CONSENT ITEMS Commissioner O’Brien requested to move item #2, 220 Olivier Street, off the Consent Agenda. Commissioner O’Neil made a motion to approve the Consent Agenda as amended. Commissioner Petty seconded the motion. On a motion by Commissioner O'Neil, seconded by Commissioner Petty, and carried by the following vote, the Historic Preservation Commission approve the CONSENT ITEMS: AYES: 7 COMMISSIONERS: Palminteri, Fletcher, Barlow, McLain, O’Brien, O'Neil, Petty NOES: 0 COMMISSIONERS: None ABSENT: 0 COMMISSIONERS: None ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None Approval of Minutes 1. Historic Preservation Commission Minutes Thursday, April 11, 2013 ACTION: Adopted a Resolution approving Historic Permit 13-117 for a new wood patio structure and ADA site improvements with Conditions of Approval. Staff Presentation/Commissioner Comments: Christine Hopper presented the Agenda Report and answered Commissioners’ questions. Applicant: Paul E. Davis, applicant, said they developed a semi-permanent structure and have altered the original design to include a removable metal roof. The project complies with the Americans with Disabilities Act (ADA) and allows access to the store/restaurant level and a portion of the patio area. Commissioner Petty asked about the water runoff from the roof pointed toward Olivier Street. In response to Commissioner Petty’s questions, Mr. Davis said the project includes a gutter which removes the water from the back property line and direts runoff to landscape areas. Public Comments: None. Commissioner Comments: Commissioner O’Brien made a motion to adopt a Resolution approving Historic Permit 13-117 for a new wood patio structure and ADA site improvements with Conditions of Approval. Staff Presentation/Commissioner Comments: Christine Hopper presented the Agenda Report and answered commissioners’ questions. Historic Preservation Commission Meeting Minutes 2 Thursday, April 11, 2013 2 Historic Preservation Commission Minutes Thursday, April 11, 2013 Applicant: The applicant was not present to speak on behalf of the proposed project. Public Comments: None. Commissioner Comments: Commissioner O’Neil said he agrees with the Staff recommendation that the alterations are not significant enough to alter the historic integrity of the building. Commissioner Fletcher made a motion to recommend that the City Council include 261 Laine Street in the New Monterey Reconnaissance Survey List. Commissioner Barlow seconded the motion. Commissioner Petty requested the recommendation and Resolution be reworded to state that staff recommends that the property not be excluded. The motion make and the seconder agreed to the amendment. On a motion by Commissioner Fletcher, seconded by Commissioner Barlow, and carried by the following vote, the Historic Preservation Commission Recommended that the City Council not exclude 261 Laine Street in the New Monterey Reconnaissance Survey List. Recommend Planning Commission Consider 458 High Street; Use Permit 12-365 for Historic Incentive to Allow Reduced Corner Side Setback for a Garden Shed; Applicant Henry Ruhnke; Owner Geoff Hunziker; R-1-6-H2 Zoning District; Exempt from CEQA Requirements (Continued from March 14, 2013 meeting) Commissioner Barlow recused himself from the item. ACTION: Adopted a Resolution recommending that the Planning Commission approve Use Permit it 12-365 for a historic incentive to allow a reduced corner side setback for a garden shed with added Conditions of Approval. Staff Presentation/Commissioner Comments: Christine Hopper presented the Agenda Report and answered Commissioners' questions. Applicant: Henry Ruhnke, applicant, said the owner has done a tremendous amount of work to restore the house. Mr. Ruhnke said they looked for an appropriate location that would be screened by trees. He said before they began construction, the home owners went to the City and were told no building permit was needed. Mr. Ruhnke said during construction they were issued a Stop Work Order. Mr. Ruhnke said the height of the structure is slightly above the 12 foot maximum height. He noted that moving the garden shed a few feet forward would block the ocean view for the neighboring property. Mr. Ruhnke detailed history of prior incentives to encourage the restoration of Historic properties. He concluded his presentation by saying he believes this addition of this garden shed supports the restoration and preservation of the Historic property. Chair Palminteri asked the applicant to estimate the size of the structure. In response to Chair Palminteri, Mr. Ruhnke said the structure is 96 square feet. Public Comments: Tammy Hunziker, property owner of 458 High Street, said they have worked hard to restore the historic structure. She said they came to the City before embarking on construction of the garden shed and believed they were in in compliance with all standards. She also noted that when they bought the home there was a large garden shed on the property. She requested the Commission take into consideration that the project is a necessity to preserve the Historic home. Commissioner Comments: Commissioner O’Neil said she is sympathetic that the property has front setbacks on three sides. Chair Palminteri said the issue at hand is deciding whether the location of the garden shed helps preserve or promote the preservation of the historic property. Commissioner McLain said she would prefer to see the structure meet the setback. Chair Palminteri said the intention of the incentives were to allow development consistent with the Secretary of the Interior's standards. Commissioner Fletcher said the garden shed would contribute to the maintenance of the property. In response to Commissioner Fletcher’s comment, Commissioner McLain said the garden shed would not contribute or promote maintenance of the historic property. Chair Palminteri made a motion to adopt a resolution to recommend that the Planning Commission approve a Use Permit for a corner side setback with the following findings: The garden shed contributes to the preservation of the historic property by situating itself far from the original property creating larger area for gardens. Commissioner Fletcher seconded the motion. On a motion by Commissioner Palminteri, seconded by Commissioner Fletcher, and carried by the following vote, the