Chair Hunter called the meeting to order at 4:00 p.m. Recording Secretary Barrera provided
information to the public about how to participate by calling in to give public comment on the live
web meeting.

condition that prior to building permit final inspection, the applicant shall
complete all replacement tree plantings and/or establish a plan to mitigate the
removal of 318 protected trees at a ratio of three replacements for one
removal. Mitigation may be done in the form of on-site plantings, off-site
plantings, payment in lieu of replacement, and/or payment in lieu of
maintenance should the applicant choose not to directly maintain
replacement trees.
Staff Presentation/Committee Member Questions
Senior Associate Planner Schmidt presented the Agenda Report and answered Committee
Members’ questions.
Vice-Chair Tregenza asked for clarification on the tree replacement ratio. Mr. Schmidt
confirmed up to a 3:1 replacement ratio can be required. Mr. Schmidt asserted the tree
planting plan appears to be dense but suggested referring to the project architect.
Committee Member Ostovar asked if the City considered off site tree planting and or
charging a fee for tree removal. Mr. Schmidt answered that on-site replacement is preferred
because it is easier to monitor and maintain. Mr. Schmidt said fees would be applied if City
Code requires them.
Applicant
Steve Gonsalves, architect, shared details of the arborist report. Mr. Gonsalves stated
underground parking would disrupt the equivalent area and they are proposing to remove
less trees than originally planned in 2002. Mr. Gonsalves asserted that on-site planting other
than a few trees is not realistic because the area is overcrowded.
Committee Member Ostovar asked for clarification on location of tree preservation plan. Mr.
Gonsalves shared a map of the parking lot and tree restoration area.

Lorna Moffat spoke against the project and suggested finding other options than removing

300 trees.
Caitlin Richardson spoke in support of Ms. Moffat’s comment and stated she will wait until
after this item to provide further comment.
Nina Beety, spoke against the project and suggested an evaluation that was done in 2002 is
missing the environmental urgency that we are being faced with today.
Committee Member Comments
Vice-Chair Tregenza suggested some thinning could be done but suggested removing that
many trees is unnecessary. Vice-Chair Tregenza reiterated that it is not 2002 and we must
step back and look at other alternatives.
Committee Member Schmidt asked when the arborist report was completed. Mr. Schmidt
answered towards end of 2022.
Committee Member Ostovar stated these situations are difficult and the designers did a good
job, given the parameters. Committee Member Ostovar suggested revisiting policies and
questioned if it’s worth asking the Planning Department to give stricter parameters.
Vice-Chair Tregenza made a motion to approve preliminary and final architectural review
only. Ms. Roveri suggested that the ARC could exclude the parking lot and tree removal
permit.
Committee Member Ostovar asked if there is room for any discussion with the Planning
Department and what would the Planning Department recommend. Ms. Roveri shared
mitigation measures from the Tree Preservation Ordinance.
Mr. Schmidt added that the project was planned a number of years ago and the plan was to
always remove the trees; however, there is more landscaping and open space proposed
than the original plan.
Community Development Director Cole shared there is a Subdivision Map that the City
approved called a Vesting Tentative Map that approved the overall project.
Vice-Chair Tregenza withdrew his motion.
Committee Member Ostovar questioned if the project isn’t approved, is there further options
for aggressive enforcement of tree replacement numbers and fees. Ms. Cole answered that
the ARC can request specific replacement ratios.
Vice-Chair Tregenza expressed disappointment that there isn’t more that the ARC can do
and doesn’t understand the need for continually building more parking lots as the need for
cars will hopefully decline.
Ms. Schmidt asked for clarification on the parking requirements. Ms. Cole stated it is based
on the Municipal Code requirements and the parking ratio was met. Ms. Roveri added they
were required to provide a minimum of 837 parking spaces for the entire complex.
Chair Hunter asked for a motion. Ms. Roveri suggested separating the approvals, off site
planting, and/or charging a fee.

Mr. Gonsalves offered to explain how underground parking does or does not preserve trees.
Committee Member Ostovar stated it is not clear why underground parking or off-site
planting wasn’t initially sought out. Ms. Cole said if the Committee is leaning toward a
mitigation requirement of 3:1, the ARC can approve the project with that condition and staff
can work with the applicant.
Committee Member Ostovar made a motion to approve the project with the condition that the
removal of 318 trees has a replacement ratio of 3:1, on-site or off-site plantings, and fees in
lieu of planting and/or maintenance.
Ms. Roveri asked if there was flexibility in the motion for providing less replacements than
the 3:1 replacement ratio and instead paying in lieu fees. Committee Member Ostovar
confirmed yes.
On a motion by Committee Member Ostovar, seconded by Chair Hunter, and carried by the
following vote, the Architectural Review Committee approved Architectural Review Permit
ARP-22-0177 for preliminary and final architectural review of a new medical office building

Committee Member Comments
Chair Hunter spoke in favor of the project and for the condition of approval for reduced
lighting. Committee Member Schmidt agreed and added it will look nicer from the
freeway. Vice-Chair Hunter agreed, as did Committee Member Ostovar.
Vice-Chair Tregenza made a motion to approve with the condition that applicant will work
with the planning staff to reduce the parking lot lighting.
On a motion by Vice-Chair Tregenza seconded by Committee Member Schmidt, and carried
by the following vote, the Architectural Review Committee approved Architectural Review
Application ARP-23-0026 for exterior alterations to an existing hotel property at 2600 Sand
Dunes Drive with the added special condition that the applicant shall work with staff to make
parking lot lighting changes for a dark sky solution with no visible glare on the nearby beach or
roadways:

ADJOURNMENT
ADJOURNMENT — The general policy of the Architectural Review Committee is that the
Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no later than
11:00 p.m. Any public agenda items that have not been completed within the designated
adjournment time may be formally extended by the Committee, or continued to the next regularly
scheduled Architectural Review Committee Meeting, or continued to a Special Meeting.
Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office,

Members of the public have the right to address the Committee on any Agenda items. The Chair will
formally open the floor for public comment. However, if you wish to speak to items during "Consent
Agenda" or "Staff Informational Report," please advise the staff or the Chair prior to the action on that
item and you will be recognized. Notification as much in advance as possible is appreciated.
Information distributed to the Committee at the meeting becomes part of the public record. A copy of
written material, pictures, etc. should be provided to the Secretary for this purpose.
Architectural Review Committee decisions may be appealed within ten (10) days from the date of the
decision on forms available in the Planning Division during business hours. When the tenth day falls
on a weekend or a holiday, the appeal deadline date is the next working day following the holiday or
