March 6, 2013 ACTION: Approved as submitted. ***End of Consent Agenda*** PUBLIC COMMENTS None. PUBLIC APPEARANCE  Architectural Review Committee Minutes Wednesday, March 20, 2013 Todd Bennett informed the committee that staff requested item 4 be heard first due to the presence of the City Forester. The committee concurred. Committee Member Dawson made a motion to move item 4 to the first item in Public Appearance. Committee Member Latasa seconded the motion. On a motion by Committee Member Dawson, seconded by Committee Member Latasa, and carried by the following vote, the Architectural Review Committee approved moving item 4 to the first item under Public Appearance: AYES: 7 MEMBERS: Hill, Bartram, Davis, Dawson, Latasa, Sullivan, Jacoubowsky NOES: 0 MEMBERS: None ABSENT: 0 MEMBERS: None ABSTAIN: 0 MEMBERS: None RECUSED: 0 MEMBERS: None 2. Consider 1360 Josselyn Canyon Road; Tree Removal Permit 13-068 for Removal of an One Monterey Pine Tree; Applicant John Stacy; Owner Monterey Woods Owners Association; R-1-10-D2 Zoning District; Exempt from CEQA Requirements. ACTION: Continued the item to the April 3, 2013 meeting to allow the applicant to provide a site plan. Staff Presentation/Committee Member Questions: Todd Bennett presented the Agenda Report and answered Committee Member questions. City Forester Robert Reid briefed the Committee on the history and health of the tree in question. Applicant: Lee Keely, President of the Monterey Woods Home Owners Association, said the residents have worked with Mr. Reid for years to minimize sap and damage from the tree. He said this is the only tree on the property causing problems and in total has damaged four cars, including cracking the windshield of one car due to a fallen limb. Mr. Keely said the presence of the tree is a safety issue and thus its removal is warranted. Public Comment: Jim Fillputt, head of the Parking Committee at Monterey Woods, said none of the other uncovered parking spaces on the property have suffered from extensive debris or damage. He said creating covered parking would present an issue because each resident is provided one covered and one uncovered parking space. Jill Verha, a resident of Monterey Woods, said the presence of this tree is a safety concern. Ms. Verha told the Committee her car windshield was damaged after a large branch fell from the diseased tree. Photographs of the fallen branch and damaged vehicles were submitted by the applicants. Committee Member Comments: Committee Member Dawson asked about the feasibility of constructing a covered parking on the property. In answer to Committee Member Dawson's question, Mr. Bennett said the design of a single car carport might not be compatible with the design of the existing carports which are designed for two vehicles. 2  Architectural Review Committee Minutes Wednesday, March 20, 2013 Committee Member Sullivan suggested exploring alternative solutions that would not require the removal of the tree. Vice Chair Bartram concurred. Committee Member Jacoubowsky suggested parking could be relocated to an undeveloped area on the site. Chair Hill questioned the functionality of such a solution. Committee Member Latasa said Exception C of the Standards for Review of tree removals, justifies the committee approving the Tree Removal Permit. Vice Chair Bartram said if the Committee were to approve removal of the tree, he would like to discuss an alternative replacement tree. Committee Member Dawson concurred with Vice Chair Bartram and said the Jacquaranda tree is not an appropriate replacement. Committee Member Bartram made a motion to adopt a Resolution denying the tree removal permit. Committee Member Dawson seconded the motion. On a motion by Committee Member Bartram, seconded by Committee Member Dawson, and carried by the following vote, the Architectural Review Committee moved to adopt a Resolution denying the tree removal permit. Committee Member Davis made a motion to adopt a Resolution approving the tree removal permit and delegating the type and quantity of the replacement tree to staff. Committee Member Latasa seconded the motion. Committee Member Jacowbowsky said he would like to view a site plan of the property. He said this would provide the Committee the opportunity to discuss alternative placement for parking. Consider 640 Wave Street; AR Permit 13-080 for a New Mural; Applicant Robin Esquivel for Viking Sign Installations; Owner Cannery Row Company; C-2 Zoning District; Exempt from CEQA Requirements. ACTION: Adopted a Resolution approving the new mural. Staff Presentation/Committee Member Questions: Todd Bennett presented the Agenda Report and answered Committee Member questions. Applicant: Robin Esquivel said the goal of the mural, and the recently installed Sign Program, is to increase attendance at the theatre that occupies the building. She said the proposed mural is a beneficial addition to the building and does not meet the definition of signage. Michael Burnell, Senior Manager of the Wave Street Cinemark, said the instillation of the previously approved sign program has resulted in a noticeable spike in attendance and the addition of the mural should further increase attendance. Public Comment: Frank Donangelo, Vice President of Planning and Development for the Cannery Row Company, said the Cannery Row Company supports the addition of the mural. Committee Member Comments: Committee Member Dawson made a motion to adopt a Resolution approving the new mural. Committee Member Jacoubowsky seconded the motion. Committee Member Bartram said he believes the proposed project meets the definition of signage. In response to Committee Member Bartram's comment, Mr. Bennett highlighted the Architectural Review Committee adopted guidelines (1992). 4  Architectural Review Committee Minutes Wednesday, March 20, 2013 On a motion by Committee Member Dawson, seconded by Committee Member Jacoubowsky, and carried by the following vote, the Architectural Review Committee adopted a Resolution approving the new mural. Consider 794 and 798 Lighthouse Avenue; Sign Permit 12-373 for a Multitenant Sign Program; Applicant Anjanette Adams for Monterey Signs, Inc.; Owner Cannery Row Company; C-2 Zoning District; Exempt from CEQA Requirements. ACTION: On consensus the Committee continued the project with direction for redesign. Staff Presentation/Committee Member Questions: Todd Bennett presented the Agenda Report and answered Committee Members’ questions. Applicant: Anjanette Adams said creating a multitenant sign program has presented multiple challenges. She said one problem is the property contains two vastly differing storefronts. She said another challenge is the UPS signage does not meet current guidelines. Frank Donangelo, Vice President of Planning and Development for the Cannery Row Company, said he is looking for guidance and direction from the Architectural Review Committee. Public Comment: None. Committee Member Comments: Mr. Bennett said he believes that the Architectural Review Committee (ARC) has the ability to recognize that in some cases a multitenant sign program may not be the most appropriate or desirable approach; therefore the ARC has the ability to defer a multitenant sign program until there is a new tenant or UPS alters their current signage. 5 Architectural Review Committee Minutes Wednesday, March 20, 2013 Vice Chair Bartram asks if the awning can be removed to create continuity. In response to Vice Chair Bartram's Comment, Ms. Adams said the tenant would prefer to keep the awning. Committee Member Jacowbowsky said that an ideal solution would include signage that address both the pedestrians and cars through signage on awnings and smaller pedestrian oriented signs. Dawson concurs with Committee Member Jacoubowsky’s suggestion and said this would create greater symmetry between the storefronts. Mr. Bennett suggested that the applicant come back to the ARC for review of the awning sign for Amir’s Grill and Bar and formally acknowledge the postponement of the Multitenant Sign Program. The Committee concurred. COMMITTEE MEMBER COMMENTS None. INFORMATIONAL REPORTS & STAFF COMMENTS Mr. Bennett notified the Committee that the City Attorney was invited to the April 3, 2013 ARC meeting to provide opinion on the proposed cross on Josselyn Canyon Road.
