the construction of the proposed boat, the fin sign and the colors proposed. Public Comments: None. Committee Member Comments: A discussion was held regarding the lighting being returned to the Committee instead of staff for review, and the construction regarding the boat having a flat bottom. Post-Decision Referral of an Administrative Approval of a Two-Story Addition to an Existing Single-Family Dwelling. ACTION: Approved the application and adopted Findings for Decision. 2  Architectural Review Committee Minutes Wednesday, June 1, 2011 Staff Presentation/Committee Member Questions: Senior Planner Ebbs presented the staff report and answered Committee Members’ questions. Applicant: Jeanne Byrne was present. Ms. Byrne explained the project with regards to the location of the garage, the gable roof, and the mass of the project being below street level. She answered questions regarding the garbage can storage area and screening, the parking pad, and the possibility of running the ridge the opposite way and rotating the master suite to move the garage farther away from the street. Public Comments: None. Committee Member Comments: A discussion was held regarding the ridge and the overall mass of the project. On a motion by Chair McKenzie, seconded by Committee Member Latasa, and carried by the following vote, the Architectural Review Committee approved the application and adopted Findings for Decision. Consider the application for temporary signage at the R&M Auction event. ACTION: Approved the application with the Conditions of Approval and adopted Findings for Decision. Conditions of Approval: 1. The 5’ tall, 60’ wide banner sign is approved for the period of August 16, 2011 through August 21, 2011. 2. The projected logos are approved for the period of August 16, 2011 through August 21, 2011 with the following restrictions: a. The red and white background should be identically illuminated. Both explained the proposal with regards to having special events at the Conference Center, using the signage to direct people to the event and the buildings having no color. Consider Sign Application for installation of a new gate sign. ACTION: Approved the application with the Conditions of Approval and adopted Findings for Decision. Conditions of Approval: 1. The sign shall be reduced in area to a maximum dimension of 24” in height and 36” in width (6 square feet). 2. The sign shall contain a contrasting border of at least 1” in width. 3. The sign shall be fashioned out of aluminum or other rust-resistant metal instead of plywood and vinyl. 4. The inquiry shall be removed from the sign. It may be located at the deck below. 5. Committee Arellano questioned the color of the awning at the Marriott hotel and how long CONA block grant funds will be used for the Code Compliance Coordinator’s time. Committee Member Jacoubowsky announced that Committee Member Davis’ back surgery went well. INFORMATIONAL REPORTS & STAFF COMMENTS None.
