CONSENT ITEMS Approval of Minutes 2. July 08, 2024, Field Trip 3. July 11, 2024 Public Comments None. Commissioner Comments Commissioner O’Neil clarified comments they made about the Oak Grove neighborhood and ADUs. Chair Rath stated the minutes are very general and then requested additions to the minutes to reflect the applicant’s refusal of modifications. Commissioner Smith-Crivello requested further clarity regarding comments they had made at the meeting. Commissioner Barlow clarified that the HPC was not evaluating or choosing between the two historic reports from the previous meeting item. Rodriguez abstained from voting on both minutes as he was absent. ACTION: Approved as amended On a motion by Commissioner O’Neil, seconded by Commissioner Smith-Crivello, and carried by the following vote, the Historic Preservation Commission approved the CONSENT ITEMS as amended, by the following vote: Rath, Barlow, Collum, O’Neil, Pyzel, Smith- AYES: 6 MEMBERS: Crivello NOES: 0 MEMBERS: (None) ABSENT: 0 MEMBERS: (None) Docusign Envelope ID: 4F17453D-28A7-40E8-AF40-D703238AAA4A Historic Preservation Commission Minutes Thursday, August 08, 2024 ABSTAIN: 1 MEMBERS: Rodriguez RECUSED: 0 MEMBERS: (None) PUBLIC COMMENTS None. PUBLIC HEARING Commissioner Rodriguez confirmed with assistance from Planning Manager Hill that they lived over one thousand feet from the project site and per the Brown Act did not need to recuse themselves from item number four. 4. Consider 603 and 605 Hoffman Avenue; Historic Permit Amendment Application PA- 24-0090 for Alterations to the Historic Dwelling and Amendment of the Historic Preservation Report; Applicant Susana DeFatima Silva; Owner Test of Tyme, LLC; R-3-5-H2 Zoning District; Medium Density Residential General Plan Land Use Designation; Exempt from CEQA per Article 19, Section 15301 and 15331, Class 1 and 31 ACTION: Approved as submitted Staff Presentation/Committee Member Questions Associate Planner Buggert presented the Agenda Report and answered commissioner questions regarding the timeline of the project, the state of the historic house before the 1950s, the windows, and if the project received any comment letters. Commissioner Smith-Crivello commented that the alterations were already made, but that they were presented as “proposed” and wanted to make sure that the resolution properly stated that the approval is a retroactive approval. Hill assisted by clarifying what the HPC was being asked to approve. Applicant Don Whitaker provided a detailed explanation of the double-hung windows, the overall scope of the project, and the approach taken with the windows. He pointed out that the aluminum windows do not seem to be original or historic, and observed that the exterior retains the typical appearance of a historic Victorian home. The Commission inquired whether Whitaker could determine the original size of the window openings, to which Whitaker responded that it was not possible due to significant alterations to the openings. The Commission then asked if Whitaker had ordered the windows after the siding was removed. Whitaker confirmed that they had fabricated the windows, and yes, they were made after the siding had been removed. Whitaker clarified that they were speaking as the project applicant/contractor. Public Comments None. Commissioner Comments The Commission expressed appreciation for the updates and believed the windows to be an improvement to the home. Receive Mills Act Inspections Informational Report (Not a Project Under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) ACTION: Received report The Commission appreciated Buggert’s work in providing the informational report. Vice-Chair Rodriguez had questions regarding older historic properties that did not have maintenance schedules, the process of cancelling a contract, who determines if the property is in breach of contract, the properties listed in the report as not inspected, enforcement of the Mills Act contracts, and if the City has cancelled any contracts in recent history. Both Hill and Buggert responded to Commissioner Rodriguez’s questions. Commissioner Barlow then asked if there was a process for modifications to the maintenance plan. Buggert responded that the process for modifications was on a to-do list for the coming year. Barlow stated that the Commission should be cognizant of and encourage consistency across maintenance plans. Buggert then noted that staff is looking to update maintenance plans for consistency and accessibility soon. Hill updated the Commission on the progress of the Mills Act Fiscal Analysis and answered questions regarding the demographics served as well as what financials were analyzed. The Commission further discussed potential updates to the Mills Act program maintenance plans. Hill confirmed that when Mills Act properties are sold the contract persists. Hill informed the Commission that in order to cancel the Mills Act contract for a property the new owner would have to make a request with the City and pay a fee. Rodriguez expressed a desire to discuss Mills Act properties that are or were destroyed by neglect. Public Comment None. PUBLIC COMMENT PROCEDURES AND TIME LIMITS: The total amount of time allocated for public comment on a particular issue and for each individual speaker is generally as follows: 1. Up to three minutes per speaker. 2. For regular Historic Preservation Commission meetings, there is one 15-minute public comment period for items not on the agenda. 3. The total time allocated for public comment: a. Items pulled from the consent agenda – 15 minutes each item b. Public Appearance items – 30 minutes each item c. Public Hearing items – 30 minutes each item At the time an item is considered, the Chair will ask those attending the meeting in person to line up at the podium or raise their hands, and for remote participants to use *9 on the telephone or the “raise hand” function in Zoom, if they wish to address the Historic Preservation Commission. Planning Office Update ADJOURNMENT The general policy of the Historic Preservation Commission is that the Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no later than 11:00 p.m. Any public agenda items that have not been completed within the designated adjournment time may be formally extended by the Commission, or continued to the next regularly scheduled Historic Preservation Commission Meeting, or continued to a Special Meeting. Writings distributed for discussion or consideration on these matters within 72 hours prior to the meeting, pursuant to Government Code § 54957.5, are available at: monterey.gov/submitted- comments and in the Planning Office at 570 Pacific St., Monterey, CA 93940 during regular business hours. Information distributed to the Historic Preservation Commission at the Historic Preservation Commission meeting becomes part of the public record.
