Chair Brassfield called the meeting to order at 3:00 p.m.

PUBLIC HEARING
1. Consider 188 Via Gayuba and Monterey Peninsula Unified School District
Assessor's Parcel Number 001961026000; Lot Line Adjustment Application SD-21-
0042 to Adjust the Lot Lines between the Existing Lots at 188 Via Gayuba and APN
001961026000; Applicant Jeffrey Moir; Owners Jeffrey and Kimberly Moir and
Monterey Peninsula Unified School District; R-1-6 and R-1-20 Zoning Districts; Low
Density Residential and Public/Semi-Public General Plan Land Use Designations;
Exempt from CEQA per Article 19, Section 15305, Class 5
Action: Approved as submitted.
Staff Presentation/Committee Member Questions
Interim Principal Planner Roveri presented the Agenda Report and answered Committee
Member questions.
Chair Brassfield asked about Section 54221 B1 of the Government Code where it states that
prior to any transfers of property from a school district there must be a meeting stating such a
transfer was approved. Brassfield asked if a whereas section could be added to the resolution
noting the date this transfer was approved by the school district. Brassfield also inquired if staff
found any findings in their research which noted this was a requirement.
Interim Principal Planner Roveri explained that she had looked up Government Code Section
54221 B1 and it stated that, “’Surplus land’ means land owned in fee simple by any local agency
for which the local agency’s governing body takes formal action in a regular public meeting
declaring that the land is surplus and is not necessary for the agency’s use.” Roveri clarified
that MPUSD had declared that land as surplus and not needed for their use.
Brassfield followed up and asked if that should be noted as a whereas section of the resolution
along with the date of that action.

Roveri noted she did not attend the school district meeting to confirm this was stated but would
refer to the meeting to see if the statement about surplus land was mentioned. Roveri said this
information could be included as a condition of approval if the statement was not made during
the school district meeting.
Applicant Presentation
Owner/Applicant Jeff Moir presented and answered committee member questions.
Public Comments
Terry Latasa spoke in favor of the project. Latasa explained he had been working with the owner
on one story additions to his home and explained the neighborhood supports the project and
that a second story addition would cause several view impacts. Latasa noted the school board
did approve the sale and that the fourth whereas on sheet one of the formal purchase and
resale agreement between the owner and the school district does note government code
sections about surplus land.
Committee Member Comments
Harty spoke in favor of the project and commented on how well the applicant has worked with
his neighbors to notify them of this project.
Brassfield complimented the applicant and how well the applicant made the effort to work with
neighbors and avoid view impacts. Brassfield also noted the public support for the project and
appreciated Terry Latasa’s comment and the information he shared. Brassfield did ask if a
whereas section could be added to the resolution to note when the project was heard and
approved by the school district.
Community Development Director Cole noted the surplus land act finding is a finding that the
school district must make. Cole confirmed that Mr. Latasa was correct, and the purchase and
sale agreement stated that according to Government Code 54211, if a parcel is smaller than
5,000 square feet it is exempt from surplus property requirements and the formal finding has
been found in the school district resolution.
On a motion by Chair Brassfield, seconded by Committee Member Harty and carried by
the following vote, the Minor Subdivision Committee approved 188 Via Gayuba and
Monterey Peninsula Unified School District Assessor's Parcel Number 001961026000; Lot
Line Adjustment Application SD-21-0042 to Adjust the Lot Lines between the Existing Lots
at 188 Via Gayuba and APN 001961026000.

PUBLIC COMMENTS
PUBLIC COMMENTS. At this time, the public may speak for a maximum of three minutes
on any subject which is within the jurisdiction of the Monterey Planning Commission and
which is not on the agenda. Any person or group desiring to bring an item to the attention
of the Commission may do so during Public Comments or by addressing a letter of
explanation to the Commission, City Hall, Monterey, CA 93940. Public Comments are
taken during the afternoon session and continued at the evening session. Individuals
may choose to speak once for up to three minutes at either session, but not both.

PUBLIC HEARINGS are required by law for certain actions. You are welcome to offer
your comments after being recognized by the Chair. The Chair may limit the time

announcement or make a brief report on his or her activities. In addition, a Committee
Member may provide a referral to staff or other resources for factual information, request
staff to report back to the body at a subsequent meeting concerning any City matter, or

ADJOURNMENT
ADJOURNMENT — The general policy of the Minor Subdivision Committee is that the
Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no
later than 11:00 p.m. Any public agenda items that have not been completed within the
designated adjournment time may be formally extended by the Committee, or continued
to the next regularly scheduled Minor Subdivision Committee Meeting, or continued to a
Special Meeting.
Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office,
or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the
meeting.
Members of the public have the right to address the Committee on any Agenda items. The Chair will
formally open the floor for public comment. However, if you wish to speak to items during "Consent
Agenda" or "Staff Informational Report," please advise the staff or the Chair prior to the action on that
item and you will be recognized. Notification as much in advance as possible is appreciated.
Information distributed to the Committee at the meeting becomes part of the public record. A copy of
written material, pictures, etc. should be provided to the Secretary for this purpose.
Minor Subdivision Committee decisions may be appealed within ten (10) days from the date of the
decision on forms available in the Planning Division during business hours. When the tenth day falls
on a weekend or a holiday, the appeal deadline date is the next working day following the holiday or