Historic Preservation Commission adopted a resolution recommending the Planning Commission approve a Use Permit for a corner side setback with the finding that the garden shed contributes to the preservation of the historic property by situating itself far from the original property creating larger area for gardens. Commissioner Fletcher seconded the motion. Commissioner McLain said she would like input from the neighboring property owners. She also said that every historic building is unique and therefore should be analyzed on an individual basis, without reference to prior cases that utilized incentives. Commissioner Petty asked the applicant how much modification the garden shed could sustain due to its partial construction. Ms. Hunzker said a significant amount of the structure has already been constructed and it would be difficult to move or alter it significantly. Commissioner Fletcher made a motion to continue the item. There was no second to the motion. Commissioner Petty made a motion to adopt a Resolution recommending that the Planning Commission approving Historic Permit 12-365 for a historic incentive to allow a reduced corner side setback for a garden shed with the following finding: The location maximizes the use of the lot to allow for future development on the site. Chair Palminteri seconded the motion and added the following Condition of Approval: Special Condition: 1. The height and design be reviewed by the Historic Preservation Commission. The motion maker accepted the Special Condition. On a motion by Commissioner Petty, seconded by Commissioner Palminteri, and carried by the following vote, the Historic Preservation Commission adopt a Resolution recommending that the Planning Commission approving Historic Permit 12-365 for a historic incentive to allow a reduced corner side setback for a garden shed with added Condition of Approval. Consider 570 Pacific Street; Historic Report Application 13-042 for Adoption of Colton Hall Museum Conditions Update and Preservation Maintenance Program; Applicant/Owner City of Monterey; CO-H1 Zoning District; Exempt from CEQA Requirements. ACTION: Adopted a Resolution approving Historic Report Application 13-042 adopting the Colton Hall Conditions Update and Comprehensive Preservation Maintenance Program, 2012. Staff Presentation/CommissionerComments: Christine Hopper presented the Agenda Report and answered Commissioners' questions. Applicant: Dennis Copeland, applicant, said he is willing to answer any questions. Public Comments: Mike Dawson, President of the Association of Monterey Area Preservationists (AMAP), said AMAP was unanimous in its recommendation to adopt the report and apply for National Historic Landmark designation for the building. Mike McLain, said he is in opposition to stuccoing Colton Hall as it is difficult to maintain. He also said stone is much more aesthetically pleasing. Sharon Dwight, New Monterey Neighborhood Association, said the request for funding for this project goes before the Neighborhood Improvement Program (NIP) on April 25, 2013. She invited the Commissioners to attend the meeting. Commissioner Comments: Commissioner O’Neil said she is in support of the adoption of the Colton Hall Conditions Update and Comprehensive Preservation Maintenance Program. Commissioner Petty made a motion to adopt a Resolution approving Historic Report Application 13-042 adopting the Colton Hall Conditions Update and Comprehensive Preservation Maintenance Program, 2012. Commissioner O’Brien seconded the motion. On a motion by Commissioner Petty, seconded by Commissioner O’Brien, and carried by the following vote, the Historic Preservation Commission Adopted a Resolution approving Historic Report Application 13-042 adopting the Colton Hall Conditions Update and Comprehensive Preservation Maintenance Program, 2012. ACTION: Adopted a Resolution approving Historic Permit 13-122 for exterior alterations and site improvements at 290 Figueroa Street with Conditions of Approval. Staff Presentation and Commissioner Questions: Christine Hopper presented the Agenda Report and answered Commissioners' questions. Applicant: Henry Ruhnke, applicant, said they have worked closely with staff and the historian. Commissioner Petty asked about the upgrades to the restroom. In response to Commissioner Petty's inquiry, the applicant said the tile in the restroom is historically significant and the plumbing fixtures chosen create a simple solution to enable ADA accessibility while ensuring preservation of the historic tile. Public Comments: John McCleary noted the committee should take into consideration the option of the doors swinging outward. Commissioner Comments: Commissioner O’Neil said he is pleased with the project. Commissioner O’Brien and Commissioner Fletcher concurred. Commissioner O’Neil made a motion to adopt a Resolution approving Historic Permit 13- 122 for exterior alterations and site improvements at 290 Figueroa Street with Conditions of Approval. Commissioner O’Brien seconded the motion. On a motion by Commissioner O'Neil, seconded by Commissioner O’Brien, and carried by the following vote, the Historic Preservation Commission adopted a Resolution approving Historic Permit 13-122 for exterior alterations and site improvements at 290 Figueroa Street with Conditions of Approval. Receive Report on New Monterey Neighborhood Association Letter Regarding New Monterey Historic Context Statement Historic Preservation Commission Meeting Minutes 7 Thursday, April 11, 2013 7 Historic Preservation Commission Minutes Thursday, April 11, 2013 Christine Hopper Presented the Report and answered Commissioners' questions. Sharon Dwight, New Monterey Neighborhood Association, said eclectic is not defined within the Context Statement. She said without a definition you cannot adequately assess its historic significance. Commissioner Fletcher asked what mechanisms, in addition to age, are in place to protect mid century architecture. In response to Commissioner Fletcher's question, Ms. Hopper said there a couple different mechanisms one of which is themes. She said this adds another level of protection. Commissioner O’Neil suggested agendizing the item. Commissioner Petty concurred and said the item needs to come back before the Commission due to its potential implications for future areas of the city.
