Brown Act, Calif. Government Code section 54953(e)(1)(C) and Resolution No. 22-063 C.S. CALL TO ORDER Vice Chair Hunter called the meeting to order at 4:00 p.m. and Recording Secretary Barrera provided information to the public about how to participate by calling in to give public comment on the live web meeting. CONSENT ITEMS Approval of Minutes 2. June 15, 2022 Action: Approved as amended. Vice Chair Hunter and Committee Member Carter abstained from the minutes due to absence from the June 15, 2022 Architectural Review Committee meeting. Committee Member Ostovar noted Committee Member Pauly’s vote was not added into the final vote count for item 6. On a motion by Committee Member Tregenza, seconded by Committee Member Ostovar, and carried by the following vote, the Architectural Review Committee approved the June 15, 2022 minutes as amended: AYES: 3 MEMBERS: Ostovar, Schmidt, Tregenza NOES: 0 MEMBERS: None ABSENT: 2 MEMBERS: Bluth, Pauly ABSTAIN: 2 MEMBERS: Hunter, Carter RECUSED: 0 MEMBERS: None PUBLIC COMMENTS None. Consider 165 Via Gayuba; Application ARP-22-0062 for Preliminary and Final Architectural Review of a Second-Story Addition and Setback Variation at an Existing Single-Family Residence; Applicant Salvador Jorgensen; Owner Salvador Jorgensen and Cheryl A Logan Trs.; R-1-8 Zoning District; Low Density Residential General Plan Land Use Designation (Exempt from CEQA per Article 19, Section 15301, Class 1) (Continued from June 15, 2022, Architectural Review Committee Meeting) ACTION: Approved with Conditions Application ARP-22-0062 for Preliminary and Final Architectural Review of a Second-Story Addition and Setback Variation at an Existing Single-Family Residence at 165 Via Gayuba. Staff Presentation/Committee Member Questions Associate Planner Buggert presented the Agenda Report and answered Committee Members’ questions. Committee Member Tregenza asked what the height from the base of the garage to the peak of the roof is and what the overall height limits for roofs are. Mr. Buggert stated the height is 21’-5” and the overall height limit is 25 feet. Vice Chair Hunter questioned if there are fire safety or code concerns with the chimney being lower than the roof ridge line. Principal Planner Roveri answered chimneys are exempt from maximum building height requirements and if it needs to be adjusted, it will be addressed at the building permit stage. Committee Member Ostovar suggested the possibility of adding style conditions to the chimney if it needs to be heightened at the building permit stage. Ms. Roveri confirmed that if the chimney needs to be changed, a condition can be added that the material and look must be the same. Applicant Salvador Jorgensen, applicant explained the purpose of the project and noted he has worked with his neighbors to create a low impact design that ties in with the spirit of the neighborhood. Public Comments None. Committee Member Comments Committee Member Tregenza shared the project is a nice addition and commended the applicant for working with their neighbors. Confirm Annual Appointments for Chair and Vice Chair (Not a Project under CEQA per Article 20, Section 15378 and under General Rule Article 5, Section 15061) ACTION: Confirmed Ed Hunter as Chair and Patrick Tregenza as Vice Chair. Staff Presentation/Committee Member Questions Principal Planner Roveri presented Agenda Report and answered Committee Member questions. Public Comments None. Committee Member Comments None. On a motion by Committee Member Carter, seconded by Committee Member Schmidt, and carried by the following vote, the Architectural Review Committee confirmed annual appointments for Chair and Vice Chair: AYES: 5 MEMBERS: Hunter, Carter, Ostovar, Schmidt, Tregenza NOES: 0 MEMBERS: None ABSENT: 2 MEMBERS: Bluth, Pauly ABSTAIN: 0 MEMBERS: None RECUSED: 0 MEMBERS: None INFORMATIONAL REPORTS & STAFF COMMENTS Ms. Roveri addressed the Architectural Review Committee’s (ARC) previous request for an updated ARC submittal checklist, lighting standards for signs, and tree protection standards. Ms. Roveri said she is working with Mr. Buggert to place recommendations for updates to ARC checklist and will bring them forward at the next meeting. Ms. Roveri stated the lighting standards for signs is a bigger project and ordinances to comply with new state standards for SB35 and SB9 take priority. Ms. Roveri stated that the Planning office does not have the authority to request that the Parks and Recreation Department present on Tree Protection Standards. Planning Office Update ADJOURNMENT ADJOURNMENT — The general policy of the Architectural Review Committee is that the Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no later than 11:00 p.m. Any public agenda items that have not been completed within the designated adjournment time may be formally extended by the Committee, or continued to the next regularly scheduled Architectural Review Committee Meeting, or continued to a Special Meeting. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Committee on any Agenda items. The Chair will formally open the floor for public comment. However, if you wish to speak to items during "Consent Agenda" or "Staff Informational Report," please advise the staff or the Chair prior to the action on that item and you will be recognized. Notification as much in advance as possible is appreciated. Information distributed to the Committee at the meeting becomes part of the public record. A copy of written material, pictures, etc. should be provided to the Secretary for this purpose. Architectural Review Committee decisions may be appealed within ten (10) days from the date of the decision on forms available in the Planning Division during business hours.
