There were no questions from Committee Members. Applicant The project applicant, on behalf of Property Solutions West, LLC, was present and declined to speak. Public Comments Max Troyer expressed appreciation for the information provided and spoke in support of this project as presented in Exhibit A. Committee Member Comments Chair Reed said this seemed like a nice quick easy presentation, and the project makes sense. Massey; R- 3-6 Zoning District; Medium Density Residential General Plan Designation; Exhibit A requires Initial Study Pursuant to CEQA; Exhibit B is Exempt from CEQA Requirements, Article 19, Section 15305, Class 5 ACTION 1: Recommended referral of the proposal to the Planning Commission and recommended they deny Option 1, Exhibit A, of Minor Subdivision application SD-21-0159 to split a 7,200 square-foot parcel (APN 001-373-010- 000) into two separate parcels (proposed options for the Minor Subdivision as Exhibits A and B) at 246 Anita Street and 251 Clay Street, with corrections regarding “meets” and “does not meet” as specified in the presentation ACTION 2: Recommended that the Planning Commission deny Option 2, Exhibit B, of Minor Subdivision application SD-21-0159 to split a 7,200 square-foot parcel (APN 001-373-010-000) into two separate parcels (proposed options for the Minor Subdivision as Exhibits A and B) at 246 Anita Street and 251 Clay Street, with corrections regarding “meets” and “does not meet” as specified in the presentation Staff Presentation/Committee Member Questions Principal Planner Sabdo presented the Agenda Report and answered Committee Member questions. Community Development Director Cole clarified that the Minor Subdivision Committee could not make a final decision on either proposal as neither meets the findings for approval, and specified their role is to recommend the item to a Planning Commission hearing. Chair Reed asked if it would have to go to the Planning Commission either way. Ms. Cole confirmed it would. Applicant Applicant and owner Dorothy Massey further described the plan set on Exhibit B and remained present to answer questions. Public Comments None. Committee Member Comments Chair Reed asked what discouraged meant as presented. Ms. Cole explained the irregular lot shape is discouraged and not banned. Chair Reed suggested the odd structure possibly works better than the unreasonable one and asked how Senate Bill 9 (SB9) fits into this lot split. Ms. Cole explained this application was submitted before SB9 became effective, described SB9 allowances, and specified SB9 projects require a separate ministerial process and application. Chair Reed further suggested there did not seem to be enough benefit to overcome the discouragement such that it benefits the community or neighborhood and recommended going to the Planning Commission or through SB9 analysis. Committee Member Harty agreed that discouraged is different than prohibited and suggested that although the atypical property line is more palatable knowing the geometry can work, it clearly makes more sense as a straight line. Chair Reed added that either way, the project will go to the Planning Commission and Planning Staff would talk to the applicant about SB9. Chair Reed moved to refer the project to the Planning Commission and recommend denial of Minor Subdivision application SD-21-0159 between 246 Anita Street & 251 Clay Street for Option 1, Exhibit A, because it does not meet findings. Ms. Sabdo requested the motion be amended to specify findings met and not met. Chair Reed amended the motion to correct “meets” and “does not meet” as discussed in the presentation. Committee Member Harty seconded the amended motion. On a motion by Chair Reed, seconded by Committee Member Harty and carried by the following vote, the Minor Subdivision Committee recommended referral of the proposal to the Planning Commission and recommended they deny Option 1, Exhibit A, of Minor Subdivision application SD-21-0159 to split a 7,200 square-foot parcel (APN 001-373-010- 000) into two separate parcels (proposed options for the Minor Subdivision as Exhibits A and B) at 246 Anita Street and 251 Clay Street, with corrections regarding “meets” and “does not meet” as specified in the presentation. Ms. Sabdo explained that if the proposal meets the Old Town Area Plan, Finding 1 would be “does not meet”. Chair Reed suggested it meets Finding 1 because it does not comply with the Old Town Area Plan. Ms. Sabdo clarified “meets” is the accurate verbiage in that case. Ms. Cole asked if the motion ultimately does not support the subdivision in Option 2, Exhibit B. Chair Reed confirmed that is what he recommends and stated he does not support the Exhibit B design. Committee Member Harty seconded the motion. He stated he did not think the “discouragement” overcomes this proposal as it has not met that threshold. Ms. Sabdo stated applicant wanted to speak again. Chair Reed did not reopen public comment and recommended applicant speak with Planning Staff.
