Brown Act, Calif. Government Code section 54953(e)(1)(C) and the City Council's resolution authorizing teleconferencing. CALL TO ORDER Action: NCIP Chair Heuer called the meeting to order at 6:00 p.m. Staff Coordinator Tom Harty explained to the public how to participate in the meeting virtually via Zoom teleconference. ROLL CALL Action: Called roll with 13 neighborhoods represented and 2 neighborhoods absent (Aguajito Oaks and Oak Grove). PUBLIC COMMENTS Neighborhood and Community Improvement Program 4/13/2023 6:00:00 PM Committee Minutes Public comments were made by Nina Beaty and Terry Pipes. APPROVAL OF MINUTES 1. February 23, 2023 (Not a Project Under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) Action: Approved as submitted. Committee Member Fields introduced a motion to approve the February 23, 2023 minutes as submitted. The motion was seconded by Committee Member Rasch. The motion carried by the following vote: AYES: 13 COMMITTEE MEMBERS: Heuer, Ruccello, Overton, Fields, Hansen, Lofaso, Rowley, Whitney, Rasch, Ogbonna, Harrison, Duke, Peterson NOES: 0 COMMITTEE MEMBERS: ABSENT: 2 COMMITTEE MEMBERS: Aguajito Oaks, Oak Grove ABSTAIN: 0 COMMITTEE MEMBERS: RECUSED: 0 COMMITTEE MEMBERS: INFORMATIONAL REPORTS & STAFF COMMENTS Staff Coordinator Harty reported that conflict maps were being prepared. NCIP Engineering Project Manager Paulding gave status reports on funded projects. NCIP INFORMATIONAL REPORTS 2. Monterey City Clerk Presentation on AB 2449 and Traditional Brown Act Teleconference Rules (Not a Project Under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) Staff Coordinator Harty had technical difficulties sharing the recorded presentation from the City Clerk and made a verbal report on teleconference requirements. 3. NCIP Spokesperson Reports NCIP Chair Heuer reported that he met with the City Manager, City Attorney, and Tom Harty to discuss the Citywide designation being removed. Heuer reported that ultimately all projects must have a neighborhood designation since all projects are in a neighborhood. Approve Funding for Two FY 2022-23 Cut Off Projects (Not a project under CEQA Article 20, Section 15378 and under General Rule Article 5, Section 15061) Action: Approved. Committee Member Ruccello introduced a motion to Approve Additional Funding for Two FY 2022-23 Cut Off Projects. The motion was seconded by Committee Member Rowley. NCIP Committee First Review of Proposed Projects: Aguajito Oaks – Monterey Vista (Not a Project Under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) Staff Coordinator Harty reviewed proposed project Aguajito Oaks – Monterey Vista, receiving public and committee comments after reviewing each neighborhood. Aguajito Oaks Neighborhood Public and Committee Comments: Public comment was received by a number ending in 902 in regards to AM-01 asking for clarification the path proposed. NCIP Chair Heuer clarified that the path is an existing path. Casanova Oak Knoll Public and Committee Comments: Public comment was received by Robert Yoha in favor of COK-03. Committee Member Ruccello commented in favor COK-01, COK-03, and COK-05. Staff Coordinator Harty discussed getting clarity from the project submitter on COK-01 on whether or not the proposal is including camera monitoring. Deer Flats Public and Committee Comments: No comments were made by the public or committee. Del Monte Beach Public and Committee Comments: Public comment was received by Committee Member Hans Jannasch on DMB-02 on whether erosion is an issue for the project. Committee member Fields commented that the Portland Loo company felt confident that the restrooms would hold up. Committee Member Ruccello commented that the loo is stainless steel and holds up well in the climate. Del Monte Grove-Laguna Grande Public and Committee Comments: Staff Coordinator Harty will remove DMG-03 as the committee approved to fund it. Public comment was received by Nina Beaty about DMG-02 and concern for noise levels. Downtown Public and Committee Comments: Public Comment was received from Nina Beaty in support of DT-09. Nina Beaty commented on the safety and health concern associated with DT-15 and converDT-06. Committee Member Ruccello commented in support of DT-09, concern of allocating money to the youth center as it is in a tsunami zone, support of DT-06, and support of DT-17. Committee Chair Heuer commented in support of DT-01. Committee Vice Chair Rasch commented on DT-15 concerned about toxicity levels of artificial turf. Committee Member Rowley commented in support of DT-17. Fishermen’s Flats Public and Committee Comments: Committee Member Rowley commented that submitter for FF-01 and FF-04 no longer resides in Monterey and that he does not have signatures of support from neighbors for FF-02 yet. No projects were nominated for Glewood. Monterey Vista Public and Committee Comments: MV-03 was completed and removed, MV-04 was completed and removed, and MV-12 was approved to go to council and removed. Public comment was received by Ray Myers in support of MV-08. Public comment was received by Nina Beaty in support of MV-10 and opposed MV- 12. Public comment was received by Bruce Anetta in support of MV-08. Public comment was received by Committee Member Jannasch in support of MV-08. Adopt the Updated Neighborhood and Community Improvement Program Committee Deadline and Meeting Schedule for Development of the FY 2023/24 Neighborhood and Community Improvement Program (Not a Project Under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) Action: Adopted. NCIP Chair Heuer introduced a motion to the Updated Neighborhood and Community Improvement Program Committee Deadline and Meeting Schedule for Development of the FY 2023/24 Neighborhood and Community Improvement Program. The motion was seconded by Committee Member Rowley. The motion carried by the following vote: AYES: 13 COMMITTEE MEMBERS: Heuer, Ruccello, Overton, Fields, Hansen, Lofaso, Rowley, Whitney, Rasch, Ogbonna, Harrison, Duke, Peterson NOES: 0 COMMITTEE MEMBERS: ABSENT: 2 COMMITTEE MEMBERS: Aguajito Oaks, Oak Grove ABSTAIN: 0 COMMITTEE MEMBERS: RECUSED: 0 COMMITTEE MEMBERS: COMMITTEE MEMBER COMMENTS Committee Member Ogbonna commented that NM-19 would be added back to the list of nominated projects. Committee Chair Heuer commented that he would not be in attendance for the next meeting. Committee Member Adam commented that she would be attending the next meeting remotely and would provide her address.
