MINUTES CITY COUNCIL REGULAR MEETING CITY OF MONTEREY Tuesday, December 4, 2012 4:00 - 6:00 p.m. COUNCIL CHAMBER, FEW MEMORIAL HALL OF RECORDS MONTEREY, CALIFORNIA CALL TO ORDER Mayor Della Sala called the meeting to order at 4:00 p.m. ROLL CALL (2010-2012 City Council) Councilmembers Present: Councilmembers Downey, Haferman, Selfridge, Sollecito, Della Sala Absent: None City Staff City Manager, City Attorney, Director of Information Resources/City Clerk, Present: Assistant City Manager, Deputy City Manager, Plans & Public Works, Finance Director, Community Services Director, Police Chief, Fire Chief, Chief of Planning, Engineering, and Environmental Compliance COUNCIL INSTALLATION CERTIFICATION OF ELECTION RESULTS 1. Approve Resolution Declaring Canvass of Returns and Results – Consolidated General Municipal Election November 6, 2012 (Information Resources - 702-03) Action: Adopted Resolution No. 12-178 C.S. Information Resources Director/City Clerk Gawf gave the staff presentation. On a motion by Councilmember Haferman, seconded by Councilmember Sollecito, and carried by the following vote, the City Council adopted Resolution 12-178 C.S. declaring the Canvass of Returns and Results of the Consolidated General Municipal Election of November 6, 2012: AYES: 5 COUNCILMEMBERS: Haferman, Downey, Selfridge, Sollecito, Della Sala NOES: 0 COUNCILMEMBERS: None ABSENT: 0 COUNCILMEMBERS: None ABSTAIN: 0 COUNCILMEMBERS: None RECUSED: 0 COUNCILMEMBERS: None 2. Recognition of Councilmember Haferman (City Manager's Office - 701-01) Action: Recognized Councilmember Haferman Mayor Della Sala recognized Councilmember Haferman, thanked him for his service and contribution to the community, and presented him with a Monterey coffee table book and an etched crystal bowl. Vice Mayor Downey also thanked him for his contributions. Councilmember Haferman made brief comments, saying that he has enjoyed his time on the Council. 3. Installation of 2012-2014 Monterey City Council (Information Resources - 701-01) Action: Installed 2012-14 City Council  City Council Minutes Tuesday, December 4, 2012 Information Resources Director/City Clerk Gawf presented a report and swore in Councilmembers Downey and Haffa and Mayor Della Sala. Former Councilmember Haferman stepped down, and Councilmembers Downey and Haffa and Mayor Della Sala took their seats at the dais. 4. Appoint Vice Mayor for 2013 (Information Resources - 701-01) Action: Appointed Councilmember Selfridge as 2013 Vice Mayor Information Resources Director/City Clerk presented the staff report. On a motion by Mayor Della Sala, seconded by Councilmember Downey, and carried by the following vote, the City Council appointed Councilmember Selfridge as Vice Mayor for 2013: AYES: 5 COUNCILMEMBERS: Haffa, Downey, Selfridge, Sollecito, Della Sala NOES: 0 COUNCILMEMBERS: None ABSENT: 0 COUNCILMEMBERS: None ABSTAIN: 0 COUNCILMEMBERS: None RECUSED: 0 COUNCILMEMBERS: None ROLL CALL (2012-2014 City Council) Present: Councilmembers Downey, Haffa, Selfridge, Sollecito, Della Sala Absent: None PRESENTATIONS 5. Medal of Valor Award to Firefighter Neal Hurd (Fire - 501-01) Action: Presented Medal of Valor to Firefighter Hurd Mayor Della Sala presented the Medal of Valor to Firefighter Hurd, and Fire Chief Miller presented him a plaque in recognition of his bravery. Division Chief Goodwin gave Firefighter Hurd a message from Chief Goodwin's mother and presented Firefighter Hurd with his pin. Firefighter Hurd thanked the Council and City staff, accepted the award, and dedicated it to everyone he works with each day. City Manager Meurer thanked the Fire Department and other City Employees who serve the people, and he thanked their families as well. 6. Recognition of the 20th Anniversary of First Night Monterey (Recreation & Community Services - 302-02) Action: Presented Proclamation City Manager Meurer gave a brief history of First Night. Paulette Lynch thanked the City, and said that the volunteers are inspired by the response from the community. Ellen Martin, Executive Director for First Night, said that she loves to see the joy of the participants who come to First Night and she appreciates being a part of the night. Susan Briton, President, said that it is wonderful to see the activity Downtown at First Night. Fred Hernandez, first Board Member of First Night, remembered the very earliest celebration on Alvarado Street. Modify Resolution Number 12-174 to Include the Time and Place for the Public Hearing to Levy Assessments on Lodging Businesses within the Monterey County Tourism Improvement District (MCTID) (Finance - 407-08) Action: Adopted Resolution No. 12-180 C.S. Other 10. Approve Policies and Procedures Manual Revisions for the Neighborhood Improvement Program for Calendar Year 2013 ***NIP*** (Plans & Public Works - 808-01) Action: Approved 11. Approve Representatives and Alternates for the Neighborhood Improvement Program for Calendar Year 2013 ***NIP*** (Plans & Public Works - 701-04) Action: Approved ***End of Consent Agenda*** Mayor Della Sala adjourned the meeting to the Successor Agency of the RDA. 12. Authorize