DocuSign Envelope ID: BB39D805-4E90-492C-B3E6-6DDFFC1E5B81 Architectural Review Committee Minutes Wednesday, May 5, 2021 Staff Presentation/Committee Member Questions Interim Principal Planner Roveri presented the Agenda Report and answered Committee Member questions. Committee Member Tregenza asked if this would be the second permit extension for the project and if the extension would be for two years. Roveri explained the project was approved in 2017 and the first permit extension was in 2019. Roveri also confirmed that this would be the second permit extension and the permit would be extended for two years. Chair Carter asked if there is a limit on the number of extensions an applicant can request. Roveri confirmed there are no limits on the amount of permit extensions in the City Code and the applicant just needs to submit a request prior to the permit expiration date. Committee Member Ostovar asked about the purpose of having a limit on a permit and requiring an extension. Roveri explained the City Code does not specify the purpose of the permit extension, but the staff needs to confirm the conditions of approval are still valid and the project is still consistent with the documents used to approve the permit. Roveri further clarified that two years is the standard timeline for permits to be valid. Committee Member Schmidt asked if a permit is still valid if regulations change between the approval date of the permit and the permit extension. Roveri explained that the permit is subject to the previous regulations if it is still valid. Roveri also noted that the permit extension period is the opportunity to see if the project is still consistent with the City and neighborhood vision. Applicant Presentation Owner/Applicant Steven Platt presented and answered Committee Member questions. Platt explained due to COVID-19 related financial issues they need to extend the permit. Committee Member Pauly asked if future permit extensions could be put on the consent agenda. Interim Principal Planner Roveri stated she would inquire about this for future permit extensions. Chair Carter asked about the N. Fremont bike lane project and the grand jury recommendation that future items related to this project be reviewed by the ARC beginning August 1, 2021. Roveri stated she was not familiar with the article and could not comment at this time. Committee Member Tregenza asked about a spam email to ARC members and if anyone else saw that email. Other Committee Members confirmed they received the email and deleted it. Planning Office Update ADJOURNMENT ADJOURNMENT — The general policy of the Architectural Review Committee is that the Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no later than 11:00 p.m. Any public agenda items that have not been completed within the designated adjournment time may be formally extended by the Committee, or continued to the next regularly scheduled Architectural Review Committee Meeting, or continued to a Special Meeting. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Committee on any Agenda items. The Chair will formally open the floor for public comment. However, if you wish to speak to items during "Consent Agenda" or "Staff Informational Report," please advise the staff or the Chair prior to the Architectural Review Committee 5/5/2021 4:00:00 PM 2 action on that item and you will be recognized. Notification as much in advance as possible is appreciated. Information distributed to the Committee at the meeting becomes part of the public record. A copy of written material, pictures, etc. should be provided to the Secretary for this purpose.
