NS Aquarium Cooking for Solutions. She said that MHA has asked her to remind everyone about Merrienda. Thanked Mr. Peterson from MHS for bringing the students. Councilmember Downey said that she appreciates the work of the Advisory Committee who is working on the ballot measure. She reported that Alvarado Street property owners are graciously deciding to fund some security personnel and she appreciates it. Councilmember Haffa thanked the staff who helped support the AMGEN Tour. He said that it brought a lot of positive to Monterey. He thanked the City Manager, Councilmembers, and other staff for attending the MPC event where Dr. Gresaian was awarded... Mayor Della Sala echoed Mr. Haffa's comments on the AMGEN Tour, saying that it is a world class event that is broadcast in over 220 countries. He said that in discussions with the officials he is hopeful to have them back next year, possibly discussing starting and ending the tour here. PRESENTATIONS  City Council Minutes Tuesday, May 20, 2014 1. Recognition of Defense Language Institute Quarterly Joint Service Awards (City Manager - 701- 17) Action: Presented Proclamations to Private First Class Samuel Lindberg Mayor Della Sala and the City Council recognized Private First Class Samuel Lindberg, who made brief comments and thanked the council. 2. Recognize National Public Works Week (Plans & Public Works - 701-17) Action: Presented Proclamation Mayor Della Sala read a proclamation recognizing National Public Works Week, May 18 - 24, 2014. 3. Recognize MIIS Students for Financial Study of the Golden State Theatre (City Manager - 706- 07) Action: Recognized MIIS students Councilmember Selfridge introduced MBA faculty advisor Lou Panetta, who read the names of the MIIS students who produced the financial study. He noted how this project furthers the relationship between the City of Monterey and MIIS. Ms. Selfridge presented certificates for the students. Mayor Della Sala opened the floor for public comments. Nelson Vega voiced a concern about approving a ten-year lease rather than a five-year with a five-year option. Staff new building... Nelson Vega urged Council not to approve this request, saying that there is no information included as to why this increase is needed. Hunter Harvath, Assistant General Manager of MST, explained that MST has to have the consent of a majority of its thirteen jurisdictions, and they are merely asking for consent, not support. He said that it is a ministerial function in accordance with the legislation that formed the district. On question, he said that the tax would exclusively support the elderly, disabled and veterans in the community, as the funding is being discontinued for those programs. No further... On a motion by Councilmember Downey, seconded by Councilmember Sollecito, and carried by the following vote, the City Council approved the Request from Monterey-Salinas Transit to place a County-wide sales tax measure on the November 4, 2014 Ballot: Councilmember Haffa asked to amend the motion to add a clause that the City specifically is not endorsing this measure. Councilmember Downey added a clause, "The City Council is not taking a position on the measure at this time." to the motion and the seconder agreed. Councilmember Selfridge said that because she opposes all tax increases she would not support the motion, and Councilmember Downey responded that since this is for disabled, veterans, for which the funding is going away, she supports it. Authorize Professional Services Agreements with RRM Design Group for On-Call Planning Services and Preparation of the Villa del Monte Neighborhood Revitalization Plan and with Kimley-Horn Associates for On-Call Planning Services (Plans & Public Works - 201-12) 4  City Council Minutes Tuesday, May 20, 2014 Action: Adopted Resolution No. 14-101 C.S. (5-0) and Resolution No. 14-102 C.S. (4-1; Selfridge voting no) Councilmember Selfridge asked to separate the $75,000 Revitalization Plan to go through now, with the on call services, if needed, and to delay the rest of the action until the new Deputy City Manager of Plans and Public Works is on board. Mayor Della Sala disagreed, saying that this action sets aside the money in case it is needed, and it would not be spent if it is not needed. Councilmember Sollecito said that he believes that consultants are needed at this time and that the NIP Subcommittee had agreed with NIP representatives to move forward with this action. Chief of Planning Rerig read a list of NIP projects for which the consultants could be used, but those projects are yet to be approved by Council. Assistant City Manager Uslar explained that this action does not spend any money or appropriate any funds, but that would occur as the projects come forward. Councilmember Selfridge siad that she feels that we need to move foward with hiring a dedicated staff person for NIP. Community Services Director Bui Burton presented a staff report, explaining the difference between this assessment and the City of Monterey's TOT contribution, and answered 5  City Council Minutes Tuesday, May 20, 2014 Councilmembers' questions. Mayor Della Sala opened the floor for public comment. Nelson Vega said that he attended Monday's meeting and all of the people on the committee are intelligent and he believes they will do a good job. He said that they are not getting the full history of how the City got to the current situtation. He said that he only had three minutes to give another perspective. He asked