CONSENT ITEMS Approval of Minutes 2. July 15, 2020 Action: Approved as submitted. Staff Presentation/Committee Member Questions DocuSign Envelope ID: 29FA0A3B-D95C-4E81-A6E1-094F6B3E9618 Architectural Review Committee Minutes Wednesday, August 5, 2020 Senior Associate Planner Schmidt presented the Agenda Report and answered Committee Members’ questions. Committee Member Conner asked when the construction had begun and inquired as to how long the administrative review process would take had the proper process been followed and the notices been sent out. Senior Associate Planner Schmidt stated that construction began on June 29 or 30 and he shared photos showing the extent of the foundation work that had been completed before he received the call from Catherine Badin stating concerns. Schmidt explained that the process requires story poles to be posted for 10 days for notices to be mailed 10 days before the meeting. Schmidt further elaborated on the permit process and stated that construction can begin immediately, once permits are approved by both the Planning and Building Divisions. Applicant Dan Bird, the applicants’ son, called in on behalf of the applicants Carolee Bird and Mary Ellen Eglington. Mr. Bird explained that the applicants did their research to develop a design that would be the least impactful while fitting in with the existing neighborhood and provide private accessibility. Mr. Bird explained that the owners followed proper procedure and were unaware of any legal and architectural issues that would impede the project further. Lastly, Mr. Bird shared that his family looks forward to retiring in this community and fears that delaying the project further will cause financial hardship for the applicants and the delay may upset neighbors more. Public Comments Catherine Badin, the neighbor at 824 Lily Street, called in to share concerns about the project. Badin explained she moved to this property because she is a writer and needs a quiet neighborhood to work. Badin shared that the proposed project blocks views from both her first and second floors. Badin stated that she suffers from clinically diagnosed complex PTSD and a noise disorder which is why it is vital for her to live in a quiet neighborhood. Lastly, Badin voiced concerns for construction taking place during a time when COVID-19 cases are rising and people are sheltering in place. Badin stated that since neighbors weren’t given proper notice, she is in the position of having to pack up her belongings and move. Badin requested that the project be delayed until COVID-19 cases have subsided. Cynthia Smitland, the neighbor at 832 Lily Street called in to share concerns based on what she has observed. Smitland understands the homeowners have the right to expand but the noise would be difficult to deal with while sheltering in place. Smitland explained Badin has a reversed floor plan and the project is near the main floor and would impact Badin’s views. Smitland also stated Badin is sensitive to noise and expressed concerns that Badin would be dealing with the noise as well at her residence. Committee Member Comments Committee Member Rath spoke in favor of the project. Rath stated that the proposed project is reasonable, fits in the neighborhood well and has minimal impact. Rath said that she understands the neighbors’ concerns but explained that other construction is going on nearby. Committee Member Conner supported the project stating that this is a modest addition. Conner empathized with neighbor noise concerns and the difficulties with the noticing but surmised that the noticing would not have changed the outcome, nor delayed the project. On a motion by Committee Member Tregenza, seconded by Committee Member Hunter, and carried by the following vote, the Architectural Review Committee approved 816 Lily Street; Architectural Review Application ARP-19-0306 to allow 1st Story Addition and Deck. AYES: 6 MEMBERS: Carter, Bluth, Conner, Hunter, Rath, Tregenza NOES: 0 MEMBERS: None ABSENT: 1 MEMBERS: Pauly ABSTAIN: 0 MEMBERS: None RECUSED: 0 MEMBERS: None COMMITTEE MEMBER COMMENTS Committee Member Rath shared that her term is expiring and that she has decided to not reapply. Rath stated she has enjoyed her time on the Architectural Review Committee working with the committee members, the public and city staff. Chair Carter shared that she is giving her commission stipend back to the city and contributing it to the Reopen and Rehire Fund to assist in rehiring city staff. Chair Carter encouraged other committee members to do the same and feels this is an important gesture during these unprecedented times. Committee Member Tregenza inquired about the meeting procedures and asked why there is no comment period between the motion and the vote. Tregenza shared that he has served on other commissions and boards where there is typically a discussion or option to comment between the motion and the vote. Principal Planner Flower responded to Committee Member Tregenza’s question and shared the meeting procedures with the board. Flower explained that in the procedures they do have the option and ability to have a discussion period after the motion and before the vote. Flower suggested making this option clear for future meetings. Chair Carter said she is happy to follow the method of motion, second, discussion, and then vote but had been going straight to the vote since her predecessors had used that meeting format. Committee Member Hunter suggested asking for any further comment after second and before vote. Committee Member Conner asked about the 415 Spencer appeal and why that appeal is going to the City Council since the project was approved by the Architectural Review Committee and the Planning Commission. Principal Planner Flower explained that Planning Commission decisions can be appealed to the City Council and the appeal has been scheduled for the City Council meeting on 9/1. Senior Associate Planner Schmidt shared that Architectural Review Committee Members can call in and share comments. Cole mentioned that Committee Members may express individual opinions as individuals. INFORMATIONAL REPORTS & STAFF COMMENTS Update received. Principal Planner Flower shared that boards and commissions including the Architectural Review Committee, the Building and Housing Appeals Board and the Disabled Access Appeals Board are looking for members. Flower explained board and commission applicants can apply online or mail an application to the City Clerk’s office. Planning Office Update ADJOURNMENT ADJOURNMENT — The general policy of the Architectural Review Committee is that the Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no later than 11:00 p.m. Any public agenda items that have not been completed within the designated adjournment time may be formally extended by the Committee, or continued to the next regularly scheduled Architectural Review Committee Meeting, or continued to a Special Meeting. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Committee on any Agenda items. The Chair will formally open the floor for public comment. However, if you wish to speak to items during "Consent Agenda" or "Staff Informational Report," please advise the staff or the Chair prior to the action on that item and you will be recognized.
