MINUTES CITY COUNCIL REGULAR MEETING CITY OF MONTEREY Tuesday, December 5, 2017 4:00 p.m. - 5:30 p.m. FEW MEMORIAL HALL OF RECORDS, 580 PACIFIC STREET MONTEREY, CALIFORNIA Councilmembers Present: Councilmembers Albert, Barrett, Haffa, Smith, Roberson Absent: None City Staff City Manager, City Attorney, Director of Information Resources/City Clerk, Present: Assistant City Manager, Police Chief, Community Services Director, Finance Director, Human Resources Director, Library Director, Acting Community Development Director, Acting Public Works Director, Principal Planner, Associate Civil Engineer, Property Management Administrative Analyst, Sustainability Coordinator CALL TO ORDER Mayor Roberson called the meeting to order at 4:00 p.m. PLEDGE OF ALLEGIANCE Mayor Roberson led the Pledge. PRESENTATIONS 1. Presentation by Museum and Cultural Arts Commission (Not a Project under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) (Library - 308-02) Action: Received report Museum and Cultural Arts Commission Chair Castagna presented the report and answered Councilmembers' questions. 2. First Night Monterey 25th Anniversary Celebration (Not a Project under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) (City Manager - 701-17) Action: Presented proclamation Ellen Martin, Executive Director of First Night, said this year's theme is "Celebrate the Magic," and she gave a brief history of the event's twenty-five years. She introduced Paulette Lynch, Founder of First Night Monterey, who recounted the beginning of the celebration in Monterey and thanked the volunteers. Susan Brenton told of her first experience at First Night Monterey, thanked Ms. Lynch, and invited everyone to attend. Mayor Roberson recognized former Mayor Dan Albert, who was in the Chamber, and presented a proclamation to Ms. Martin. PUBLIC COMMENTS Mayor Roberson opened public comments on items not on the agenda. Judy Karas, Monterey resident, said that it is wonderful to see the young students in attendance from Monterey High School. She reported that International Campaign to Abolish Nuclear Weapons (ICAN) will receive the Nobel Peace Prize. She asked Monterey consider agendizing joining Mayors for Peace. Luis Osorio spoke about the healthy communities issue as it relates to urban planning. He said that diabetes is an issue of health and noted that a new candy store just opened at the  City Council Minutes Tuesday, December 5, 2017 Wharf. He suggested that before the City leases a building to someone, they ask what the business is. Michael Baer reiterated his concerns regarding the permits for the pipe bridge and said he is worried about safety during the installation. He asked that the City require a traffic study. Rick Johnson thanked the Council and Community Services Director Bui-Burton for making the Christmas tree lighting a real Monterey event. Nina Beety said it is difficult to hear speakers in the back of the Chamber. She voiced concerns that Verizon has proposed to place cell towers near the high school. She submitted documents for the record and asked the public to get involved in opposing the project. Lorna Moffett agreed with the previous speaker. She reported on an article about a lawsuit that urges California to protect whales from Dungeness crab gear and asked everyone to boycott the crab industry because of whale entanglements in the traps. Sharna Stewart voiced concerns regarding vines climbing and overcoming pine trees. She urged trimming the vines to keep the trees healthy and help fight global warming. With no further requests to speak, Mayor Roberson closed public comments. CONSENT ITEMS On question, Mayor Roberson opened public Comments on the Consent Agenda. A gentleman asked what is being built on the Cannery Row, and Acting Community Development Director Cole gave a brief presentation on the project proposed for Cannery Row. With no further requests to speak, Mayor Roberson closed public comments. Councilmember Smith asked to remove Item 11 from the Consent Agenda. Other 11. Initiate Amendments to the North Fremont Specific Plan (Not a project under CEQA, per Article 20, Section 15378 and under General Rule Article 5, Section 15061) (Plans & Public Works - 201-12) Action: Removed from Consent; discussed; approved Acting Community Development Director Cole gave the staff presentation and answered Councilmembers' questions. Mayor Roberson opened public comments on the item. Richard Ruccello said that over fifty people met to go over the issues. He stressed the need to review parking standards and supported the proposed amendments. Robert Yoha, Monterey resident, said that the North Fremont Plan started in 2009 and has been a long process. He thanked the Council and staff for their work to build a consensus and for making North Fremont a pedestrian-friendly street. Luis Osorio said that he was on the Subcommittee that worked on the first version of the plan. He said that it was difficult, changes were made, and we are still talking about the same things. He reviewed several issues that have been discussed through the process, and are still to be discussed. Having no further requests to speak, Mayor Roberson closed public comments. 3  City Council Minutes Tuesday, December 5, 2017 On question, Ms. Cole defined "adjacent to" as it is used in the proposed plan regarding commercial/residential use on the first floor. She said that the amendment should not put a project that is in the queue in jeopardy, and the applicant has already incorporated many of the ideas in his plan. Appoint Agency Negotiators for Conference with Real Property Negotiators Pursuant to Government Code Section 54956.8; Property: 585 Laine Street #2; Agency Negotiators: Kimberly Cole and Elizabeth Caraker; Negotiating Parties: Lane Hill Condominiums, Inc.; Under Negotiation: Price and Terms for Property Purchase (Not a Project Under CEQA per Article 20, Section 15378 and under General Rule Article 5, Section 15061) (Plans & Public Works - 207- 03) Action: Appointed Negotiators ***End of Consent Agenda*** COUNCIL COMMENTS Councilmember Haffa updated Council regarding FORA, saying that his vote regarding creating a successor JPA in 2020 rather than extending FORA was based on a desire to have a central regional body to discuss issues such as affordable housing. He supported the continuation of a successor agency to enforce agreements, and address costs of development of currently entitled projects. He announced that tomorrow the Eastside Parkway Forum will be conducted by FORA for public outreach at Carpenters' Union Hall in Marina. Councilmember Albert said the Cannery Row and City Hall tree lightings are part of what makes Monterey such a special city. He expressed his appreciation to the business associations that sponsored those events. He reported that he participated in the Citizens Police Academy, which allows participants to look into the operations of the PD. He congratulated Chief Hober on the success of the program. He reported on his tour of the Conference Center last week, saying it is magnificent. Councilmember Barrett wished everyone a Happy Holiday. He reported that he has attended several community meetings recently and noted that Monterey is a very involved community. He said that he is proud of that public participation. He said that he attended the State of the Region Economic Conference, which included a theme of how to deal with parking and a different community approach on how to deal with our City streets. He said a measure of success is how many people are on the street, not in cars. 4  City Council Minutes Tuesday, December 5, 2017 Councilmember Smith reported on recent TAMC activities, including improvements to Highway 156, Highway 68, proposed roundabouts, and other Measure X projects. He reported on a recent trip to Washington DC to discuss our community partnership with DLI with people at the Pentagon and a visit with Leon Panetta. He noted that almost every consent agenda includes several projects for DLI. He agreed that the Christmas tree lighting ceremonies were great, and he reminded people to buy local. Mr. Smith wished everyone Merry Christmas and Happy new Year. CITY MANAGER REPORTS City Manager McCarthy reported that the Fire Department has sent two engines for mutual aid to the Ventura County fire in Santa Paula. He said that tomorrow will mark the first major event at the City’s new Conference Center: the annual CalPelra Conference. He announced that Tuba Christmas will be held there on Sunday. Mayor Roberson opened public comments on the closed session items, had no requests to speak, closed public comments, and adjourned the meeting to closed session at 5:47 p.m. ANNOUNCEMENTS FROM CLOSED SESSION Information Resources Director/City Clerk Gawf announced the following closed session actions: cs1.
