Brown Act, Calif. Government Code section 54953(e)(1)(C) and the City Council's resolution authorizing teleconferencing. CALL TO ORDER Action: NCIP Chair Heuer called the meeting to order at 6:00 p.m. Staff Coordinator Tom Harty explained to the public how to participate in the meeting virtually via Zoom teleconference. ROLL CALL Action: Called roll with 12 neighborhoods represented and 3 neighborhoods absent (Aguajito Oaks, Deer Flats, New Monterey).  Neighborhood and Community Improvement Program 5/19/2022 6:00:00 PM Committee Minutes One neighborhood arrived late: New Monterey arrived at approximately 6:30 pm. PUBLIC COMMENTS Tom Reeves, resident of 844 Pine Street, spoke regarding NCIP funding. He said NCIP is not meant to be used for projects that can otherwise be funded through other sources and said he feels that Council defunding projects was a violation of the Charter. He also discussed a storm drain improvement project on the 800 block of Pine Street and asked the Committee how they would address projects that fail to meet the intent of what they were originally funded for. Tammy Jennings discussed the recent City Council meeting and the City budget presentation. She asked if Council will take funding from NCIP projects. Kelly Violini, CEO of the Monterey County Fair, spoke in support of her project COK-4 and said as a state agency they would be willing to pay for a portion of the project and asked what they can do to partner and get it done. APPROVAL OF MINUTES 1. May 5, 2022 (Not a Project Under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) Action: Approved as submitted. Committee Member Duke introduced a motion to approve the May 5, 2022 minutes as submitted. The motion was seconded by Committee Member Whitney. NCIP INFORMATIONAL REPORTS 2. NCIP Spokesperson Reports NCIP Chair/Spokesperson Heuer said Staff is working on pulling together information regarding the ending balance for an item to be placed on the next meeting agenda. NCIP Committee Follow-up Discussion and Public Input of Proposed Projects: Aguajito Oaks – New Monterey (Not a Project Under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) NCIP Chair/Spokesperson Heuer began the proposed project review, starting with the Alta Mesa neighborhood. Public Works Director Wittry said the City is proceeding with Measure P/S funding for AM-9. Mr. Heuer said it can be removed from the NCIP project nomination list. Committee Member Ruccello removed COK-1 since it only requires one remaining sign to be placed and Staff Coordinator Harty confirmed it will be done. Committee Member Jannasch said MV-8 has been completed and can be removed and he spoke to the submitter. He requested the estimate for MV-18 be reduced to $250,000 for a portion of the construction cost of the project so it is a phased construction project. Public Works Director Wittry discussed the estimating process and impacts due to inflation. Public comment was received from: Donna Gibson said she was speaking on behalf of the Parks and Recreation Commission (PRC) and said AM-5, AM-7 and AM-8 are projects PRC has supported in the past; Mike Dawson spoke in support of AM-11; Donna Gibson said she was speaking on behalf of PRC and said COK-5 is supported by PRC; Robert Yoha spoke in support of COK-5 and clarified the fence style; Donna Gibson said she was speaking on behalf of PRC and said DMB-1, DMB-2 and DMB-5 are projects PRC has supported in the past; Lara Nagel, Del Monte Beach Neighborhood Association President, said she had not heard of the survey monkey results reported by Committee Member Fields and that the neighborhood association mailed out a survey to every resident of the neighborhood and received twice the response as Committee Member Fields’ survey and said the number one selection was for the toilets (DMB-3); Debra Proctor, resident of Dunecrest, spoke regarding her concern over DMB- 12 and the impact to entrance and exit roads in the neighborhood and how safe entry is compromised for bikers and pedestrians; Esther Malkin, President of the Del Monte Grove- Laguna Grande Neighborhood Association, discussed the Laguna Grande Soccer Field, spoke in support of DMG projects, and discussed her neighborhood’s priority for safety projects; Brandon Naylor spoke in support of DMG-3, DMG-4, DMG-5, DMG-7 and safety projects; Melissa Mannix spoke in support of her submitted project DT-25 and said she submitted it as a member of the Downtown Neighborhood Association; Tom Reeves spoke regarding DT-5 and said the Big Sur Land Trust will be working on landscaping improvements on the Hartnell Gulch portion of their property and he encouraged the City to coordinate with them if and when the project receives funding; Gary Kreeger spoke in support of DT-16; Teresa Bennett spoke in support of her submitted project DT-16; Donna Gibson said she was speaking on behalf of the PRC and spoke in support of DT-5; Sherna Stewart spoke in support of DT-4; Donna Gibson said she was speaking on behalf of the PRC and spoke in support of FF-6 and suggested smaller trees due to the drought; Jane Sink and her husband spoke in support of MV-15 and discussed traffic and parking issues on their street; Bob Tachibana spoke in support of MV-11; Gina Sessions spoke in support of MV-10 and stated support from her neighborhood; Robin Elahi spoke in support of MV-14; Debby spoke in support of MV-12; Tom Reeves spoke in support of NM-24 and discussed stop sign needs and options; Cesare Paci, a resident at the corner of Oak Street and Hoffman, spoke in support of NM-25; Lee Henderson, a resident of Neighborhood and Community Improvement Program Committee Meeting Minutes 5/19/2022 6:00:00 PM 3  Neighborhood and Community Improvement Program 5/19/2022 6:00:00 PM Committee Minutes Oak Street, spoke in support of NM-25. Donna Gibson said she was speaking as a private citizen and resident of the 500 block of Oak Street and spoke in support of NM-25 and in opposition of NM-29. COMMITTEE MEMBER COMMENTS Committee Member Tipton requested conflict project information from Staff Coordinator Harty in regards to the Fair Political Practices Commission (FPPC). Committee Member Ruccello asked the NCIP to come up with a contingency amount. He asked Committee Chair Heuer to discuss the financial condition of the City with the City Manager and how it may affect the NCIP and to bring back the information to the Committee. Committee Member Duke discussed contingency and ending balance funds, and his request to have NCIP support for the community wildfire protection plan as an item on an upcoming agenda. Committee Member Fields discussed the estimating process and cut-off projects. Committee Chair/Spokesperson Heuer yielded his time as a Committee Member for Mayor Clyde Roberson to provide information to the Committee during Committee Member Comments: Mayor Clyde Roberson said the City had a sobering budget primer, as described by City Manager Hans Uslar, at the Council meeting Tuesday night. Mayor Roberson suggested taking a look at the written report on the agenda and listening to the presentation, saying it will answer questions with respect to the status of the City budget.