Council to appoint him as a non-voting member. Councilmember Downey agreed that Mr. Vega has a good background, and it is important to hear that perspective. City Attorney Davi gave some options.Councilmember Selfridge asked to agendize adding a non-voting member. Councilmember Haffa said that the City Manager's suggestion to allow Mr. Vega to give a presentation... Henry Ruhnke said that he grew up in San Jose, and had his bicycle stolen when he was young. He said that when he moved to Monterey he thought that this was an extrememly safe community. He reported that in the last five years, he has had his car broken into four times, one car was stolen, and he reported other similar incidents. He said that he looked at the police logs, and in the past month there has been 46 burglaries. On question, Mr. Ruhnke gave additional details 6  City Council Minutes Tuesday, May 20, 2014 from the police logs. On question, Police Chief Penko said that there has been a burglarly spike since 2011 when prison realignment occurred. He reviewed several steps that have been taken to respond to the situation and protect the community. Marleen Huckleberry said that she is available to open a shelter in the old Outdoor World building on Fremont Street. She said that federal funds are available for this purpose. She said that the facility could provide medical care along with temporary housing. Raul Pantola, Monterey Fire Association and MFFA, invited Council to a free outdoor moving event on Colton Hall Lawn on June 13th. Having no further requests to speak, Mayor Della Sala closed public comments. Mayor Della Sala opened the floor for comments on the closed session items. Nelson Vega asked the Council to find another way to conduct labor negotiations rather than having employees represent the Council and conduct the negotiations. Council adjourned to closed session at 5:12 p.m. Mayor Della Sala reconvened the meeting at 7:00 p.m. PUBLIC APPEARANCE 18. First Review of Recommended Neighborhood Improvement Program (NIP) Projects for FY 2014/2015 ***NIP*** (Plans & Public Works - 406-03) Action: Declined to fund the David Avenue open space project and provided guidance that they agreed with the other recommended projects Interim NIP Coordinator Francis presented the staff report and answered Councilmembers' questions. Councilmember Downey said that she is concerned about the threat of fire, and she believes that fuel reduction should be a high priority. She asked if there is adequate funding for maximum fuel reduction. Staff said that there are adequate funds. Ms. Downey voiced concerns that there is no alternate for Alta Mesa on the NIP and the representative has to travel out of town and sometimes cannot attend the meeting. She referenced a handout she compiled that shows the distribution of NIP funds over the years and asked that staff prepare a spreadsheet each year that tracks the past ten years of NIP funding. Councilmember Haffa said that if funding is broken down per neighborhood, it would be important to look at per capita figures. He asked how staff would handle the maintenance and potential hazards on the David Avenue property if the City does not aquare the property, and Mr. Rerig said that there is a process in place to work with the property owner. Councilmember Selfridge voiced concerns that staff did not raise objections to the David Avenue property until after it had been approved by NIP. Mayor Della Sala opened public comment to the NIP Spokesperson. Sharon Dwight, NIP Alternate Spokesperson, said that it is up to the individual neighborhood association to get a volunteer to serve as an alternate. She said that there is a vetting process for these projects, and the committee is asking staff for clarification of any restrictions during that process. She 7 City Council Minutes Tuesday, May 20, 2014 said that NIP is currently funding almost all of the greenbelt maintenance, and the David Avenue would be the same as other greenbelt areas. She said that all greenbelt areas will require a CEQA review before any fuel reduction can occur. Councilmember Sollecito expressed concern about purchasing a parcel that will always remain open space and that will create a liability to the City. On question, Mr. Harari said that the property is too steep to be buildable. Having no further requests to speak, Mayor Della Sala closed public comment. Mayor Della Sala complimented the NIP Committee for an outstanding job. He said that he would have an issue with purchasing the David Avenue open space and taking on liability for no significant benefit. Councilmember Haffa suggested setting aside unallocated funds toward fuel reduction, and staff said that it would be posible if the NIP chose to do so, but normally the money rolls over to the next year or used to fund cutoff projects. On question, Ms. Dwight said that the $26,000 ending balance goes to the next cutoff project and she does not recommend changing that process. On a motion by Councilmember Della Sala, seconded by Councilmember Sollecito, and carried by the following vote, the City Council declined to fund the David Avenue open space project and provided guidance that they agreed with the other recommended projects. [go to item 19] ***Adjourn to Closed Session*** Council will adjourn to closed session no later than 5:00 p.m. * No discussion of a new item will be started after 10:30 p.m. ANNOUNCEMENTS FROM CLOSED SESSION Information Resources Director/City Clerk Gawf announced that in a