Transfer of Redevelopment Project Area Land Use Plans and Land Use Functions from the Successor Agency of the City of Monterey Redevelopment Agency to the City of Monterey (Plans & Public Works - 201-12) Action: Adopted SA/RDA Resolution No. 858 3  City Council Minutes Tuesday, December 4, 2012 On a motion by Councilmember Sollecito, seconded by Councilmember Downey, and carried by the following vote, the City Council adopted SA/RDA Resolution 858, authorizing the transfer of Redevelopment Project Area Land Use Plans and Land Use Functions from the Successor Agency of the City of Monterey Redevelopment Agency to the City of Monterey : AYES: 5 COUNCILMEMBERS: Haffa, Downey, Selfridge, Sollecito, Della Sala NOES: 0 COUNCILMEMBERS: None ABSENT: 0 COUNCILMEMBERS: None ABSTAIN: 0 COUNCILMEMBERS: None RECUSED: 0 COUNCILMEMBERS: None Mayor Della Sala adjourned the meeting to the Ocean View Community Services District. 13. Receive Ocean View Community Services District Quarterly Report (City Attorney - 706-09) Action: Received report On question, City Manager Meurer gave a brief update on the development, and gave an overview of efforts to insure that the Stohan's building is maintained. Chair Della Sala adjourned the meeting to the City Council. PUBLIC APPEARANCE 14. Provide Update on Monterey Peninsula Regional Water Authority and the Regional Water Project Action: Update given and discussed a. Presentation from Monterey Regional Water Pollution Control Agency on Ground Water Replenishment Action: Presentation given and discussed Mayor Della Sala presented an update on the progress of the Monterey Peninsula Regional Water Authority and the MPRWA TAC, giving a synopsis of the proposed water projects along with a history and outlined upcoming meetings and actions. Councilmember Downey reviewed the reasons the update is being presented at this time, saying that it is an educational opportunity, and clarifying that no action will be taken. Keith Israel, General Manager of Monterey Peninsula Water Pollution Control Agency, presented the MRWPCA Vision regarding recycled water use. City Attorney Davi summarized the governance issue associated with any water project, saying that the issue remains largely unresolved with respect to CalAm's proposed project. Councilmember Selfridge urged everyone to read the Herald's editorial regarding governance of the desal plant. Mayor Della Sala opened public comment on the item. George Riley voiced concerns regarding the hurdles that CalAm is facing, saying that the project has been delayed. He said that the ratepayer objections to CalAm’s financing proposal, which is unfair to the ratepayers, could cause further delay, and he supported having a contingency plan. Having no further requests to speak, Mayor Della Sala returned discussion to the dais. 4 City Council Minutes Tuesday, December 4, 2012 City Manager Meurer said that public ownership requires a financial source, and cities do not have the resources. Councilmember Downey said that supporting the Water Management District is vital in moving forward on this project. She said it is important that the cities participate in the governance of any project. Councilmember Sollecito said that if the State order goes into effect it would economically ruin the Peninsula, and he asked if the City should be putting energy into gaining some leniency with regard to the order. Mayor Della Sala agreed and said that the best way to gain leniency would be to remain united and continue to move forward on obtaining a project. Councilmember Haffa agreed, saying that the cities should speak with one voice, and the one voice should demand the cheapest water possible, which would be best achieved via public ownership. He suggested passing a resolution to that effect. PUBLIC COMMENTS Mayor Della Sala opened the floor for public comments on items not on the agenda. Nina Beatty voiced concerns about the government's past actions regarding bombing the moon, saying that is an example of how the government disregards the environment and acts in secrecy. She said that the government is currently releasing particles in the atmosphere, contaminating the air. Having no further requests to speak, Mayor Della Sala closed public comment. COUNCIL COMMENTS Councilmember Selfridge congratulated the Council, welcomed the new member and said that she would always remember her trip to Azerbaijan with Councilmember Haferman. Councilmember Downey thanked her campaign committee, noting that they supported her while she was unable to go door to door this year. She thanked her husband for his help and support. Councilmember Haffa thanked all of the people who helped him in his campaign, including his wife. He thanked the other candidates for the way their campaigns were conducted, saying that it was a productive season. Councilmember Sollecito spoke about the strong fabric of the community, noting the 82% turnout at the election. Mayor Della Sala agreed and thanked the citizenry. He urged people to contact the Council with their concerns and questions. CITY MANAGER REPORTS City Manager Meurer had no report.