conference with real property negotiators regarding property located at 1187 Del Monte Avenue--Mohr Motors--there was a unanimous roll call vote where the City Council gave confidential direction to their negotiators: Hans Uslar, Chip Rerig, Rick Marvin and Janna Aldrete regarding price and 8  City Council Minutes Tuesday, May 20, 2014 terms of the lease. WATER UPDATE Mayor Della Sala said that the Executive Director of the Water Authority is on vacation. He gave a brief update and reported that Cal Am, the Monterey County Water Resources Agency, and the Monterey Peninsula Water Authority would meet this Friday. He opened the floor for public comment. Nelson Vega asked what would happen if a judge rules the previous project and agreements are valid. He asked if source water has been identified for GWR. Having no further requests to speak, Mayor Della Sala closed public comment. Councilmember Downey reported that the source water for GWR is under negotiations and she believes it will take an arbitration process. She said that she is hopeful that an agreement will be complete by June. Mayor Della Sala said that he cannot answer the question at this time. [Item 18 goes here] CONTINUED PUBLIC COMMENTS Mayor Della Sala reopened the floor for public comments on items not on the agenda. Nelson Vega said that he attended a previous meeting where the Council was discussing their mission and goals. He suggested that the Council needs to set benchmarks and a direction for the new City Manager. He asked Council to prioritize that, and suggested that one such benchmark might be to direct the City Manager to bend the cost of government by 2 percent. Receive Monterey County Convention and Visitors Bureau's 2013-2014 Destination Marketing Report (Public Facilities - 307-04) Action: Received and discussed report Tammy Blount, President and CEO of MCCVB, presented the report and answered Councilmembers' questions. Mayor Della Sala opened public comment on the item. Jim Hekkers, Managing Director of the Monterey Bay Aquarium and Board Member of the CVB, supported the program saying that they are focusing on the group market. He said that the City's investment in that market gives an excellent return and is the right business decision. Rene Boskoff, General Manager of the Monterey Marriot spoke in support of funding the CVB. Rick Aldinger, General Manager of the Big Sur River Inn, said that his organization understands the value of the CVB and the partnership with Monterey. Receive Report and Provide Direction on Request from Wharf No. 1 Concession #33 Lessees Mary Alice Cerrito Fettis and Gloria Brown to Approve a 20-Year Extension of Lease (Gilbert’s Restaurant Building at 30 Fisherman’s Wharf) (Plans & Public Works - 206-03) Action: Received report; adopted Resolution No. 14-105 C.S. Property and Housing Manager Marvin presented the staff report and answered Councilmembers' questions. Mayor Della Sala opened public comments on the item. Mary Alice Cerrito Fettis and David Brown, representing his parents, said that this is an opportunity to make some upgrades on the Wharf, and he asked Council to approve the matter. Mayor Della Sala opened the floor for public comment, had no requests to speak, and returned the discussion to the dais. On a motion by Councilmember <MOVER>, seconded by Councilmember <SECONDER>, and carried by the following vote, the City Council ______ed the Review and Discuss Improved Cost Recovery Options and the Five Year Update Required for Planning Fees, as Part of the 2014/15 Budget: Councilmember Downey expressed concerns regarding some of the fees, as well as the 40% overhead figure. She said that she would prefer to phase the increases in. She asked to continue the item to see if any feedback is received. On question, Chief of Planning Rerig said that the development community was notified. Ms. Downey asked to have a chart that shows the old charge compared for each fee. Review the City's Sign Ordinance (Monterey City Code section 34-1 et seq.) and Provide Direction on Whether to Revise the Regulations Applicable to Signs on City Property (City Attorney - 701-15) Action: Directed the City Attorney... (4-1; Haffa voting no) City Attorney Davi presented the staff report and answered Councilmembers' questions. Chief of Planning Rerig reviewed a map showing City open space and city-owned properties. [Ban all ground mounted or temporary signs on City property] Councilmember Haffa said that he has concerns regarding these types of regulations giving an advantage to more well-funded campaigns, and he could support time limits. It was moved by Councilmember Downey, and seconded by Mayorr Della Sala, to direct the City Attorney to come back with an Ordinance banning ground-mounted temporary signs on City property. He said that the Library Board has appointed Inga Waite as Interim Library Director. He reported that Fire crews have safely returned from the fires down south. On question, he said staff is looking into a reported incident involving a street sweeper. Council adjourned to closed session at 10:02 p.m. ANNOUNCEMENTS FROM CLOSED SESSION Information Resources Director/City Clerk Gawf reported that the City Council gave confidential 11 City Council Minutes Tuesday, May 20, 2014 direction to their negotiators on a 4-1 roll call vote, with Selfridge voting no, in a conference with labor negotiators Michele Maloney and Debbie Jones regarding the Monterey Fire Fighters Association and the Monterey Chief Officers Association.
